AU REVOIR AND ALOHA

One of our favourite robed readers, who distinguishes himself with his thoughtful comments, leaves the REGJB for the land of marital malaise and discord:

Just wanted to say, in the words of one of our more celebrated state governors, "Hasta la vista, baby." Believe it or not, I will miss the place--It has been my "home" for over 21 years, counting SAO time.


However, much more than the Justice Building, I will miss the people who labor there.Call me naive, if you wish, but I truly believe the vast majority of us do labor to seek the truth and justice.

Lately, I have noticed a lot of sniping going on, allegely between "prosecutors" and "defense attorneys" as to their "personal characters." Said sniping is based soley on stereotyping people by their occupations. If you treat each person you meet as a unique individual you may very well be pleseantly surprised to find a kindred spirit--someone trying to do his job the best he can and as honorably as possible. After all, we are each the "hero" of our personal sagas and want to believe we are worthy of our own good self opinion. [Rumpole can't help but interject: very wise words indeed by an astute observer of the human condition. Buddhist in a way.]

Without, naming names (I do not want to subject people to public scrutiny on the blog) let me give you a couple of examples as to why the stereotypes are wrong.

This past tour of duty I witnessed a prosecutor reduce a 3 year min man for a "career criminal" to 18 months state prison. The prosecutor did this voluntarily and with absolutely nothing to gain. The defendant had already pled guilty and was sentenced to the min man. The only compensation to the prosecutor--the intense and well earned pleasure of knowing he did what was right, given the situation.

I also have witnessed, on more than one occassion, a defense attorney recommend a drug program for his client instead of an adjudication with credit for time served--looking out for his clients best interests in the long run.

Though I am no longer presiding at REG/JB, perhaps y'all can help me. I am currently assigned to the Family division and I am told I will be expected to use something called "judicial discretion". Any of you know what that is? I tried looking the term up, but couldn't find it in any of the Florida criminal statutes.

Au revoir Judge P, we will see you again, but it is not likely our paths will cross in Family court. Pehaps you might see us at a nearby lunch spot as we battle it out with the Feds.

Rumpole's New American Legal Dictionary:

Judicial Discretion: The act of making a decision one or both parties in a lawsuit will praise you for in court, and curse you for behind your back.

Noun: "I pay $2000 a month in judicial discretion temporary alimony"

Verb: "I got judicial discretioned outta my house in the divorce case."

Adjective: "That judge can take his judicial discretionary decsion and shove it.


Rumpole welcomes Judge Venzer who takes over Judge Pinero's division. It's been a long time since she was sitting in the REGJB in DUI land, and now she's joined the line-up in the big leagues. (Here come the private emails from the County Court Judges cursing me.)

David Lee Roth Back as Van Halen Singer

The rumors were true. Van Halen will reunite with original singer David Lee Roth for a summer tour of North America.

"I am very excited to get back to the core of what made Van Halen," guitarist Eddie Van Halen said in a statement posted Friday on the band's Web site announcing a 40 city tour. No specific dates have been named.

It will be the first time that Roth performs live with the band since 1984, when he was replaced by Sammy Hagar. A brief reunion with Roth in 1996 resulted in two new songs but no tour.

Original bassist Michael Anthony will not be a part of the reunion. Late last year he was replaced by Eddie Van Halen's 15-year-old son Wolfgang.

On March 12 Van Halen will be inducted into the Rock and Roll Hall of Fame at a ceremony in New York.

I think a great idea is to post a poll on the left hand side listing all the judges names in the 2008 election and ask which judge deserves opposition in 2008.

I would love to see who gets the most voted from the bloggers.

program. People actually work and
have other things to do besides
waiting two hours for your highness to show up. And I mean both clients and attorneys.

Let's just hope you don't compound
the issue by taking late comers into custody.

Piniero has a fiery temper and we've had our battles, but when it comes right down to it, he is a great judge and a hell of a guy. I'm sorry to see him go.

Hey give Venzer a break...Do you know why she was late? Could it have been something to do with her two daughters? Or some other good reason or are you just looking to slam a good Judge. She is a thoughtful, intelligent, and liberal(fair) jurist who tries to do the right thing even when it may not be popular. She's on the criminal bench for two days and you're already complaining get a life.

It's a question of common decency
for other professionals and whether Judge Venzer has forgotten
that she is an elected public official and now thinks that she
is a Queen.

Moreober, the issue comes down to whether she remembers that she is just one election from being a regular lawyer again or whether she believes she is entitled to her little throne and thus can act
however she pleases.

Often times we elect these Judges and lo and behold as soon as they
get to the bench they start acting
like prima donnas.

The usual C trial will take two weeks in front of venzer. when she was in DUI every single objection required a side bar.

She will be another judge that the PD's love like most of the rest of the MJB.

As I advised all of you some months ago, watch out for Judge Venzer. Don't get in her cross-hairs. Don't worry about being on time. Don't worry about fairness, because it will not exist.

If you like selfish, self-righteous, egomaniacal, nasty and abusive then she is your gal. Yes, she takes calls from her children while on the bench. If you want to stay on her good side, you must tell her how wonderful she is, how smart she is and how perfect she is. Also tell her how "delicious" her children are and she will do anything for you.

Be careful who you talk to about her, she has her tentacles everywhere. In particular be wary of Judges Schuminer and Leesfield. Buddy buddy, don't ya know.
