SHAME

Shame has fallen on Miami, the Miami State Attorneys Office, The REGJB, State Attorney Katherine Fernandez Rundle, and Third DCA Judge Bronwyn Miller.

As the Miami Herald is reporting, and all of the REGJB knew on Friday, there are a series of text messages between the State Attorney and Judge Miller.

Why is this shameful? 

Judge Miller was a prosecutor on the Corey Smith case, and Fernandez-Rundle is the elected prosecutor. And it is not as if this is any case. It is a case that has brought the Miami SAO to the edge of ruin, with disgusting stories of prosecutors manufacturing testimony, and then lying to the Court about it. 

Judge Miller, before she was a judge was part of the prosecution team, along with now thoroughly disgraced prosecutor Michael Von Zamft, who ran out of state, and may find that he has not run far enough as his misdeeds continue to be reported. This means that Judge Miller is a witness in the current Corey Smith saga. 

And of all the people on earth that maybe our state attorney should not be texting with, perhaps Judge Miller should have been at the top of that list. 

But alas, the two could not stop texting each other like a couple of misguided magpies. They texted. They gossiped. They trashed colleagues- judges and lawyers (defense attorneys in particular)- and Judge Miller speculated about the whole sordid mess being shut down by the Governor, as well as whether Judge Wolfson- who ruled against the prosecution after MVZ was caught lying- could be removed- allowing a successor judge to review all of Wolfson's rulings. 

Among other gems in the texts is Judge Miller trashing defense attorneys as having a lower standard of ethics than prosecutors. Well on that point she has us. Unlike her colleague MVZ and the office she worked for, defense attorneys have not coached witnesses to lie in first degree murder cases and arranged for witnesses in custody to be brought to a police station so they could have sex with their significant (or insignificant) others. We don't do things like that- shame on us. 

One wonders how Judge Miller ever sits on another criminal appeal, her bias towards Ms. Fernandez-Rundel's office and against defense attorneys now well established beyond what is needed for any defendant to have a well-founded fear that she cannot be fair and should be recused.

And perhaps, just perhaps, in a case where the Dade SAO has already been CAUGHT tampering with witnesses in a first degree murder case and coordinating and manufacturing their testimony- Judge Miller and Ms. Fernandez-Rundle crossed a line. 

Time will tell. 

Query: How can you tell if  MVZ is lying?  A: He's speaking.  Here's a gem from the Herald article: 

Von Zamft told the court that Miller wouldn’t speak to either side without a subpoena. By then, the texts show she had communicated with him and Fernandez Rundle, and texted about calling two other prosecutors.

Somewhere Alex Michaels is saying "I told you so."  (In his Romanian accent of course). 

The texts will be analyzed and scrutinized like the Dead Sea Scrolls, or the Shroud of Tourin, or the election lawsuits of 2020. 

A special prosecutor needs to be appointed. 

A blue-ribbon commission of respected Dade Lawyers and retired judges needs to be empaneled with subpoena power to get to the bottom of this dirty mess that has broken the once proud Miami Dade State Attorneys Office. Their reputation is in tatters.  If they tell you the sun has arisen, you cannot believe them. They have no moral guidance, are running scared, and now...now...the problem may be at the very very top. And we all known what flows downhill. 

Shame.

DEAR KATHY WE ARE GOING TO SIT IN YOUR OFFICE

 Not exactly a love letter. 

Prediction ( we are good at these- see our Biden dropping out prediction last week two days before he did)  your State Attorney will...DO NOTHING. 

She will not respond. 

She has not done anything although one of her now former prosecutors arguably obstructed justice. 

So Rumpole has an idea. An old idea actually. 

Her office wants to investigate and arrest PDs. Let's do a SIT IN. 

Non-violent protest. Until our State Attorney agrees to address these issues, including an independent oversight board for the convictions of her office that are now suspect, criminal defense attorneys sit in her office. At both sides of the SAO blocking ingress and egress and if necessary, like other protestors before us, get arrested. If MLK and John Conyers and thousands of others did it, we can do it. Let's take it to the streets! 

