IMPEACHMENT!

Ah the "I" word. It is more than you think, as this edition of the right and Hon. Judge M. Hirsch's Constitutional Calendar teaches:

Thomas Jefferson swept into presidential office determined to purge the federal judiciary of the Federalist judges appointed by his two predecessors.  His weapon would be impeachment.  He would start with the low-hanging fruit and, he hoped, work his way up to the greatest prize of all: his bitter antagonist and distant kinsman, Chief Justice John Marshall.

The very lowest-hanging fruit was John Pickering of the U.S. District Court for the District of New Hampshire.  Pickering, once a leading member of the bar and the author of his state's constitution, had degenerated into dementia and alcoholism.  On February 4, 1803, the president transmitted certain "letters and affidavits" to the House of Representatives with his encouragement that impeachment proceedings be instituted.  They were.

Trial before the Senate began on March 4, 1804.  But the Senate was immediately presented with a problem of constitutional interpretation.  Impeachment required that Pickering, like anyone to be impeached, be guilty of high crimes and misdemeanors.  The evidence that at all times material Pickering was insane and incapable of forming the intent to commit any crime was irrefutable.  In an ordinary criminal proceeding, this would render conviction impossible.  But surely Pickering was not entitled to remain in office as a United States district judge because he was too demented to form criminal intent.

The senators reconciled themselves to the notion that the "misdemeanors" referred to in the demised constitutional provision did not, or did not necessarily, refer to criminal misdemeanors, but was simply a catch-all phrase for misbehavior inconsistent with the duties of office.  On that basis, Pickering was convicted.

IMPEACHMENT TRIAL BEGINS

Dateline Washington , DC, The Capitol.
The third trial of an Impeachment of The President of the United States has begun. The Senate Sergeant at Arms started the proceedings as follows:  "Hear Ye Hear ye Hear ye! All persons are commanded to be keep silent, on pain of imprisonment, while the House of Representatives is exhibiting to the Senate of the United States articles of impeachment against Donald John Trump, President of the United States."

House Intelligence Committee Chairman Adam Schiff then took the podium and read the articles of impeachment to the Senate.  Once done, the members of the House present were dismissed and Senate Majority Leader Mitch McConnell (R-Mars) summoned the Chief Justice of the United States to the Senate. The CJ will be sworn in by the President Pro Tempore of the Senate (literally "the oldest guy in the room").
Once sworn in, the CJ, pursuant to Article I, section Six of the Constitution, will swear in the members of the Senate, who will swear to do justice, according to what polls best for their re-election chances. Then, in groups of four, the senators will be called to the podium to sign and oath book, which entitles them to receive a groupon for 1/3 off all footlong Subway Subs in the Dayton, Ohio, area during the week of February 3, 2020. Upon signing the oath book, the official Senate Social Media director will record and post on Instagram the act of the Senator signing the oath book and receiving their groupon.

Rumpole knows, and now you do as well, that there are only two times senators sign an oath book- when they are sworn in as a senator, and when they are sworn in as a juror in an impeachment trial.

Rumor discounted: There is  no truth to the rumor being floated that as a protest against the impeachment trial, Republican senators have agreed to sign the name "William Jefferson Clinton" and/or "Alfred E Newman" in the oath book. Nor have three senators agreed to sign the names "Moe, Larry, and Curly" but this is  mostly because there was no agreement as to whether Shemp could be substituted for Curly.

According to schedule, the Senate will then break to take up other important business of the country, including resolutions approving "National Plumbers Day" (October 19); "National Pumpernickel Bagel Day" (June 11) and a resolution approving the posting of the phrase "Don't text while driving or flying" in all Transportation Bureaus of the United States.

We will continue with our coverage of the senate trial of Donald John Trump as events warrant.

IMPEACHED

At about 8:25 PM on Wednesday December 18 2019, Donald J Trump, the forty-fifth President of the United States became the third President of the United States to be impeached by Congress.

A few thoughts:

“Never do an enemy a small injury”

Machiavelli, The Prince.

The Democrats are ignoring this lesson to their own peril.

"Be careful what you ask for in life, you may get it."
Now that the President has been impeached, the worst is behind him. This date most likely marks the nadir of the Trump Presidency. It doesn't feel like a low point for the President, does it? It doesn't feel like a victory for the Democrats does it?

This moment will be marked and debated and raised by both sides right through election day in November, 2019.  The voters will decide, but we cannot help but feel that this is net-positive for the President.

Item: The RNC and Trump reelection campaign raised over ten million dollars from small donor contributions within the last week.

Prediction: Two of the next three presidents will be impeached. Impeachment has been cheapened and will become a political tool for the party controlling Congress when a President from the other party occupies the White House.  Abuse of power is such a nebulous and flexible concept that it will be applied as the measuring stick for the next twenty years against Presidents, and when the other party controls Congress, few will measure up.

We will update this as further thoughts strike us throughout the evening and tomorrow.
