SUPER SPREADER SYMPOSIUM

Because we are prohibited, pursuant to a consent decree from publicly even mentioning the name of a particular Listserv which begins with the letter F- so let's call it "the F word" , we must speak hypothetically, lest we find ourselves in a Dep/Hurd-like defamation lawsuit. 

So assume hypothetically the F Word Listserv had members who attended some sort of federal seminar ten days or so ago. And assume hypothetically the lawyers who attended the seminar started feeling sick a few days after attending the event. And assume hypothetically some of the lawyers on the F Word copy and send emails to yours truly, then what emerges is a picture of a ....

SUPER SPREADER COVID EVENT .... (cue ominous omicron  music). 

Covid/Omicron is ripping through a dedicated group of federal defenders who just wanted to attend a resort, get some CLE, and whilst at the bar, be able to say "so then during cross of the government's snitch I get them to say they met with my client ten times without telling the government. The judge sent the jury out of the room and ripped into the prosecutors for not disclosing that and they dismissed the case the next day..." 

Because what's a CLE conference without a little alcohol-fueled war-stories-bragging? 

If you close your eyes and imagine the Great Gatsby, that's what we imagine the off hours at the Super Spreader event to be. Men in tuxedos, women in long evening gowns, sipping champagne cocktails, sans mask, laughing at hoi poloi  wearing masks serving them petit fours while musicians playing violins stroll the grounds. 

In any event, as Rocky said in Rocky I, "If youse wanna dance you gotta pay the band. If youse wanna play, youse gotta pay the man. "

Paying the man in this instance being getting Covid for being so confident that your vaccine status protected you from Omicron. It does not and it will not do so until the new batch of vaccines this fall are approved. 

We hope all of you recover quickly and remember, a lawn party does not give you the right to not wear a mask. No mask=Covid. It is as simple as that. Be safe.

POST XMAS COVID

 Good Monday morning. Congrats again to Clay Kaeiser who won the world famous REGJB Blog Survivor Pool. Look for the lawyer wearing the "I won the Blog Survivor Pool 2021 and all I got was this lousy t-shirt". Runner up Retired Judge Jon Colby was betrayed by the Chargers who got trounced by the lowly Texans. Yesterday we won 2 of 3 picks, and more importantly, after just squeaking into the REGJB Fantasy Football playoffs in the last slot, we upset the number three seed and advance to the semi finals along with Judge De La O, and top seed Born Tua Be Wild and second seed Norwood's Revenge. We have one standout player- WR Cooper Kupp who has carried us all year. But in the playoffs, anything can happen. 

If you get the emails from the SAO then you know yesterday they decided to alert everyone that they had SEVEN more employees test positive for covid the prior week and decided to tell us all the places their employees had been in the following week, including Whole Foods, a few dive bars in Hialeah, a crypto-mining emporium, Gulfstream racetrack (Not Guilty in the Fifth), and various houses of worship. 

Where is the leadership here? Why aren't SAO and PD employees required to wear masks?  Or is the SAO all of the sudden concerned with individual rights that don't concern the Fourth Amendment, which they trample without a Second Amendment thought. 

This is why Judges must require all people in their courtrooms to wear masks, because the "leadership" of those two offices are too busy counting pens and paperclips. Especially since the Miami-Dade Jury Trial task force recommended suspending jury trials until Mid-January but the Florida Supreme Court will not issue the order (there is apparently spotty internet in Aspen). 

You think our New Year's resolution was to become kinder and gentler? Think again. We are riled up to mix it up in 2022. Bring a little Alex Michaels to the blog- what do you think about them apples? 

Get vaccinated. Get boosted -in Israel they are testing a fourth booster. Wear a mask. Avoid Venezuelan made voting machines with Chinese Spyware.  Stay safe.

MASK UP 2.0

 Now you see them; now you don't. First you don't need to wear them; then you do; then you don't; now you have to wear them again when you enter the courthouse. Thank you, Omicron. 

On Thursday Chief Judge Sayfie issued the order- if you enter a Miami-Dade Courthouse you have to wear a mask.

Why Thursday? It's complicated. 

Who do you think owns the REGJB? The rumored shadowy Japanese real estate conglomerate that went on a spending spree in the bubble 1980s and bought Rockerfeller Center is not the owner of the REGJB despite QAnon hinting otherwise. Neither is the Trilateral Commission or Venezuela - the country that makes all the US voting machines. 

Nope, good old Miami-Dade County owns our courthouses which means the Mayor can issue orders about entering county owned buildings. And when Miami Dade Mayor Cava issued the mask order this week, Judge Sayfie quickly followed. 

On Thursday the hard-working Miami Jury Trial Task Force (yes there really is such a thing. They Zoom weekly and have some top doctors donating their time advising Miami judges and lawyers) recommended that jury trials be suspended until mid-January. But since the Florida Supreme Court (Motto: "Ignoring precedent and medical advice since 2018")  has not approved such a measure, Judge Sayfie cannot issue such an order, no matter how many lives it would save.  Gotta follow the Florida Supreme Court don-cha-know. Of course, in silly matters like, say, the death penalty, the Florida Supreme Court doesn't follow the Floirida Supreme Court. But why get bogged down in details when talking about a vicious virus that kills people? 

So on this Christmas Eve, some sense of reason has returned as we battle this deadly endemic.