We will win and she will break if swarms of us continue to sit in her office demanding action. 

Now, we are willing to put our money where our mouth is- and sit in with our colleagues, but we have a small trip coming up shortly, so we need to schedule this sit in, as we don't want to read about our colleagues in jail while sipping a Negroni in the Alps.

DEMOCRATIC PARTY TO RUNDLE: "DROP....OUT"

At least it wasn't the Daily News Headline about President Ford and NYC. See below. But the Miami Dade Democratic Party (motto: "Remember Us?) called upon your State Attorney Kathy Fernandez-Rundle to DROP OUT of the primary on August 18,2020. 

The Miami New Times (motto: "Remember Us?") reported this:

During a meeting of the Miami-Dade Democratic Executive Committee last night, an "overwhelming majority" of voting members approved a resolution calling on Rundle to suspend her campaign, says William Byatt, the party's treasurer and author of the resolution.
The measure reiterates Miami-Dade Democrats' previous resolution seeking Rundle's resignation "if she cannot pursue justice for all victims of crime." The 2017 resolution slammed the state attorney for a pattern "in which she has repeatedly refused to hold law enforcement officials accountable for on-duty killings."
They didn't exactly cite the rampage Rumpole went on this week about Rundle not prosecuting cops who punch people in the face when their hands are cuffed behind their backs, but it couldn't have helped. Indeed, if you click on the link and read the article you will see that the SAO Spokesperson responded that the State Attorney cannot charge people without evidence. 
So here is our question we ask once again: WHY DID NOT YOU PROSECUTE DET ARCHER WHEN HE PUNCHED A WOMAN IN THE FACE WHEN SHE HAD HER HANDS CUFFED BEHIND HER BACK? 
Don't hold your breath expecting an answer. 
FORD TO NYC: DROP DEAD
It was a long time ago, when our country was in a different type of crisis. Nixon had resigned. Ford was running for election (not re-election because he was never elected)  and large cities in the Northeast were facing blight and flight. Crime was on the rise, and the activism of the 1960's faded into this sort of difficult nether period of the 1970's when things were blah, and the go-go 80's had not yet arrived. Sometimes nations have down decades, and the 70's was one of them. 
New York City was bankrupt and asked the federal government for a bailout. President Ford said no, and this is how it was reported: 

Now as history buffs know, it did not end well for President Ford in his question for election. James Earl Cater beat him. Will the same thing happen to our State Attorney?

PEARSON V RUNDLE 2.0

So here we are, the first full week of the rest of the career of Miami State Attorney Kathy Fernandez Rundle. 

There is a lot of discussion about whether the career of an assistant state attorney is as fulfilling as it used to be. Those of our readers with gray in their beards and hair, and a shuffle in their step, wax poetic about their careers under Richard E Gerstein and Janet Reno (we just know that at this very moment there is a young pd, asa, and judge saying to themselves 'wait a second, Richard Gerstein was the State Attorney??? I always wondered why they named the building after him.'). 

So we are going to put up a poll. Unscientific. We cannot police it. But we are asking ONLY ASAs to take part in it. 

Your career as a prosecutor is .....
(  ) more rewarding than I expcted
(  ) about as rewarding as I expected 
(  ) less rewarding than I expected, I hate having to ask permission to use the bathroom. 

While the happiness of the employees is not a yardstick by which a office should be evaluated, it is a factor and one that should play a part in the upcoming election. 

Meanwhile, the defense bar can chime in this week on how many times the prosecutors in court say "victim wants the max". 

It's time they pay a price for abandoning their constitutional responsibilities.

PEARSON v. RUNDLE

Now we are cooking with oil! 
In what was an open secret whispered  brazenly in the  hallways of the REGJB, Melba Pearson, a former ASA, has filed to run for State Attorney against Kathy Fernandez-Rundle. 

WLRN was one of the outlets that broke story here, choosing to run as an unflattering picture of KFR as they could find.  

