LIFE GOES ON

Life goes on and so do we.
There is death and tragedy and suffering and waiting to be called for a case and waiting to get into FDC...

And there is life and art and literature and beauty and decency and caring and concern for others. 

So in the face of heartache and pain of losing a good friend, we do what he would have wanted. We go on. Living our life as best we can. Blogging like no one else can. And winning cases....

Speaking of winning cases...

DOM scored another win this week in federal court. 
A nasty EPA , dredging behind a home   without all the permits case in the Keys case.  The feds came after his client like he was Pablo Escobar caught with a thousand keys....or like a Biden supporter in Georgia tinkering with the voting machines. 

But it didn't matter. Justice prevailed and David and his team head into the new year with a nice Christmas win.

Congratulations to Team Markus for a great win. Alex Michaels would be proud.

It was a beautiful send off for the "contumacious" Alex Michaels. How many defense lawyers could get so many current and retired judges to attend a funeral in the middle of the day? Alex was one of a kind. Phil honored his memory beautifully.

I hope the entitled one gets the proper permits this time! Dredging is killing the Keys' environment. Sounds like the client won, the environment lost. What a world.

David got lucky in that case because he had a judge that looked out for the defendant. Every ruling went their way I heard!

Luck is the residue of design. and BTW to that other comment I didnt post about DOM and why I blog about his wins...it's because he has the freaking courage to try cases and not roll over and that deserves praise and publicity. You don't like it- go to the disney web page and have fun. I'll survive without you reading the blog. I promise I will

I believe David won because he thought of what to say and show and question and had a plan how to do it. It wasn't because of "luck", it wasn't only because of the judge, nor do I think it was the result of his courage alone. Environmental laws are easy to generalize in order for readers and listeners to push for protection, cleanliness and environmental safety. It's the right thing to do; we need to protect our environment and personal health. Most criminally charged environmental violators settle with the government prior to trial. Yet, it isn't wrong, sometimes, to fight back against them and their prosecutor, particularly when the environmental agents pushing for what they think the statute requires - based on their views of what they claim to have seen - aren't always right about what the law prohibits and ALL the facts reveal.

DOM and his team won because they believe you cannot win a plea. They prepare for trial and are great at what they do. Gee, what an unusual concept for a trial lawyer.
