BLACK TUESDAY

Tuesday of this week will forever be known henceforth as "Black Tuesday" judging (pun intended) from the moaning, groaning and shocking movement of judges in and out of the REGJB pending the New Year. 

For example, Judge Richard Hersch was said to be beside himself (and not in a good way) with his pending assignment to Juvenile in the new year. Ditto Judge Pooler. 

Some judges are calling it a massacre. Others could just be heard weeping softly into their cafe-con-leche's Wednesday morning. 
The loss of these judges along with De La O and Rudy Ruiz, along with the loss of Judge Colodny who already went to probate (Probate???) recently, means that the REGJB has suffered and will suffer a substantial talent drain. 

The list is below:
(btw that new judge "vacancy" listed as going to Juvie could well be the best of the bunch. Guaranteed not to screw anything up.)

OK, no big deal.

We get rid of Pooler who never gave a break to anyone. She'll convict every single kid.

Al Milian, a nut job who needs to be somewhere else. Go riddance.

Steve Milan, a person who simply cannot do the job and who got caught demanding that his bailiff lie about what happened in court.

Richard Hersch, too smart to be in Juvy and who already did his duty in Juvy.

Milan did not tell his bailiff to lie. He lied on his own and was subsequently fired.

Nice try Steve. You totally told your goofy bailiff to lie and got busted by Lurvey. I was present saw it happen and remain astounded that no JQC inquiry followed.

Not true that Pooler never gave a break to anyone. I personally dealt with a case where she saw the injustice in an old conviction and sat down with me and the prosecutor in chambers and helped convince the prosecutor to agree to do the right thing. Client who was sentenced to life had sentence mitigated, is out and doing well. F99-34071.

De La O is a huge loss for criminal.

The loss of Richard Hersch is huge. He is a dedicated, hard-working judge who loves what he does and cares about everyone in his courtroom. He will be sadly missed as will de la O, who probably wants to go to position himself for other opportunities.

My dear brothers and sisters,

I, too, am sad to see some of the best talent leaving REG for different assignments. As a former judge who served 10 years in the system, we need to understand that there is a body of thought that claims that rotation of judges is a good thing. They say that diversity is a good thing and when people seek to move into other levels there is a belief that a judge should have served in all divisions.

That being said, in 44 years I have seen a lot of people come and go, including judges and great lawyers. Somehow the sun will rise in the east tomorrow morning and set in the west tomorrow evening. The system will grind on just as it has for manny, many years. The sky has not fallen.

Sad news:

Mike Cohen Executive Director of Florida Lawyers Assistance passed away. He fought cancer for about 15 years but, had heart issues as well.

If you ever had a drug or alcohol problem and you are a member of the Bar, you knew him. Even if you had a first and only time DUI, you got to know him. As he said, he was paid to simply help lawyers with their problems…. Even non drug or alcohol problems.

If you knew him, you liked him.

I represented about 75 lawyers and a few judges in my career with DUI or drug issues and boy was he helpful. He was the shoulder you could lean upon in time of need. He was also my friend and someone I called often. He will be missed.

Ted, in principal I agree with you but the drain good, decent fair minded Judges leaving criminal (Colodny, De La O, Hersch, Pooler, Diaz who has grown into such a good judge) is mind boggling, especially when practically none of them want to leave. This arbitrary action will hurt the defense bar and make life tougher for us and Defendants. Someone needs to talk to Soto to address this.

It's not arbitrary, there's a rule written long ago to keep judges from staying in civil forever.

8:01am...it is arbitrary when De La O is taken out of criminal and the other judges who are so pro-state are allowed to stay when the "rule" says they are supposed to go....Diaz is staying.....Millan (god help us all) is staying....Milian....staying...but De La O has to go....anyone else see a PATTERN????

204, oh yeah, clear pattern. Thank God you caught her. Soto obviously is trying to stack the deck against the defense. Since she was always so fair in the past, I suspect she's been replaced by a pod person. Whatever you do, don't go to sleep..............