Fernandez-Rundle, Janet Reno's handpicked successor (something we also hear drives her to distraction) has been State Attorney longer than some of her assistants have been out of diapers. 

Ms. Pearson- if you're listening- and we hope you are, here are some things you can challenge our State Attorney on. 

First and foremost- Why have your prosecutors abandoned their constitutional duties to seek justice when it comes to sentencing, and placed their recommendation solely and completely in the hands of victims???  
Judge: "This is a first offense car burglary. The twenty year old defendant is eligible for PTI"
Prosecutor: "Sorry judge, the victim wants the max five years in prison."  Rinse and repeat. Over and over Rundle and her minions abandon the trust placed in them by the people of Miami-Dade County to make the fair but unpopular decisions that prosecutors are supposed to make. They abandon their duties because Rundle quakes at the political and public relations problems with not kow-towing to a victim in a case. Shame on her. For that alone, she should be replaced. 

Second problem: Too many chiefs and not enough Indians. Want to get a copy of discovery? "Sorry judge, I spoke to my chief, who spoke to her chief, who is waiting to speak to his  chief before we can provide the defense with the a-form." 

How many prosecutors does it take to change a light bulb at the SAO?  One- and thirty four supervisors. 

The office is an administrative and bureaucratic nightmare, so designed to prevent independent thinking by a prosecutor. A line prosecutor pretty much has to have their voir dire questions approved before they can ask them. "Sugar in that coffee?" "Hang on, I have to get approval." 

Janet Reno, the two words KFR hates to hear,  trusted her prosecutors to make the correct decisions in court. Ms. Rundle doesn't trust them to sharpen a pencil without supervision and approval. Well, that's not really true. She doesn't trust them to get a pencil to use without approval. Sharpening it is a whole other set of supervisors who have to sign off on it. 

We call on Ms. Pearson to promise to hire smart, independent thinking prosecutors who can be trusted in court to make the dozens of decisions on cases every day, without seeking approval from a line of supervisors that stretches from the REGJB to Joes on Miami Beach, and back. ("Want some stone crabs from Joes for lunch?" "Hang on, I have to get approval.")

We will have more to say on this subject. But for now, to Ms. Pearson: welcome to the party. You have a real chance to be an agent for change.

NEXT CASE KATHY RUNDLE

The Officer Aledda case is in limbo. Five jurors rejected the prosecution's theory of the case, illustrating just how hard it is to ask citizens to second guess officers who make split second decisions in the line of duty. That two prosecutors with unimpeachable integrity- Don Horn and Reid Ruben- believed Officer Aledda acted criminally is good enough for us. Their view was not supported by the jury, but we accept their decision as the product of thoughtful investigation. 

Now it is time to move on Ms. Rundle because officers who improperly pull and fire their weapon is NOT what is destroying this community. For every questionable police shooting, there are 100-500 cases (or more) where police officers demonstrably lied and we have yet to see ONE prosecution by the Dade County State Attorneys Office against a police officer for perjury during a deposition or court testimony. And it is the dishonesty of police officers that destroys the integrity of the criminal justice system and our community, not the one questionable shooting case. 

Every week the  Dade Public Defenders office sends emails rightfully congratulating their lawyers on a victory at trial. And some of those wins are because of weak evidence, unsure witnesses and the like. But there are enough cases discussed where the body or police vehicle camera and audio completely contradict what the officers have written in police reports and given depositions under oath about that shows we have a decades old epidemic that your office turns a blind eye too. How many times have prosecutors lost a case because the defense demonstrated that the officer(s) lied? And how many of those cases has your office followed up on and conducted an investigation for perjury? We cannot think of any. 

Defense attorneys often will tell clients that prosecutors do not lie because no case is worth their career. But we cannot say the same thing for police officers. We see the booking photos with our clients beaten bloody and read the arrest forms where the officers charge battery on a police officer and they have nary a scratch. We read the reports of drug investigations and then we get the police radio transmissions that show the officers were not where they say they were at the time- but that doesn't happen much anymore because now those same lying officers just use their phones instead of official radio communications. 

