Where, you must be wondering, are the DBR and El Herald articles on the resignation of embattled county court Judge Mike Mirabal? The articles are on hold until Double M sends his papers to Governor DeSantis. And it appears, although we have it on very good authority MM told the JQC he was outta here, he has not sent the papers to the governor.
"Why"? You as the inquisitive reader may be asking, have the papers not been sent? And while we are on the subject of mysteries, do you need a license of any sort to fly a helicopter on Mars as NASA did on Monday?
We do not know. And when we are stumped, we follow that age old journalism advice- follow the money.
First, MM is resigning. We stake our considerable reputation on it.
Maybe he is waiting for a last paycheck. Former Judge Harvey Shenberg had a problem sending a kid to college on a judicial salary (so he took an undercover FBI bribe to sell an informant's name and went to prison for a while and a bit). Maybe he wants to do the right thing and give his staff a few days to find a new job, although that would be out of character for a person whose character is well documented by doing a Pacer search with his name. The federal lawsuits say it all, and the order where Judge Williams bounces him out of court where he is the plaintiff is a doozy.
Let's just say you do not want to have MM involved in any real estate transactions you care about. Things tend to go horribly wrong when he is involved, and there are title double switches, deeds and misdeeds abound, and a real estate game of three card monte usually follows. "I can't be sued for foreclosure, I sent the deed to my mom and then the dog ate it " kind of stuff. Really,
Maybe there is some comp time at stake. The truth will out and it will not be pleasant. All we can tell you is this, people who do know are being very very silent. So something is rotten in Denmark, to quote our Bard in Hamlet. And while we are on the subject of Billy Shakespeare....

MM is a friend and is mentored by Judge Victoria Del Pino. She pushed for him and pushed him. It is well documented. Is anyone asking Del Pino why she allowed her BFF to go down? Or, is she protected by the Chief's Gals Club that has now has run the 11th for over a decade?

Cmon people. All those who run for judge it’s their decision. You may be friends with someone and not agree with their way of doing things. Leave del pino out of it that all that is listed about mm doesn’t show she had anything to do with him. Hid application. His business. His actions. It’s like if you hold all cops accountable for what another officer does. And if you don’t like del pino is one thing but don’t smear her for a friend.

The Miguel F. Mirabal v. Bank of America case is 15-cv-21838 KMW. J Williams dismissed it with prejudice in a careful and edifying order (DE 37) which is worth reading. The case was dismissed in 2016, and I don't think Mr Mirabal was elected until after that, but evidently it has come to light recently (it was his attempt to avoid foreclosure, by blaming the [wrong] bank).

Charges after resignation?
Anthony V. Alfieri, the director of the Center for Ethics and Public Service at the University of Miami School of Law, said Mirabal’s resignation should spark a conversation among the bar, bench, and the public, to change the way judges are elected and retained.
“Whatever the aftermath of Judge Mirabal’s brief tenure, the hard but persistent question is whether the present system maximizes the best pool of diverse and qualified judicial candidates sufficient to ensure the highest quality of justice in Florida courts,” said Alfieri, who is not involved in events surrounding the judge’s resignation.
Meanwhile, information from The Florida Bar suggests misconduct charges could await Mirabal following his resignation from the bench.
“The Bar does have a file on Judge Mirabal, but it is on monitor status since The Florida Bar does not have jurisdiction over sitting judges,” said Leslie Smith, staff liaison for the bar.
Mirabal did not respond to a request for comment.
Andrew Berman, an ethics expert and shareholder at Young, Berman, Karpf & Karpf in Fort Lauderdale who has no involvement in the judge’s departure, said there is no escape for the bench.
“If you have bar problems before you run for judge,” Berman said, “you might want to think twice if it turns out there is substance to them because they’re going to follow you.”
Now, the Miami-Dade Circuit Court spokeswoman said Mirabal will no longer don the black robe effective April 30.