COVID POSITIVE WEB PAGE FOR COURT

 What do you do when the number of people who are covid positive who have been in the courthouse is rising exponentially, and you do not have the ability to send an email every ten minutes alerting everyone to another twenty something maskless ASA who tested positive for covid? 

You set up a webpage! 

Introducing...the Eleventh Judicial Circuit's Covid 19 self monitoring web page! Ta da! 

Just go on the webpage and see that pretty much the only place a covid positive person has not been in the REGIB in the last few days is in a janitor's closet on nine- and that's only because the cleaning person tested positive last week and hasn't been in work since. 

Because pretty much every place has had someone who tested positive for covid, we suggest that the media advisory people now do the opposite and send emails alerting people where it is safe to go. 

"The Dade County Courthouse law library has not had anyone who has tested positive for covid in the last week. It is safe to go there, particularly the section reserved for judicial research." 

Is December 23 Christmas eve eve? 

Is December 29 New Years eve eve?

How do you throw out a garbage can?

WOLFSON PULLS THE PLUG

 Because of the two C's- Covid and Christmas, Judge Wolfson has pulled the plug on jury trials in the REGJB for the last two weeks of the year, thwarting Rumpole's plans for a Christmas acquittal ala Team Markus and their victory last week. 

If you want to clog up your email inbox, then subscribe to the Media Advisories out of the SAO because just like this summer, prosecutors are catching covid quicker than they can file a DV case with no discernable injury.  You'll get twenty or so an hour, every hour, announcing that "Unfortunately" two or more unnamed employees have tested positive for covid because for some reason prosecutors do not believe in wearing masks. 

Omicron is going to be bad folks. Very bad. If you're not vaccinated and boosted and you get sick and need to go to a hospital, you will have a better chance of getting a prosecutor to go below a misdemeanor DV complaining witness's request for forty years in prison than getting into a hospital because not only are they going to be overwhelmed because of the sheer volume of people infected, but the breakthrough ability of the virus is going to hit the medical profession hard. And when doctors and nurses are sick, they cannot work. And if they cannot work, there is no one to intubate you. 

You're on your own maskless C prosecutors. And you heard it here first.

QUESTIONABLE COVID DECISIONS

 Federal Judges are canceling jury trials. See DOM's blog here.  McDonalds is closing      in- restaurant dinning. Our Starbucks has closed in-store ordering, eating and drinking for over a year. 

You know who is up and running and ignoring Covid like an Oklahoma preacher? Miami-Dade County Court, that's who! Last week they had TWO jury trials. One covered by Ace Herald Reporter David Ovalle involved a serious charge against a police officer. The case fell apart when the main evidence was altered or doctored once in the custody of the State Attorneys Office, the irony being the officer was charged with falsifying official documents. No word on whether that hot mess will be re-tried. The OTHER jury trial in County Court last week was ....wait for it...A RECKLESS DRIVING CHARGE!! Not a DUI where the jury came back with a reckless verdict. The actual charge was reckless driving. Jurors were called from the community down to a Justice Building Courthouse which has been glowing red-hot with covid all summer. Court personnel, a Judge, clerks, a court reporter were all brought into a courtroom -and they RISKED THEIR LIVES TO TRY A RECKLESS DRIVING CASE. 

TALK ABOUT BEING RECKLESS! 

Folks, this is madness, pure and simple. 

We have a Delta Variant 100X more virulent than the original disease. We have breakthrough infections of people vaccinated- including several well known REGJB lawyers- and we have people dying. What we should NOT be doing is trying reckless driving cases before juries. Period. End of discussion. 

Speaking of the Delta Variant, The REGJB Fantasy Football league kicked off another exciting season with a draft Sunday. Drafting in the 9th spot- Rumpole's team- The Delta Variant (because we cannot be stopped) nabbed Saquon Barkley, Cooper Kupp and Najee Harris with the first three picks. The second overall rated QB- Josh Allen- was nabbed by us in round four- talk about value- and top-rated TE Tyler Higbee fell right into our lap in round six. And yet...and yet...Yahoo rated our draft a C+. Well ladies and gentleman, they do not decide the title on pre-season rakings. You have to play the game. 

Johnny's Sack- managed by a very experienced FF player was Yahoo's top rated player in our draft. Kudos to getting the top TE Travis Kelce,  but here is a few things JS is going to learn- Dak Prescott is done; never pick a Cincinnati  WR or a Jax RB (he has several), and the problem with Steeler WRs is that they have too many good ones. There will be no breakout star despite JS drafting one of their best- Dionate Johnson. 

Everyone's fav Judge loaded up on WRs- he has eight of them, and some questionable Dolphin players, but then again his team is called De la Fins.

A COVID UPDATE FROM THE CHIEF

 As the Delta Variant (motto: "Killing only the incredibly stupid") rips through our world, our nation, our city, and our own REGJB courtesy of ignorant Assistant State Attorneys who do not believe in vaccinations, many are wondering if there will be any changes in the opening of courthouses. 

We have the email from CJ Sayfie (posted below) , but the short answer is NO, there will not be any changes because COVID-DV only kills imbeciles and those who watch and believe Newsmax, ONAN, Fox News, and the 45th president of the United States. 

For a short term solution trust Rumpole to come up with a unique answer that solves all of our problems. 

Fact: Covid-DV infects and kills those who are unvaccinated, and thus those who do not have Bill Gates Microchips implanted in them.

Fact: Most but not all of the legal community and the judiciary are now vaccinated. 