The danger and damage to our community is not the rare and indiscriminate police shooting- although those get the headlines. The danger to our system of justice and to our community is the epidemic of officers who lie and perjur themselves with no fear of being caught and prosecuted. The worst that ever happens in the case where officers are caught lying is the case is dismissed. 

Where is the Dade County State Attorneys Office when a law enforcement officer is caught lying? Why aren't prosecutors like Don Horn and Reid Ruben and legions of other dedicated prosecutors assigned to cleaning up the real scourage of our community? 

Miami is watching and waiting and the silence is deafening.

THE SAO: TWO VIEWS

We received two comments with two different views on the SAO under State Attorney Katherine Fernandez-Rundle.

 Anonymous said... It is such a tired line the worship of Reno and the hatred of KFR. Reno was a great person and we have not had an AG Since with her integrity. That said, Reno was the State Attorney when crime was totally out of control in this city. There were double the number of murders and robberies that there are today. German Tourists were being killed regularly by armed robbers. Kathy has been SA during one of the greatest drops in crime and has done many innovative things such as setting up states first human trafficking unit, insurance fraud unit. She disbanded the narcotics unit and increased the staffing of the career criminal unit. All the while Rick Scott destroying her ability to retain staff by giving no raises for 8 years and cutting all employees pay by 3 percent. Not saying she or that office are perfect but all you whiners go defend a case up in Broward and try to reason with one of the robots employed by that office and you will realize it could be much much worse.

Anonymous said... Most of the ASAs forced to attend this ego-driven event sat seething for two hours, as speaker after speaker reminded us of the wonderfulness of all that is her. It was regarded as an unnecessary imposition, not a pleasure. When the rabbi finally gave the ending benediction, the ex-judge celebrity who served as MC decided it was appropriate at that point to add another 10 minutes of her remarks. The capper was that absolutely NO thought was given to what was ostensibly the purpose of the gathering, i.e., for the ASA's to be sworn in and have their oath signed by one of the several judges present. Rather than prearrange and announce that the judges array themselves in an organized manner so everyone could line up and do this quickly and easily, a mad crush ensued as ASAs scrambled to get out of there so they could then get into the fun of downtown rush hour traffic. A good time was had by none. The comparisons made to Ms. Reno only reminded us that she would've never staged such an event.

STATE ATTORNEY INVESTITURE TODAY!

It's not a Trump-ian inauguration, and we are sure that Kathy Fernandez-Rundle will not obsess over the size of the turnout, but today is the swearing in of our State Attorney, and all of her assistant state attorneys. 

So if you want to respond when the padre says "whoever objects, speak now or forever hold your peace" this would be the time to do so. 

Here are parts of her speech that we would offer, gratis, for her to use:

"I stand here today in ths shadow of giants. Richard Gerstein, who trained a generation of lawyers who shaped this community and who had the good sense to recommend Janet Reno as his replacement. And of course Janet Reno, who instilled in the next generation of lawyers one simple ethic that applies to any age and any time: Do right. Go where the evidence leads you regardless of the political consequences, and never ever prosecute a person who MAY be innocent....

"Reno and Gerstein planted acorns, that grew into oak trees and you- the members of this great office, stand in the shadow of those great trees. Never forget that you have a lifetime to create your reputation, and just a few seconds to ruin it. Your opponents may mislead you, but you can never mislead them. Judges may dismiss your arguments, but you can never dismiss them. Police and witnesses may not respect you, but you can never disrespect them. In short, you have the toughest job in the legal system. And the best. ...

"Your simple mandate is a holy one in our society. Go do justice. That often means winning, but sometimes means losing. But you don't lose when you dismiss a case or reduce charges or a jury votes not guilty. You still win, because those outcomes could have never occurred without you doing your job. 

"I leave you with this. You are here because I trust you. You are here because this community needs you. And you are here because you care. Never stop caring, and I will never stop believing in you. Now go and do justice."

STATE ATTORNEY INVESTED

It's cold and getting colder. Temps will dip into the 40's tonight. Bundle up. 

