DATE LINE DOWN-UNDER JUDICIAL ENDORSEMENTS

UPDATE: Included is the letter to Gov Scott for the names nominated for the three, countem -three- open County Court seats. They include candidates Milena Abreu, which we neglected to indicate below, and Mr. Pracitto.  Query: If a candidate gets appointed on the day they win the election, do they have to handle two divisions ?(Not that it's that difficult in County Court. Sorry, but if walk likes a duck, and quacks like a duck, it's a spade.)






G-day blog readers. It's a delightful 13c  here down-under, a welcome respite from the dog says of August in South Florida, not to mention Kensington, U.K. 

Our blog contributors are doing just fine towing the rope, holding the line, and keeping the blog afloat. 

When you travel outside the US, you quickly become aware of one thing- our country is the laughingstock of the world. 

A scene at Bad Frankie recently:

"Where'ya from mate?"
"Miami"
"Can I buy ya one?"
"Maybe I should buy you one?"
"Nah mate, with your president you need one more than I do. Crikey he's an idiot isn't he?"
"Make it a double por favor." 

JUDICIAL ENDORSEMENTS: 
The older we get, the less we know about those who wear robes, and those who want to. We are entering a world where most of our learned and younger opponents do not know a world without a five dollar cup-o-joe at Starbucks, and where your phone has always been  your camera. 
So we cannot endorse everyone, because we just don't know who the heck they are.  But we feel comfortable with these robe-wearer wannabees: 

Milena Abreu. She ran a great race last time. She should have won. She is smart, experienced, will have a great judicial temperament and unlike most of those she will join on the bench, she's actually tried a case, which makes her sui generis

Yery Marrero. Diitto. She's been in the trenches as a PD. She's experienced and a great litigator and will make a great judge. 

Judge David Miller. We're giving him the benefit of the doubt here. We did not appreciate his "Maximum Miller" philosophy in sentencing (not that we lose cases and have to deal with that). But that was a long time ago in galaxy far far away. The civil lawyers we know are uniform in their praise of Judge Miller as fair, hard working, and the type of Judge who gives lawyers the time to make their case. And the whole thing about his opponent; her big law-firm trying to throw foul elbows just stinks to high-hell. It's very "dark-side of the force-ish" from a big firm known for bullying tactics. And after reading this, we expect a nasty C&D  missive from them. Better people have tried. 

Louis Martinez/Renee Gordon.  We know of both of these candidates. They are both experienced, hard working, and will make good judges. You can't go wrong here with either of them becoming a judge. 

Chris Pracitto.  He knows his way around the criminal, DV, and family courthouses (Yes, DV and family are in the same courthouse-this is what is known as literary license). He is experienced and well respected. He knows criminal. He knows civil and he will be a great judge. His name has gone up to the governor and it would be nice to see him appointed. 

Kristy Nunez.  Rumpole says former prosecutors make the best Judges. And Ms. Nunez has been a very good ASA. She will make a good judge. And her opponent...? Res Ipsa Loquitor. 

Olanike Adebayo. We have a fondness for judicial names we can neither pronounce nor spell. But Ms. Adebayo is a very competent lawyer and she has intelligence and talent and will make a great addition to the bench. 

Michael Barket. We don't know a whole lot about Mr. Barket. But we know a whole lot about his opponent and there is nothing much to like about her being a judge. And for perhaps the first time in our career, we use a civil Latin phrase twice in one day. Res Ipsa Loquitor.

Candidates: Don't see your name up here? We didn't receive your check...duh. 

From Free Down-Under, there is a whole world that lives in peace with their elected leaders who they respect and who don't make secret deals with KGB agents and disparage their own war heroes while avoiding military service themselves. 
It's almost enough to make a blogger wonder about a new life in a new land...

I can't and won't forgive Miller for the dozens of young men he maxed out for no other reason than the fact they elected to go to trial. He indiscriminately sentenced people to the statutory maximum without any consideration for the circumstances, the desires of the victim or the life story of the defendants. He is not worthy to sit on the circuit court bench, no matter how much they love him in civil.