Fact: We have two courthouses, one of which is about to collapse. 

SO.... reopen the Civil Court and rename it as Un-vaccinated Court. 

Those lawyers who believe the vaccine is a method to line the pockets of Dr. Fauci, or that the vaccine implants trackers monitored by Barrack Obama's Muslim controllers stationed in China and Africa, can go to 73 West Flagler street and practice all the law they want there. And if the freaking building collapses on them and kills them all, well at least they were headed for death anyway, either through Covid-DV, or something else,  because the life-span of the incredibly stupid cannot be that long. 

Meanwhile, those lawyers and judges who are vaccinated can practice law at the REGJB. By moving the 25-40% of morons in the REGJB who are not vaccinated to 73 West Flagler Street- let's call it "Covid-ain't-real Way"- the criminal courthouse will have plenty of room for Judge Hanzman and his legal hearings on the Surfside collapse. 

Judge Sayfie's email released on Sunday Evening:

Good evening, All. 

If you scroll below you will see the email I sent about COVID almost 3 weeks ago. Notwithstanding the daily reports of positive tests in our courthouses, and Miami’s positivity rate increasing back over 10%, the information in that email remains largely the same. 

Last week I had a meeting with all of the Chief Judges across the state. I also attended the biweekly meeting of our local task force which includes 3 infectious disease specialists from 3 different Miami hospitals. On Saturday I had a consultation with one of the doctors as well as with Chief Justice Canady.  

The good news continues to be that the vaccine is working, and working well. It is “highly protective” against the delta variant particularly against severe disease and death.  While there are breakthrough infections, they continue to be mild and the risk of transmission from a vaccinated person is believed to be low because the “viral load” is very low. I know that the breakthrough infections are disconcerting. But we must continue to listen to the experts. I will point out that the doctors have been accurate on everything covid related thus far.

Currently in Miami 95% of those hospitalized with covid are unvaccinated. The remaining 5% are transplant recipients or elderly who have compromised immune systems. 

Our doctors in Miami as well doctors world-wide are clear that this current covid wave is a pandemic of the unvaccinated. I urge those of you who work in our court system to please get vaccinated if you have not already. That is clearly the only path to an end of this pandemic. 

In the meantime, I urge you all to wear masks. Our doctors in Miami have been recommending this consistently but now it is crucial. Whether you are vaccinated or not, please wear a mask when you are inside are court facilities. We cannot tell who is vaccinated and who isn’t. So please, everyone wear a mask

All of our divisions have remote practices built into their daily procedures. Judges will each continue to have the discretion to conduct certain hearings remotely. Jury trials will remain live unless all of the parties agree otherwise. Please urge all jurors and trial participants to wear masks at all times. 

I cannot issue an Administrative Order requiring vaccinations and/or masks at this time. This latest spike in cases is entirely the result of people’s choices. As such the Florida Supreme Court is currently not approving any “roll backs” in our procedures. I have been assured that this will be revisited in the event the CDC or Florida Dept of Health changes its advisories.

Well said Judge Sayfie. Just one comment.  You write that procedures cannot be changed until the Fla Dept of Health changes its advisories. Here is the tiny problem with that. The Fla Dept of Health recently and reluctantly agreed that condoms might, just might help control the spread of AIDS. So considering that the Fla Dept of Health (motto: "All the data is not yet in on smoking")  is a bit behind the times, waiting for them to act is like expecting certain judges to actually start on time. (And in that regard, please see the email we have sent you about a certain county court judge who is angry because, and to quote her rant we saw the other day "I have a daughter and I cannot start my calendars until ten o'clock, okay?  Like I have to provide like child care...." It was embarrassing. And she knows who she is when she reads this. Enough said...for now.)

FIAT JUSTITIA RUAT CAELUM

 If you are on the FACDL listserv then you saw the email from the State Attorneys Office that one of their employees has tested positive for Covid and was in several courts over the last few days. 

Federal law and several international treaties including the International Treaty Governing the Privacy of FACDL Listserv E Mails do not allow us to reproduce the emails in full without violating the holdings of Pennoyer v. Neff and the Corfu Channel Case

Suffice to say the Delta Variant is upon us and it is vicious. 

A few thoughts: About 50% of the lawyers in courtrooms are not masked. Of those, about 90% of the State Attorneys are not wearing masks. We are not sure why. But really, how stupid do you have to be to not wear a mask inside a closed room without outside ventilation? 

Second- as one commentator noted on FACDL- this reinforces the reason to continue with Zoom hearings. And yet where ever you go you hear Judges complaining about Zoom hearings and quite frankly it is the same old crap- they need defendants in court to "make sure" they understand the plea offer, blah blah blah. 

There is something about putting on a black robe that makes people need an audience. They just cannot bear to be in a courtroom by themselves. If it wasn't so stupid and dangerous to require people to jam back into court it would be funny. 

 And our judges are downright desperate to ruin as many defendants' days as they can by getting them to miss work, come to the courthouse, pay for parking, use cars and expend carbon into the atmosphere that we can no longer afford to do,  all for the privilege of offering supplication to the apparition in black robes hovering a few feet above them. 

Stop it already. We no longer have a useable civil court house and the sun is still rising in the east. We spent 18 months doing arraignments and motions and even pleas via Zoom and the judicial system of the United States did not come tumbling down. 