INVESTITURE: Whoops! We missed blogging about the investiture of State Attorney Katherine Fernandez Rundle who is serving a record fifth term. KFR's investiture was Friday February 15, 2013. We're certain our invitation was lost in the mail. Still, we wish her the best. 

Here is the SAO's email about the event:


Katherine Fernandez Rundle was sworn in for a record fifth term as Miami-Dade County's State Attorney on Friday, February 15, 2013. Hundreds of friends, supporters, office staff, elected officials, and other dignitaries attended the Investiture ceremony.

Florida Supreme Court Justice Barbara J. Pariente administered the oath to State Attorney Fernandez Rundle and newly elected Chief Judge of the Eleventh Judicial Circuit Bertila Soto swore in her 300 prosecutors. The investiture ceremony took place at Miami Dade College's Wolfson Auditorium.

Dignitaries who took center stage alongside the State Attorney includedUnited States Attorney for the Southern District of Florida Wilfredo Ferrer, Miami Dade College President Eduardo J. Padrón, Chief Judge Bertila Soto, former United States Congressman Lincoln Diaz-Balart, Harvard Law Professor and noted author Alan M. Dershowitz, Jorge Plasencia, Chairman of the Board of the National Council of La Raza, City of Miami Gardens Police Chief and current President of the Chiefs of Police Matthew Boyd, and Reverend Carl Johnson, Pastor of the 93rd Street Baptist Church.

Women of Tomorrow Founder and television personality Jennifer Valoppi moderated the event and State Attorney Fernandez Rundle's fiancé, well-known attorney David Efron, and her son Justin, accompanied her onstage during the event.

"I feel exceptionally proud and honored to be embarking on a new term as Dade's chief prosecutor," commented State Attorney Katherine Fernandez Rundle. "The faith that the voters have overwhelmingly shown in me is surpassed only by my desire to make my community a safer place to live and raise our families. I am so happy that my family, friends, and law enforcement partners joined me for this very special occasion."

Immediately after the ceremony, the attendees joined State Attorney Fernandez Rundle at a reception in the college courtyard.

WHERE THE BOYS ARE

Our disdain, dislike, disgust, and detestation, for Broward County is taking hold publicly, as word reaches us that Broweird is considering changing its name to ......(drum roll please) 
"Ft. Lauderdale County". Ta da! 

But alas, "What's in a name? That which we call a rose by any other name would smell as sweet."  
And that which we call Broward by any other name would still treat attorneys from Dade County like subhuman protoplasm. 

HAPPY NEW YEAR FROM KATHERINE FERNANDEZ-RUNDLE:
In our last post we summarized the interview Silent and Thin Charlie gave to the DBR. In this post, we re-print the oft anticipated New Year's letter sent out by the State Attorney. Notably absent is the SA's waist size or any dress code at the SAO. Perhaps next year. 


Dear Colleague,
As lawyers, we know that it is absolutely essential to have a State Attorney’s Office that operates with complete integrity, honesty and a true dedication to achieving justice for all members of our community. Ensuring my office continues to meet this standard will always be my commitment to you.
Today our community and our families enjoy a safer quality of life as a result of smart prosecutorial initiatives and diligent prosecutions. Many of us remember when Miami, then devastated by crime, was declared “Paradise Lost.” This is now a distant memory, in large part because of our efforts.
I am proud of our many accomplishments. Our conviction rates are almost 90%. We lead the State in the prosecution of career criminals and corrupt public officials. Our methods have been adopted as strategies to be followed by prosecutors throughout Florida. Since I became your State Attorney, crime in Miami has declined every year and juvenile crime has dropped by 50%. Crime prevention programs that I created, such as the Second Chance Outreach Program, help first time offenders put their mistakes behind them to begin anew.
As I begin my next term as your State Attorney it is my sincere promise to continue my work to maintain Miami as “Paradise Found,” never again to be devastated by fear and rampant crime and I am grateful to you for your continued support for these efforts. Together we can ensure that our community continues to be a wonderful place for us to live, work and raise our families.

