FLORIDA LEGISLATIVE UPDATE

$ Judges to make even more money $

With three days left in the 2006 Legislative session, judges are very happy today. The Appropriations bill appears headed for final passage and the Circuit and County Court Judges both get raises. Each will see about $6,000 more per year:

Circuit $139,497
County $130,693

EVEN MORE NEW JUDGES:

The Eleventh Circuit will get 2 new judges effective September 1, 2006 and two more new judges effective December 1, 2006. Dade County Court will get one more judge effective December 1, 2006. That means Gov Bush gets to name at least five more new judges before his term runs out in January. Looks like the JNC will remain very busy.

PER DIEM FINALLY INCREASED

For all of you who were ever an ASA or APD, you know that it was $3 for breakfast, $6 for lunch and $12 for dinner ($21 per day) and that amount has been around since the 1960's. The stiff suits up in Tallahassee have finally raised the per diem to $45 per day and mileage went from 29 cents per mile to 44.5 cents per mile.

ETHICS, JUDGE HERNANDEZ & D'ARCE

F.S. 104.31, via Senate Bill 2000, has been amended and the new language reads:

"An employee of the State or any political subdivision may not participate in any political campaign for an elective office while on duty".

Effective October 1, 2006, a first refusal will now become a misdemeanor punishable by up to six months in jail; a second refusal becomes a first degree misdemeanor. The law also states that Discovery does not include manuals, schematics, software of instruments, etc.

Two consequences:

Elortegui probably won't raise his rates. He'll likely amend his slick full-color brochure to say that he now includes the refusal in his $800 DUI fee :-D

Defense attorneys will syill seek manuals, schematics and software of instruments on cosntitutional 5th and 6th amendment grounds.

One question:

Shouldn't this law limiting discovery require a super-majority to get passed since it is an amendment to a criminal procedure rule (3.220)? Did it pass by a supermajority? If not, there will be plenty of litigation around the issue and the Florida Supreme Court will have to ultimately decide on its constitutionality.

Hey captain..you are incorrect on the JNC part of the new judges...These seats will be for election! the issue that is still up in the air is whether the elections will be in september or november for the new seats...the big mess with the issue is if a candidate qualifies, can they choose to resign after qualifying and apply for the new seat??? questions to be answered...Friday..

When I last heard of that project, Marilyn Milian was still on the Dade County bench.

No idea.

3) The Fourth Amendment?

Dead. And some judges, cops, and prosecutors (like the Komissar of Konty Kort) are celebrating its passing and how they brought it about.

4) Civility among the brotherhood and sisterhood of the Shark?

It went down the way of reasonable fees when the sharks started to bite each other's tails as they headed for the bottom to suck on $69 fees for tickets, $300 fees for misdemeanors and $1200 fees foe felonies.

5) Judge Ferrer’s TV Career?

Who knows? We just hope he doesn't try to come back to the bench when the show gets canceled.

6) The investigation into attorneys who share fees with bondsmen?

They'll never do a thing about it. Just like they haven't done anything about it in the past. Just like they haven't done anything about the in-jail solicitation of bonds by well-connected bailbond agencies.

7) The prosecution of the Fernandle Brothers?

They are waiting for some big dump trucks of soil from other counties to bury everything.

8) Chris Rundle?

No idea.

9) Half day back-up trials?

No idea.

10) The JA Perfume Scandal?

It forced people to drive to stores to buy perfumes at full retail instead of just going to the chambers to buy them at little above wholesale.

11) The agreement to name the Jury room in honor of Judge Crespo and the placing of a plaque to commemorate his dedication to the REGJB?

No idea. Probably languishing is some bureaucrat's desk somewhere in Dade County.

12) The Internet bubble?

Burst.

13) Mini skirts?

Some lawyers still wear them to court (hopefully the ones with nice legs).

14) A bond issue for a new criminal court house?

It was defeated by the voters, so the County government responded by spending $18 million to build two elevators.

15) Jason Grey?

Still around. He was in the building as of this morning. Just not posting, or not posting under his real name.

16) The Blog?

Heading for certain deah unless it can get a life-saving shot of scandal, sex, sleaze and politics.

Nice to see that the judges secured themselves a pay raise while leaving everyone else in the system to suck it.

The promise, both implied and express, was that the big-shots would take care of the minnows. But when the big-shots walk away with the $$$ and the minnows are left holding the bag, the bond is broken. When push came to shove, the minnows were forgotten.

And since the bond is broken, I say screw it. I can e-trade and answer the phone at the same time.

Justice Pariente and the "lobbyists" for the courts placed funding judicial staff as their number one priority. It was booted out of committee. Staff got 3%. The raises given to judges is less then 3%. If you find working for the courts as a staff memeber, or a judge financially unrewarding, go get another job. Whining is so unseemly, unless you are three years old.

Joel Robrish
Julio Perez
Jon Schwartz(the jerk who wears the jewish hat even tho not jewish)


and others who somehow have all clients come from the same bondsman.

Actually as to attorney's who pay bondsmen.. I'd like them investigated and sanctioned.. I am tired of seeing defendants forced to use a particular lawyer by their bondsman. Obviously it takes business from the rest of us.. and sadly.. some of the attorneys who engage in the practice are some of the most irresponsible, incompetent lawyers that I've ever come across.. I'm not making reference to any of the lawyers listed earlier.. I have no idea whether or not they rely on bondsmen for business.