It is not like there was a banner scrolling below the screen on CNN: "Court system collapses as Miami Judge does a virtual sounding... Chief Justice Roberts to address the nation at 9PM"

SO LET US BE CLEAR. RUMPOLE WILL NO LONGER ATTEND IN PERSON COURT HEARINGS UNTIL THE DELTA VARIANT IS CONTROLLED OR ALL IDIOTS WHO HAVE NOT GOTTEN VACCINATED ARE IN HOSPITALS, DYING ON RESPIRATORS AND WISHING THEY HAD GOTTEN THE VACCINE.

DELTA

 As the Delta variant gains a foothold in the United States and begins to capture the attention of the media and public, many lawyers are concerned about the re-opening of court right as the D Variant begins to take hold. Many of those lawyers are emailing your favourite blogger for advice. Which is the correct thing to do. Who do you think gave Fauci advice on how to outlast POTUS45? 

First, if you want to be safe- wear a mask. And get vaccinated. Those two measures will protect you from the D Variant. 

Second, we call upon our new CJ Sayfie (starting July 1- mark your calendars- there may be small fireworks display the following weekend-about three days later- to commemorate her ascension to the CJ spot) to strongly suggest if not require that people wear masks in court. It is the "Safe(ie)" thing to do. 

Third- Judges should allow Zoom appearances for arraignments and reports. Duh. 

Fourth- no sidebars without masks. Do you know where that judge has been? 

Fifth- Stay home and read the blog. You can't start a fire without a spark. You can't get wet if you don't jump into the pool. You can't eat dinner unless you order Uber eats. You get the idea. Limit your public exposure to be safe. And read the blog.

COVID UPDATE

It has been a while since we did a simple Covid19 update, what with reports of pregnant JAs lugging furniture around the courthouse, things have been positively "Broweird" in Miami. 

Florida's Dept Of Health Covid dashboard reported 5,520 new cases on Sunday. Miami reported 1,160 new infections and 12 more tragic deaths. 

Statewide 7% of the tests administered were positive which probably means we are not doing enough testing. 

The all important R rate in Miami-Dade is stubbornly staying above 1 at  about 1.06.  This tracks the number of people an infected person is infecting. Once the number falls below 1, the virus dies out because every new person infected is infecting less than one other person. The more people who get vaccinated and who continue to wear masks, the sooner that number will fall below 1 in Miami, Florida, and the world (except for some cities and states who believe the whole thing was scam designed to get the former president out of office. Those people will just eventually die out from covid19  and pure stupidity). 

Have you gotten your first/second shot yet? We have our second on board and are feeling great. 

No appointment necessary shots for people age 16 and up begin at the Hard Rock Stadium today from 8 am to 10 pm. Here is the Herald article covering it all.  For kids 16-17 they need a parent and a both certificate (it's not Joes so a folded up 50 isn't going to work).

COVID ALERT

From the Captain:  

COVID-19 ADVISORY #74 [AMENDED] SELF-MONITORING NOTICE An individual who worked in the location and on the dates listed below has tested positive for COVID-19. Persons identified as having been in close proximity to the confirmed individual are being notified and will be asked to take all necessary precautions. Lawson E. Thomas Courthouse Center, 175 NW 1st Ave.: Room 1840 on Feb. 25-26, 2021 and March 1-3, 2021 Room 1815 on March 1, 2021 Last date worked: March 3, 2021 Persons who were in these locations recently should follow self-monitoring steps for the next 14 days as outlined in the Centers for Disease Control website.


The time when these advisories will be tempered with the statement that "those who have been fully vaccinated do not need to isolate and should closely monitor their health for any signs of Covid" is not far off. 

CHECK YOUR PREMISES

There are two conflicting actions occurring at the same time: 

Item: Republicans want to win back the House, Senate, and White House/

Item: A majority of Republican men do not want to take the "beautiful" Covid 19 vaccine that President Trump personally invented in the White House basement lab during his free time. 

Conclusion: Without the taking the vaccine, many Republicans will die, lessoning the number of people who can vote Republican, hindering their chances of re-taking the House, Senate, and White House. 

As Ayn Rand famously said, "Contradictions do not exist. When you see one, check your premises, one of them will be wrong." 

You apply that to this- we do not have the time to do all of your work for you.

ONE YEAR AGO

 One year ago on March 11, 2020, our world began shutting down. The virus was ripping through society, through Florida, through Miami, and through the REGJB. The Captain posted the first of what would be many court advisories on Covid19 being in the courthouse. We were railing at the judges to shut down the courts, which is something that they would soon do.  

Here is part of our post on that very scary day: 

Fear is rippling through the REGJB, which is not surprising since the court system leaders completely ignored our entreaties weeks ago to scale back the court system. 
Stay tuned here and we will keep you updated. Here is what we know: 

Judge De La O declared a mistrial in a trial that began on Monday  when a person working in the courtroom became ill. That person will be tested if the flu-like symptoms continue for 48 hours. We will keep you updated on this. 

There is also an issue with Judge Benevides courtroom/staff. 

Tom Hanks has tested positive for covid-19. 

The NBA has suspended the season after a player tested positive. 

The value in looking back is to learn what we did right and what we did wrong and what were the issues that may have delayed the decision making. 

Clearly the issue confronting our Judiciary and Judges Soto (state) and Moore (feds) was how could the courts shut down? We had some limited experience in Miami with shutting down for a few days because of hurricanes, but this was a shut down that had no end in sight. How many of you had Zoom on your computers on March 11, 2020? How many of you had even heard of Zoom?