Ms. Aponte has been referred to The Florida Bar by Federal Judges for her incompetency. She has been repeatedly sanctioned by Judges for her improprieties. She would be a disgrace on the bench.

Word on the street is he is moping up the latin vote like nothing that's ever been seen. He's a winner and I like voting for winners.

Rumpole. Thanks for your endorsement information in the eight election contests.

I would like to hear your impressions on the three who won without opponents. Betsy Zane. Carlos Lopez. Jacqueline Woodward. How do you think each of them will be as judges.

Pracitto never put his name in with the JNC as far as I know. Check your facts.

Judge Miller was an experienced trial lawyer in private practice for decades before joining the bench and giving up salary. He is hard working, in his chambers as early at 6 Am and it is easy to schedule hearings with him. Regarding his sentencing if the defendants were guilty they deserved the max after going to trial. He is much preferred over the inexperienced, newly arrived lady put up by the insurance defense firm CSK that everyone hates, including other defense firms. Hopefully all of the Plaintiff lawyers will get behind David and help him beat the inexperienced lady attorney who hopes to win with her Latin name and nothing else to offer that beats David's long history of service.

Trialmaster you cannot mean what you wrote. Please tell me you do not believe that EVERY defendant deserves the max for going to trial and losing. That there is no such thing as particular circumstances to a defendant and a crime and that judges have no right to consider such circumstances and should be nothing more than calculators after a trial. Please tell me you are not that stupid, dumb, and ignorant.

5:01 Pracitto was interviewed by the JNC two weeks ago AND his name was sent to the Governor. Check YOUR FACTS SIR! Good day.

Pracittio. Keep an eye on this one. He's going places. County-Circuit-Fed-11th...
Milena because a day without Milena is a day without sunshine.
And Lody-Jean because she really deserves it and would be a great judge.

BTW I don't know any of the candidates. I don't know nothing about Miami anymore. I'm stuck here in Lacrosse, Wisconsin managing a bunch of Aunt Annie's Pretzels at the local malls like Saul Goodman. It's not Miami, but it's a living.

POTUS: It's my great pleasure to Make America Great Again by nominating Judge Christopher Pracitto to replace Judge Ginsberg for a seat on the US Supreme Court. The Old bag couldn't outlast me....the justice passed away and now I get to put a real judge who won't legislate from the bench and will call balls and strikes and will give me my seventh vote in the case of USA v. Trump.

Given his use of Shakespeare quotes and Latin phrases, it is clearly quite obvious that Rumpole is none other than the Right Honourable Mr. Chief Justice Milton Hirsch.

The poll ratings for the actual judges are more interesting than these wannabe judges. The real judges in circuit not the playpen kounty kourt kiddie judges. Caba results came out last week. How did our favs do?
Not as well as you might hope. None of the REG judges cracked 60% for exceptionally qualified-number for qualified is irrelevant because all judges should at least be rated as qualified. Wolfson came close with 59.5 easily beating out all others-no surprise there. Another no surprise, Charlie Johnson was 2nd and Tinkler was 3rd. So much for Caba being friendly to the latin judges. The fearless leader admin judge Sayfie was 4th but with 10% voting her unqualified!
The bottom of the barrell will be no surprise either. 52% voted Blumstein as unqualfied-the highest in any division because Millan quit. Zilber 30% unqualified and Milian 20% unqualified. Hendon and Cohen each at 14% unqualified. This poll is pretty accurate.

Looking at all divisions only 4 judges were rated by over 70% as exceptionally qualified. Soto, Thornton, De la O and Lopez. No surprises there either. Although it is a little Latin friendly.

Other results of note:
Rod Smith couldn't even get half of voters to find him exceptionally qualified but hes going to fed court. Rudy Ruiz on the other hand was voted exceptionally qualified by 69%. Eig was voted unqualified by 25%-no surprise. Lopez was voted unqualified by no one! Del Rey with a 27% unqualified makes her third highest unqualified percentage. Only other judge to get over 20% unqualified was Korvick. No surprises.
