YOUR TAX DOLLARS AT WORK

 FDC and County Court Judges....that's what is on our mind. 

Your County Court Judges are back from a week in semi-tropical paradise, sipping Mai Tais and attending lectures on such topics as "The Defense Demanded Discovery...Now What?"    (the defense has demanded discovery, you should A) look at them in genuine puzzlement, as if you have never heard of the concept before; B) Shake your head in disgust and move to the next case; C) audibly mutter 'if that's the way you want to go on this one'...").  Their location was and is a secret for security reasons. Next up- your Circuit Court Judges hit the road for lectures on "Probate and You-having fun while banished"; "Salacious Secrets of the Civil Rules Of Procedure"; and "Why Rule 3's are for Chumps." 

FDC

From time to time we are forced to perambulate from the garage that also houses law firms, to FDC to see a client who wishes to retain us and has not yet been released. Things have changed. First, The Governmental Select Committee on Allowing FDC Forms to be Filled Out On Line, has issued its semi-annual report, indicating that the software protocol for filling out the forms has been reduced to thirty-six finalists. The Committee expects the issue to be resolved "no later than 2026." 

There are now NEW FORMS and new posters - all paid for with your tax dollars. 

The walls of FDC are now adorned with posters such as "Wash Your Hands" (in English and Spanish); "The Seven Signs OF Covid" (as surprising as this will be to you, the FDC poster says a cough, sore throat, fever and loss of sense of smell MAY be signs of Covid) and "Vaccinations Work!" ("honey what do you think about a covid-19 vaccine? I don't trust that Fauci guy, but I was in FDC the other day and they have a poster." "Well, if the Bureau Of Prisons said I should get a vaccine, that's good enough for me. They should know."). 

There is now a form denying you have Covid. It is as effective as those questions at the airport if someone else packed your bag, paid you money to take their bag, whether you have batteries that could explode, and whether a mysterious person of Middle Eastern descent gave you a box that has a radiation warning sign on it and asked for a favor. 

There is also a new form sly quizzing you on if you have Covid. 

"Do you feel sick?" "Do you have an unexplained fever?" "Do you have feelings of anxiety and dread?" (Gee, we just lived through a pandemic, there is a new strain even more infectious, Senator Joe Manchin just sealed the fate of the planet to overheat and kill all life on it because otherwise West Virginia Coal Miners won't make it....nah, I have no feelings of dread or anxiety." )

We put people on the Moon. We put Rovers on Mars. We cured Polio and invented the Silicon Chip which eventually led to the creation of Tinder. We can do great things, and yet the BOP spends money on useless forms and insipient posters and refuses to allow lawyers to fill out forms on line to schedule visits with clients ;  and  WHY, someone please tell us, in this age of Uber, do they need to know the Freaking Car We are driving? AND the license plate, just to allow us access to see our client.  And we know they don't really check, otherwise someone would want to know why consistently put on the form that we are driving a 1936 White Rolls Royce Phantom with the license plate 123ABC. 

We kid about the judges. We are all in favor of judicial education (and if you could see us fighting not to write more about WHY they need more education, you'd understand just how difficult writing this blog can be at times).

POWER OUT AT FDC

 This is a breaking story. The power is out at FDC Monday morning. Most likely it's one of those things where managers are looking at each other holding the FPL bill, each saying "I thought you paid it last month". 

Without power, those electric doors do not work. So visitation is canceled as of this writing at 10 am. 

Meanwhile, take a moment today and pause and think about those brave men, 78 years ago today, jumping into Normandy, France, and landing on boats to free Europe from what Winston Spencer Churchill called "the odious grip of the Nazis"

FDC LOCKDOWN

 Put away those masks and gloves. Time to go for coffee and a bagel because if you were planning on going to FDC  (Motto: "You wanna see who???") Tuesday morning, you now have some free time because there is a lockdown. No entry. Do not pass go and do not get one of those locker keys to store your phone and car key. 

FDC, that behemoth block of granite that houses the broken and downtrodden and depressed, is closed for legal visits. 

Here are some fun facts about FDC.......

That's right. There is nothing fun about FDC. 

Want to have some fun with them? Try bringing in a book. The next time you go, bring a copy of Catcher in The Rye or The Grapes of Wrath and see what they do. 

You can't bring in colored handkerchiefs, because they think it's a gang affiliation. 

The Government sends all discovery electronically. Want to bring in electronics to review it with your client? NO PROBLEM

Just get written permission from Justice Alito, the Pope, the attorney general, former attorney general Bill Barr, and some nameless, faceless bureaucrat that runs the FDC "legal department" whose voicemail has this outgoing message "Hi. Thanks for calling FDC legal. I am out for the 2011 July 4 weekend and will return on Tuesday and will get to your messages as soon as I can. You can message me on Compuserve if you need quicker assistance."

Yup, FDC- a full-service institution and a wonderful example of your tax dollars at work.

SNAFU

 FDC is open for legal visits.  Wine Cheese and Masks are available for purchase through the vending machines. 

The Miami Dade Clerk's office (Motto: "Using Yesterday's Technology Today") * Calendar Function (whatever that is) is now working, causing millions to breathe a sigh of relief. The Dow went up a 100 on the news. 

And Omicron is still making everyone sick. 

In other words, an old military acronym is applicable: Situation Normal All F'd Up. SNAFU

QUERY: In a time of a pandemic, do you think it is appropriate to file a speedy trial demand for your client? WE DO NOT. 

Now before you write us nasty emails, there are legitimate exceptions, especially for incarcerated clients who are overcharged and will prevail at trial.  But to the extent smarmy defense attorneys who never try cases (you know who you are) who think they are being smart by filing speedy demands, we vehemently disagree. All you are doing is dragging our end of the profession down to the civil lawyer's status (sorry guys), and no one wants that. 

Yes, for you prosecutors who read the blog and fume at our cheap shots, we are on your side on this one. Now how about offering some reasonable pleas because this new wave has once again shut things down? 


* Good writers borrow but never steal. A wit sharper than ours came up with that saying for the Clerk's Office and we have permission to use it.

FDC SHUTDOWN SORTA

UPDATE: FDC OPEN FOR LEGAL VISITS...so they say. Let us know. It's a promise from a government agency, which, along with eight bucks, gets you a coffee at Starbucks.  


BREAKING.... Tuesday Afternoon: 

FDC is shut down. All visitation canceled. All inmates will be kept in their cells. 

We don't have much more information but hazarding an educated guess, it just might have something to do with COVID.