It took a few days, but our chief judges and the State administrative judges did the heavy lifting. Carlos Martinez and Kathy Rundle worked together (as they should and often do) and they got our creaky 1970's court technology into the second decade of the 21st century and we were soon up and running with virtual hearings. The State worked with the PDs and the defense and the Judiciary to get as many people out of jails as they could safely do. The feds were about to be hit with a Tsunami of compassionate release motions and the fed judges and their clerks went to work researching the law and writing opinions, and saving lives by releasing defendants. 

What should come out of this last year are many lessons. First, we can now switch quickly from in person to virtual hearings if needed in the future (and we will need to be able to do so). Second, some form of virtual hearings are here to stay. We need to keep people out of courthouses. The single mom working her third job as a Starbucks barista does not need to miss a day of work to show up for a misdemeanor calendar call. She can step outside and handle it on her phone in ten minutes. Less people coming to court means less crowds, less cars on the road, more work productivity. Civil lawyers (near and dear to our cold, black, heart) should not have to trek in from Kendall for those five minute motion hearings to compel answers to plaintiff and cross-co-plaintiff-intervenor's second set of interrogatories on the slip-n-fall at Fresco-y- Mas. 

And finally there is this- our prosecutors and judges should re-think incarceration. On the federal side, many  massive sentences to defendants in drug cases were reduced. A young woman sentenced to forty years in at age 30, now at age 60 seemed less of a threat and her further incarceration seemed needless.  No good would come out of keeping  her in prison for another 10 years. On the state side the need for pre-trial incarceration was dialed back. Any Hollywood-type tragedies emerge from letting some poor homeless guy charged with burglary of an occupied vehicle when he reached inside a car and grabbed a Big Mac out of jail? Did he steal another Whopper? 

There was a brief influx of a level of humanity into a criminal justice system that has diligently worked since the 1980s to remove humanity from the decision making process:  "I know it's your first offense at age 50 but there is a twenty year minimum mandatory for this drug possession and only the state can waive it...I know the sentence seems harsh counsel, but the potential loss amount was 100 million dollars, and that elevated the guidelines even though your client only was paid five thousand dollars." In both cases the judges then say "there is nothing I can do". 

Maybe one lesson of Covid 19 is to give some decision making on sentencing  back to judges and away from prosecutors.  Our judges surprised everyone by being more than competent to move us through this shut-down year. They kept the courts open; they made tough decisions and they saved lives.  

Maybe we should start trusting judges more. (We know, we know...we make a living take cheap shots at those who wear black robes at work. But we tell it like it is).

TAKE THE JnJ JAB

 In preparation for our ground breaking, earth-shaking, robe-wearer-quaking post on Monday, we use this Sunday to clear up some loose ends. 

First, Diamond Joel Hirschorn, ever the class act, wrote to us privately that the real story behind the discovery that the trial court neglected to read the reasonable doubt instruction was a little less dramatic than our post, which took some literary-license with the scenes of discovery, not to mention the 3rd DCA deliberations (and perhaps it is time to give kudos to the panel- CJ Kevin Emas,  and neewbies and former prosecutors Flor Lobreee and Monica Gordo.  We expected no less from Judges Lobree and Gordo  as former prosecutors. In their time at the SAO  they were known as reasonable and fair and it was nice to see them in the majority here.  BTW- if you like reading 3rd DCA opinions, keep an eye on Judge Gordo- some of her dissents have been superb and she is making a reputation for herself as an original thinker. It is gratifying to see. 

In his email to us, Diamond Joel gave all credit on the briefs to his co-counsel Mr. Sarangoulis, and had some mild criticism for the State not admitting error. We find the last part troubling. A man is serving life in prison, and the fundamental basis upon which our entire criminal justice system rests- a jury considering whether the prosecution proved their case beyond a reasonable doubt- was not in play during the trial. And despite that, the State - with their unsettling blood lust, sought to keep Mr. Phelps in prison until he died. The Florida Bar should be investigating whether these state bureaucrats should be held accountable for their lack of prosecutorial professionalism, the first requirement being sworn to ensure that the laws of the State are followed and executed. On this point, they failed miserably. Not for the fact that the RD instruction was not read, but for not immediately agreeing that a new trial was in order. 

Second, many people are emailing us asking if they should take the Johnson and Johnson vaccine or wait for the Pfizer/Moderna jab. The answer is an unequivocal YES.  The main reason is this- ignoring all of the other numbers for a moment, the JnJ vaccine is 100% effective in stopping hospitalizations and death for Covid19. That means that no one- zero, nada, was hospitalized or died after getting the JnJ vaccine, even if they got Covid. That means everything. 

Now lets take a deeper dive into the numbers. First praise for Pfizer. Not only are the P=jabs 95% effective against Covid19, but those numbers have been confirmed in real life field testing in Israel in which, reviewing over 250,000 people who got both P-Jabs in the last few months, the vaccine approached 98% efficacy. These numbers are more recent than the P-jab studies conducted 8-10 months ago, in the US, Europe, Africa and South America when there were less and less serious variants. So the Pfizer vaccine works and is working now. 

The JnJ jab was tested more widely and more recently  than the Moderna shot, which was only tested in the US, and also was tested at a time when there were less and less serious variants. Preliminary data shows that the Moderna vaccine is very effective against the deadly South African variant. which is good. But the final thing to remember is that with all three vaccines you are comparing Broward Judges to Miami Judges- there is no comparison. One set of the Judiciary will take lawyers who are from another county out of turn and another won't. You figure it out. 

