WHAT WE KNOW ABOUT OPENINGS

 We know that after the July 4th weekend the Feds will start trying criminal cases. 

We know that the feds are trying some civil cases now. 

We know the REGJB remains locked. 

Why don't we know when the REGJB will reopen? 

We don't know. 

SPEAK THE TRUTH 

The Republicans are poised to remove the number three in their house leadership on Wednesday. Liz Cheney's crime? She spoke the truth. Congress people who will vote to remove her will be elected members of Congress, many of whom believe 1) the prior president won the election; 2) Dr. Fauci was wrong about masks and is personally profiting from the vaccines; 3) Jewish lasers in space cause fires in California; 4) Hillary Clinton is part of child sex-trafficking ring run out of a pizza shop in DC; 5) Hugo Chavez and Venezuela rigged the US presidential election; 6) Global warming is a fraud; 6) The World Health Organization is part of a conspiracy about Covid19 to weaken the United States.  

Yes they believe this. 

And you wonder why the United States future as a world leader is in doubt. If you were part of the leadership of say, Bulgaria, or Thailand,  who would you cast your lot with? Matt Gaetz  or Xi Jinping? 

In our opinion (widely sought as it is) the Democrats have only one legitimate response- Impeach the former president. 

Again.

Things the RGB should be open for: jury trials, PVHs, motions for which one or both sides request an in-person hearing, felony pleas, surrenders into custody, arthur hearings

Things the RGB should never be open for again: arraignments, soundings, misdemeanor pleas, diversion acceptances, sealing and expunging, any motions in which neither party has requested in-person hearing.

Court calendars should begin with those matters set over zoom, and special set in-person matters for 11AM or at the court's convenience.

The days of 12 lawyers in a line waiting to "stand on the pleadings" or sound not ready should never return.

I know this is a criminal blog, but I will weigh in on civil.

Things that should occur in person in civil court: trial, injunction hearings, hearings in which one or both parties asked for an in-person hearing and articulated good cause for needing it (enjoying the sound of your own voice is not good cause).

Things that should not occur in person in civil cases any longer: everything else.

Five minute motion calendar should be Zoom based only. Likewise for longer special sets that require the Court to dig into a long record and ask questions of the lawyers (learn to screen share effectively - use multiple screens and only put up one of them so that you can work off screen while sharing one thing at a time).

Motions to dismiss (which are limited to the 4 corners) and summary judgment motions (which are limited to the timely filed record) don't need hearings at all. Or if they do, Zoom.

99% of civil appeals don't need oral argument.
