NEW JUDGES

"No Judge writes on a wholly clean slate."
Felix Frankfurter, 1937.

Judges Ivonne Cuesta and Laura Stuzin were elevated from county court to circuit court this week, replacing the vacancies that occurred with the retirement of Judge Cardonne-Ely, and elevation of Judge Lindsey to the 3rd District Court of PCA Appeals.

Judges Altfield, Brinkley and Multack, along with ASA Luis Perez-Medina were among those whose names were sent to Tallahassee but were not given a seat when the music stopped.

Judge Rosa Rodriguez, a former Dade Public Defender, resigned from the Circuit court after 18 1/2 years on the bench, effective Halloween, 2017. Boo!

Judges ought to be more learned than witty, more reverend than plausible, and more advised than confident. Above all things, integrity is their portion and proper virtue.
Francis Bacon, "Essay LVI: Of Judicature", Essays (1625).

JUDGE ROSA RODRIGUEZ DRAWS AN OPPONENT .....

THE CAPTAIN REPORTS:

BREAKING NEWS CONTINUES ... JUDGE ROSA RODRIGUEZ HAS OPPOSITION .....

In what's now becoming a regular occurrence over the past few days, another long time Incumbent Judge has drawn an opponent.

Early on it was the likes of County Court Judges Ed Newman and Fred Seraphin, and Circuit Court Judges Jason Bloch and Robert Luck.

In the past couple of days, add Incumbent Judges Wendell Graham, Nushin Sayfie, and now Rosa Rodriguez to that list.  WHO'S NEXT ?!

Today, attorney Jorge A. Lopez has filed to run against the three time incumbent Judge Rodriguez.

Judge Rosa Rodriguez was first elected to the Circuit Court bench in 1998. She was reelected in 2004 and 2010. She is running to retain her seat.  In 1998, Rodriguez defeated attorney Ann Mason-Parker by 54% to 46% to win her race.  She ran unopposed in '04 and '10.

Attorney Jorge A. Lopez has been a member of The Florida Bar for 29 years. He has an office in Coral Gables. According to his web site, this is what it says about him:

Jorge A. Lopez, Senior Partner

Jorge A. Lopez earned a Bachelor of Science Degree in Business Administration from Georgetown University in 1983 and a Juris Doctor degree from the University of Miami School of Law in 1986. Mr. Lopez was admitted to the Florida Bar in October of 1986. Mr. Lopez has extensive experience handling complex commercial matters and litigation involving investor fraud and corporate disputes. Mr. Lopez also handles litigation of catastrophic injury claims, aviation disasters and consumer fraud cases. In addition, Mr. Lopez has represented clients against some of the largest financial institutions including Merrill Lynch, Morgan Stanley, UBS Paine Webber, Salomon-Smith Barney, CitiGroup, Credit Suisse First Boston and Prudential Securities. Mr. Lopez speaks Spanish and Portuguese

COINCIDENCE

As was pointed out by an alert reader of the BLOG, Attorney Rosy Aponte (who filed against Judge Sayfie) and Attorney Jorge A. Lopez, both have the exact same Campaign Treasurer.  That person is C.P.A. Carlos Trueba who has an office in Doral.

MONEY

We all know that you can't run a campaign without it.  And, like Judge Graham, who has raised no money and filed with one week to go before the qualifying deadline, and like Judge Sayfie, who has raised only $54,000, the least among all incumbent Circuit Court Judges, so does Judge Rosa Rodriguez fall into that same category.  Of the 14 Incumbent Circuit Court Judges running for reelection, only Judges Schlesinger, Bernstein, and Areces have raised less than the $89,000 that Judge Rosa Rodriguez has raised.  And when you add in the amounts lent to candidates' own campaigns, Rodriguez fall down to third to last with Areces and Sayfie bringing up the rear in total funds available for their campaigns.  Rodriguez has contributed a grand total of ZERO loaned to her own campaign. (See our BLOG post dated April 29, 2016).

Alert readers, please email us with any other tips and breaking news.

WHO IS THE BEST YOU EVER SAW?

SPENCE-JONES TRIAL UPDATE: Judge Rosa Rodriguez denied a prosecution motion to recuse herself from the case (because as a PD before becoming a Judge she once called the SAO "a house of cards", or some such other ridiculous reason) and as the Herald reports, opening statements were given Monday. The trial continues today.

GADAFFI SECRET DEFENSE PLANS: In an interview with the BBC yesterday, Libyan lunatic Colonel Gadaffi inadvertently revealed his secret plans for defending his grip on power: Gadaffi will resort to the Three Stooges double eye poke.

We're not kidding: the interview is here:

"Col Gaddafi challenged those, including UK Prime Minister David Cameron, who have accused him of having money abroad, to produce evidence.

He said he would "put two fingers in their eye" "

Former Secretary of Defense Donald Rumsfeld said yesterday that the 300 million dollars in last defense budget he submitted to train us troops in the "one handed block of the eye poke" would now prove to be a wise expenditure of funds. Yuk, yuk, yuk.

Sometimes readers drive the bus:

Sam I am said...

Rumpole: Everyone hates lawyers... (hard not to when you have to count Thomas Jefferson, Abe Lincoln, Gandhi and Nelson Mandela amongst your ilk). But here's a question for you and your able readers: Who are the five most vile attorneys of the past 300 years? I'll take my answer off the air.

Monday, February 28, 2011 6:07:00 PM

Rumpole says: It's nice to remember that we actually practice an ancient and honourable profession. So lets turn the question a bit and also ask who are the five best attorneys you have ever seen or hear or read about? Have at it (best or worst or both)* and let us know who was the best and we'll post or Twitter some replies.

Speaking of Twitter, we broke the news today of the decision in Michigan v. Bryant about the Supreme Court doing away with the confrontation clause. The decision is an awful example of liberal activist judges like Roberts and Alito and Thomas creating by judicial fiat exceptions to the hearsay rule that are not in the Constitution and were not passed by Congress.

David Marcus has all the gory details on his blog. However, once again DOM celebrates the dissent of Judge Scalia and we remind DOM that in this matter Scalia's ox was not gored, so he stood on principle. However such is not always the case with Nino.

More on this case later this week.

See You In Court.

* If you have an axe to grind against a particular attorney who currently practices in the REGJB and want to label him or her the worst you ever saw, more than likely we will not post the comment, so don't bother or be prepared to sign your name and advocate why they should be included on the list.