If offered the JnJ jab, just keep telling yourself this- a month after I get this vaccine, I have zero chance of dying from Covid. Period. End of story. Roll up your sleeve, grit your teeth, get a lollipop and leave with your life protected. 

It is fair to say we are at a tipping point in our battle for Covid- but there is no doubt how it will end. We will prevail- we can make boosters and new vaccines that will shut this sucker down and a year from now, someone dying from Covid will be a rare and isolated event. 

WE CLOSE WITH THIS:

What would have happened if Covid came in 1977, or 1987, or even 1997? Would the Justice system have survived? In 1977 or 1987 most people didn't have cell phones (remember beepers?). In 1987 laptop computers were a rarity, there were no Ipads, and we accessed the internet with a  dial-up modem. Even in 1997, internet access and speeds were such that we could not have streamed Zoom hearings. And there was no e-filing at the time. So what would have happened? The clerk's office would have to had a person on the front steps, wearing a mask that they could not buy from Amazon, taking filings. We cannot even imagine the lines at Eckards (remember them?)  to buy a box of masks. 

Court hearings to process new arrests would have to take place in Lot26. Regular calendars would have to be held across the street under tents, or in the Orange Bowl. Even the dissemination of information about what was happening would have been near impossible. The Herald (gasp!) would have played a crucial role in telling people where to go and when. 

This could have been worse. We did not have the mRNA technology that the Pfizer and Moderna vaccines use. The JnJ weakened adenovirus would have been the first jab created and without computer monitoring and reporting of events, it would have taken a year to collect, collate and analyze the data.  And in any of those decades, 9 out of 10 vaccines routinely failed. So let us take a moment and count our blessings. We are well on our way to being back, to having Rumpole prowling the bars of jury boxes, growling out objections, crushing lying state witnesses with a withering glare, and arguing the reasonable doubt instruction-whether the judge deigns to give it or not.

CONVERGENT EVOLUTION

British researchers now believe that the new British strain B1.1.7, which Dr. Fauci has already said many times will be the dominant strain in the United States next month, is not only more virulent but most likely more lethal. 

But something a little more concerning is also happening, and along the way it is further proof of Charles Darwin's Theory Of Evolution. For all you Religious-Fundamentalist-Republicans who do not believe Adam descended from Bonzo the Chimp, Covid is dealing you some serious disappointments. 

Convergent Evolution is the similar evolution of new traits in not closely related organisms. In other words non-related species can evolve similar traits based on their environment. The phenomenon has been observed in viruses and now there is evidence that strains of Covid19 in the United States are showing traits of the strains of the British and South African variants. Holy Evolution Batman! This is not good. What this means is our enemy is independently adapting throughout the world. Strains continents apart are separately and independently mutating to a new strain with similar characteristics- becoming easier to catch (because by wearing masks we have made it harder to spread) and more deadly. Covid is a worthy enemy- like a prosecutor with a confession and DNA. But as any prosecutor who has dealt with Rumpole can tell you, Covid can be beat.

The reasons for an elevated death rate are not entirely clear. Some evidence suggests that people infected with the variant may have higher viral loads, a feature that could not only make the virus more contagious but also potentially undermine the effectiveness of certain treatments...

The overall picture is one of something like a 40 to 60 percent increase in hospitalization risk, and risk of death,” Neil Ferguson, an epidemiologist and scientific adviser to the British government, said in an interview on Saturday. Referring to the tight restrictions on socializing that are in effect across Britain, he said, “It reinforces the policy measures in place.

The CDC announced Sunday that two million Americans had been vaccinated the day before.  We are close to vaccines being available  for those of us who labour in the REGJB for our bread and wine, although it is not yet on the menu of Au Bon Pain. March 1, 2021, is NOT the time to open up the Courthouse and start trials again.  But like opening day in baseball, Memorial Day or the 4th of July or Labour Day or Thanksgiving, it is coming. Just wait a little longer please.

THREE STEPS FORWARD

 And two steps back....That is the clearest view of humanity's battle against the Covid 19 virus. We will prevail, but as the virus mutates, the battle will be longer and harder than we have admitted to ourselves. 

The two new vaccines, with a third on the way shortly,  are not the end of battle. They are not the beginning of the end.  British Prime Minister Winston Spencer Churchill said in a speech in November 1942 when the British defeated the Germans and General Rommel at El Alamein, that the victory was "not the end. It is not the beginning of the end. It is perhaps the end of the beginning."  Churchill was preparing the British public for a long war. A war he had neither flagged nor failed in believing his small island nation would win. But Churchill knew there were many more difficult days ahead.  England was still standing alone; bloodied, battered, but unbowed. 

Covid 19 is mutating and the mutations are negating some of the advantages of the vaccines. That is the bad news. The good news is that the virus cannot mutate indefinitely. The act of mutations will, in and of itself, burn the virus out. The additional good news is that the vaccines will stop most infections. When a person is not infected by an older strain of the virus, the virus loses a chance to find a host and mutate. When that happens enough, the virus dies. But until then, our enemy survives. The troubling variant, E4A4K, which is emerging in South Africa and Brazil, appears to bind easier to human receptor cells AND eludes the antibodies produced by natural infection or vaccines. 