COCKAMAMIE:
In the case concerning the disappearance of Rilya Wilson, the prosecution used convict Robin Lunceford to saw the defendant confessed to her. On Thursday, the defense called an ex-inmate to say Lunceford told her that the defendant didn't really confess. Got it? ASA Josh Weintruab called her story "cockamamie" on cross examination. Judge Tinkler-Mendez, keeping tight control of the trial, struck the word. And on it goes. 

ASA Weinstraub rips into McCloud's story. Judge Tinkler repeats his adjective: "Strike the word 'cockamamie! ' Chuckles abound

SPEEDY TRIAL CRISIS?

We'll take this moment to remind US Attorney Patrick Fitzgerald: "When you strike at the King, you must kill him." Ralph Waldo Emerson.  (It was either Emerson who said that, or former Judge Howie "The Mouse" Gross.)

Speedy Trial Crisis?

Not really, although the title of the post links to the Herald article where outgoing Public Defender (and incoming special consultant?) Bennett Brummer bemoans the fact that defendants facing third degree felonies who are represented by his office will "have to wait much longer to face a judge."

Oh really?  NO. 

As long as the judges are not shut down by the budget crisis, they will still set cases for trial within the normal course, and all defendants will be in court on a regular schedule. And Mr. Brummer knows that. We all do. 

There is a crisis, but we don't think Mr. Brummer is properly explaining it. We'll return to him in a moment- because right now the State Attorney is in our sights. 

Her brilliant proposal, as quoted in the article was for Mr. Brummer's office to spend less resources on defending misdemeanor cases. 

Bulletin to the State Attorney which she can ponder while on one of her many out of the office "trips":  The Public Defender's office would not have to spend any resources on misdemeanor cases if your lawyers stopped asking for jail on ridiculous misdemeanor cases!!!  Would you like us to ask our county court lawyers to write in on a daily basis with all the outrageous plea offers being made on petit theft cases, or possession of marijuana? Do you really want the statistics on PD domestic violence cases that are dismissed because the complaining witness has stated several times s/he lied and nothing really happened, and yet the prosecution continues the case for months and months? 

Yes, there are minimum mandatory jail sentences on repeat DUI offenders who need representation in county court. But as to all the other cases, don't take our word for it. 
Go speak to the County Court judges who see those other ridiculous cases prosecuted- they will tell you how out of touch the State Attorneys Office Supervisors really are. They will tell you how it takes three and four levels of supervisors who are all scared of their own shadow (remember last year's Christmas Eve Massacre at the SAO? Click here) before the prosecutor in court can do anything different than what some nameless -faceless supervisor wrote on a file six months before. 

Madam State Attorney: You want the PDs to spend less time on misdemeanor cases? Straighten up your own house before you throw stones at the PDs. 

Whew!  We've been waiting a long time to say that. 

OK Bennett, now get back to court. Wait. You're gone. Or are you? Is it Colorado or 14th Street? Or both? Lets us know. 

CATHY VOGEL RETIRES!:
Long time REGJB regulars remember Ms. Vogel as a good and fair and decent (decent as in caring and concerned) prosecutor. Several years ago she traded in her shoes for flip flops and went to the SAO in Key West (Motto "eat a shrimp out of season and we will get you!"). Now she writes in the  comments section yesterday that she has  retired and hung out a shingle across the street from the Key West Courthouse. Well Done Ms. Vogel!. Thank you for 32 years of service to our state.

If we attend, will the State Attorney address the issues that we raised during the “State Attorneys Office Christmas Massacre Post?”

Why is valet parking needed?

Will the State Attorney explain to us how Herb Walker decided to resign out of the blue, and how his resignation had absolutely nothing to do with the sexual harassment complaints made against him?

Will the State Attorney explain to us her policy of firing people who lie about why they were fired? How about her policy of punishing and firing young assistants who assist charities.

In lieu of the above, does she really want Rumpole to attend her party?

We may well solicit funds to allow us to make a donation and attend.

Should Rumpole attend the State Attorney’s fundraiser?
And should we trust her valets with our car?