So we have a long, hard battle ahead of us. And that brings us to the legions of robed readers, wandering empty halls of courthouses, their footsteps echoing off of walls and ceilings that used to absorb the noises of loud objections, thundering cross examinations, quiet and meek pleas for mercy, and bored jurors looking to get out of service. We imagine them staring wistfully at empty jury boxes and quietly humming "When will I see you again?" 

The answer is "not very soon your honor." 

We cannot and should not be opening the state courthouses in March when the CDC is predicting that the new and more virulent virus strains will be the dominant strains in the United States. We should not be opening the federal courthouse for jury trials in April. We need patience. We need  50%, 60%* and beyond of Floridians to have been vaccinated. We need  the R rate way below 1 and we need to see that the number of new infections state wide is less than a hundred a day. Only then, when the virus is on the ropes can we attack and win- the way new Commander Bernard Law Montgomery deceived (Operation Bertram)*  and out manoeuvred General Rommel until the time was right to press the attack (Operation Lightfoot). *

WWI ended at 11am on 11/11. At 10:59 am, US Solider Henry Gunther-bayonet fixed-  attacked a German machine gun emplacement and became the last American solider to die in the war.* No one wants to be the Henry Gunther of Covid when a vaccine and cure is right around the corner. 

* It is generally accepted that a herd immunity of +75% is needed to kill a virus and stop a pandemic. With Covid mutations diminishing the effectiveness of current vaccines, it is postulated that we will need a herd immunity of 85% to end Covid. So lets roll up our sleeves and get jabbed. 

* All warfare is based on deception. Sun Zu, the Art of War. In the weeks leading up to the final battle, the British scattered fake camps, fake tanks, fake ammo dumps with camouflage throughout the dessert in front of the German lines so as to confuse their enemy where they were and where the attack would occur. 

* When General Montgomery ordered the attack, the 24th Australian Brigade shelled the 15th Panzer division for a few minutes. Then, in a brilliant coordinated artillery attack, 1000 guns launched an attacked across a 40 mile front. Then Montgomery sent in four infantry divisions. The soldiers would not trip the anti-tank mines because they were not heavy enough. Artillery supported the infantry as engineers cleared the minefields and the infantry called in the coordinates. Then Montgomery sent a three pronged-pincer  attacked, with the 7th Armoured division and the Free French Brigade attacking the German lines from the South, while on the right flank the 44th 131st Infantry Division and 131st Infantry Brigade pressed the attack. The Germans fought hard and were disciplined. The mine fields were deeper than expected and took more time to clear.  

There is so much more to the second battle of El Almein and perhaps this fall, 78 years after the famous battle, we will write more about it. 

* Gunther's story is fascinating. A few months earlier, after he sent a dispiriting letter home criticizing the war, he was  demoted from sergeant to private as the letter was read by censors and his feelings were reported to his superiors. The demotion crushed him, and he spent the remaining months of the war trying to prove his loyalty. On the morning of November 11, the Germans knew of the pending armistice. It is unknown if Gunther's unit was aware the war was about to end. There are conflicting reports about what the Allies knew. When Gunther charged,  the Germans yelled at waved at him to go back. They fired shots over his head. Undeterred, Gunther continued his charge with his bayonet fixed, eventually forcing the Germans to open up with their machine gun and kill Gunther.

JOHNSON AND JOHNSON NEWS

 "We are all worms. However, I do believe I am a glow-worm".  Winston Spencer Churchill. on humanity's  morality and his. 

JNJ reported on their vaccine today. Overall 72% effective in reducing mortality and severe Covid infections in the US,  66% in Latin America, and 57% in Afirca. The efficacy rate  is below the magic 95% number of Pfizer and Moderna.  The real number is in the details, so pay attention.  Pfizer and Moderna did not test overseas and did not test during the spread of the new Covid variants.  We do not have much data on how effective their vaccines are in the current and rapidly changing enviroment. 

The OVERALL effective rate for the JnJ jab  in preventing infection is 85%, well above the CDC guidelines for approval of any vaccine. The number is also 85% worldwide in preventing severe disease that requires hospitalization. 

What to make of this? It is good news. It is a one shot vaccine in which one billion doses can be distributed and injected in 2021. One billion doses. It does not need to be chilled below normal refrigeration.  It is a game changer. The vaccine appears to INCREASE immunity over time due to the operation of certain cellular biology that you dear reader, do not need to be bored with. 

JnJ will be filing an EUA (emergency use authorization) with the FDA next week. The phase three results on a two-dose regimen, which may well approach or exceed 95% will be released within the next two week. 

What we know about the Pfizer and Moderna vaccines from Israel where 40% of the population has been vaccinated is that the first round of numbers show a protection rate approaching 99%. For example in one population study of over 200,000 people, less than 20 contracted Covid. The point is that as the JnJ vaccine is released and data from hundreds of thousands of people is analyzed, the efficacy rate will rise, if for no other reason that as more and more of the population is vaccinated or recovers from an infection the R transmission rate will continue to fall below that all important 1 number, meaning for every person infected, less than one person gets the disease from that new infection. This is how pandemics burn out. 

Rumpole says, if you are offered the JnJ vaccine, TAKE IT. Please. If we get the JnJ vaccine, we will be ready to try our backlog of cases the following week (wearing a mask). We will take 75% protection, and wearing a mask that is 95% effective, in a world where most of the people we come into contact with are either vaccinated, have immunity from a prior infection, or both. The news is good once we get a better roll-out. 

We have some thoughts about US Congress representatives who advocate shooting and killing other members of the House and who harass children who survived school shootings. That will come shortly after we finish our legal obligations for the day.

WHEN WILL I SEE YOU AGAIN?

 Item: The music from the 1970's is the best. Period. We will not entertain any additional motions for rehearing or reconsideration. 

We were listening to Sirius/XM's 70s on 7, as is out wont on Sunday, when we heard the familiar first notes from The Three Degrees "When Will I See You Again?" hit,  and we began to wonder which of our favourite judges in the REGJB are humming that same tune? 

When should trials begin again? (As Judges Soto and Sayfie reach for their shot glasses, as they have had their fill of us on this point,  we press on). 

Initially, March seemed like a good target date. But then the feds screwed up the vaccine distribution. Actually that's not true. The feds had NO plan for vaccine distribution until we got POTUS46 and now they are admirably scrambling to come up with something. They are even scrapping the bottom of the proverbial barrel with the FDA's approval of the use of a special syringe to wring a sixth shot out of the vial of five doses (for which Pfizer, which negotiated a per dose charge with the feds, immediately sought to renegotiate their payments for six doses per vial, not five. What are civil lawyers for if not to get an additional 20% for their client out of a deal?). 

Then the virus mutations became troubling. The virus is now more contagious. Just ask anyone in California. The new and more contagious British strain  may also, as per British PM Johnson, be more than 30% more deadly. President Biden has warned and intoned that our darkest virus days are before us. 

This is no time to say "enough" and ask trial lawyers to emerge from their den of virus hibernation and stand up on their hind legs and wobble into court Ursine-like. 

It is always  darkest before the dawn, and we humbly suggest to our chief judges, state and federal alike, that it is wise to wait just a wee bit more. Let the lawyers and judges and clerks and officers and court reporters and jurors get their two vaccines. We still need to socially distance (best thing about covid-19 is that we can now claim social distancing and never be in close proximity to a black robe again) and wear masks, but once we are jabbed, let's pick six.  That next "not guilty" may well be the sweetest, but aren't they all wonderful? Does not a rose by any other name smell as sweet my dear Montague? 

Until we are all safely jabbed, renew your Netflix (the new HBO Max is great!) , stay home a bit more,  and send us the bill, and enjoy the song.

PM SHUTS DOWN ENGLAND

 Prime Minister Boris Johnson, to save the British healthcare system which is -Los Angeles like- teetering on the edge of being overwhelmed- has SHUT DOWN England for a month. No Pubs- gone are the days we could spend an afternoon drinking some Guinness pints in The Grenadier or The Dog and Duck (love the top floor hideaway for a quiet evening). No gathering in Trafalgar square. No strolling through Piccadilly. Schools are closed. The Virus is taking a terrible toll because of the new strain's increased transmission rate. More transmissions means more people sick and that means the health system gets swamped with more people than it can handle. 

England is facing 100,000 deaths within the next month. Per capita wise, that would mean 500,000 new deaths in our colonies. 

And make no mistake about this. The new and more virulent strain of the virus is rampaging through the United States like a hot knife through butter. It is looking for more healthy victims like a president searching for 11,780 votes in Georgia. 

We do not feel the sense of urgency in the United States like there is in England. 

And that foretells many dark says ahead. Because as careful as you have been staying healthy, you now need to be doubly careful. No more walking inside Starbucks to pick up your latte. No more wandering down the aisles of Publix in a mask. No more casual dinning with friends. Stay home. Wear a mask. Stay away from everyone.

VACCINATION LIST

 As a noted ethicist, we are often consulted about the issues of the day. And the current issue is who should get the vaccine first? We of course have the answer, because as our great law school property professor often said: "Sometimes wrong, never in doubt.

1. Doctors and nurses and hospital staff. This one is easy. 

2. First responders. Ditto. 

3. Elderly people in nursing homes and staff. Double ditto. 

4. Witty legal bloggers from Miami. 

5. People with medical conditions such as cancer, diabetes, hypertension that make them more susceptible to adverse outcomes if infected with Covid. 

6. US Armed forces. 

7. Bartenders. It's been a long year. 

8. Restaurant and food service staff- restaurants are suffering. 

9. Athletes and Show performers. We need entertainment to help deal with the dark days ahead. 

10.  Meat processing plants  personnel. 

11. Corrections officers and inmates. 

12. Courtroom staff like court reporters and clerks. (Except the person who staffs the attorney line on nine at the courthouse. Considering they appear to have been working from home since 2012, no rush to vaccinate that privileged individual). 

14. Retail personnel. 

15. Librarians. 

16. Veterinarians.  

17. Opticians. 

18. Morticians. 

19. Starbucks baristas and those that manage the windows at the small Cuban restaurants that serve Cafecitos.  

20. Bagel makers. 

21. Writers. 

22. Sanitation workers. 

23. Casino workers. 

24. Zamboni operators. 

25. Used car salespeople. 

26. Microsoft and Apple helpline employees. 

27. The weather women on Channel Seven. 

28. Butchers and Bakers. 

29. Candlestick makers. 

30. Criminal attorneys. 

31. Airline employees. 

32. Cruise ship employees. 

33. Civil attorneys. 

34. Judges. 

35. Worm and Slug farmers. 

36. Politicians.  These last three were close.
