With the elevation of Judge Norma Lindsey to the 3rd DCA and the retirement of Judge Gisela Cardonne Ely, there are two open seats on the Circuit Court. The Eleventh Circuit JNC has met and nominated a total of 12 names to the Governor - he will choose two of those as our next Circuit Court Judges.

SO, YOU WANT TO BE A COUNTY COURT JUDGE .....

With the elevation of Judge Lourdes Simon to the Circuit Court, the JNC is now accepting applications for an open seat on the County Court. Please make sure to get your application filed before the deadline of August 24, 2017 to JNC Chair Luis Suarez, (lsuarez@bsfllp.com).

For those of you wanting to predict the five names that Governor Scott will choose, lay your money on any of the nominees that have been an ASA or AUSA or government paid lawyer. Just within the past eight weeks Governor Scott has continued his MO of appointing judges that are both young, and are former government employees. For example, since mid June he has appointed seven new judges including General Master and Judicial Hearing Officer Kristine Van Vorst, 40, to the Alachua County Court; Jamie Grosshans, 38, former ASA, to the Orange County Court; Judge Jennifer Gabbard, 45, former ASA, to the 13th Judicial Circuit Court; Judge Charles Sniffen, 44, former ASA, to the 12th Judicial Circuit Court; James Goodman Jr, 38, former ASA, to the 14th Judicial Circuit Court; and Darren Farfante, 46, former Justice Dept attorney, to the 13th Judicial Circuit Court.  Finally, was his recent appointment of Judge Lourdes Simon, a former Assistant Public Defender.

BREAKING NEWS . FROM THE 3RD DCA TODAY .....

Many of you have been following along with the "trials" and tribulation of the Lewis Tein saga. For many years their firm was raked through the coals by the Miccosukee Tribe and their legal team, led by Bernanrdo Roman. Over and over again, Lews Tein prevailed, thanks in large part to their talented legal counsel, Paul Calli.

Unfortunately, this latest round goes to the tribe. Lewis Tein filed a lawsuit in 2016 alleging four counts of malicious prosecution and one count of criminal practices. The case was assigned to Judge Thornton. The Tribe's Motion to Dismiss the entire Complaint was denied by Thornton. Today, the 3rd reversed that decision and dismissed the complaint.

Here is what Judge Luck had to say writing for the three judge panel:

“There are reasons to doubt the wisdom of perpetuating the doctrine” of
tribal immunity. Kiowa Tribe of Oklahoma v. Mfg. Techs., Inc., 523 U.S. 751,
758 (1998). It “can harm those who are unaware that they are dealing with a tribe,
who do not know of tribal immunity, or who have no choice in the matter, as in the
case of tort victims.” Id. No one knows this more than Guy Lewis and Michael
Tein. The Miccosukee Tribe of Indians of Florida, according to Lewis and Tein’s
complaint, spent five years filing false lawsuits, suborning perjury, and obstructing justice, in an effort to damage the attorneys’ finances, reputations, and law firm. Whatever its wisdom, tribal immunity endures, and Indian tribes are not subject to the civil jurisdiction of our courts absent a clear, explicit, and unmistakable waiver of tribal sovereign immunity or a congressional abrogation of that immunity. Because neither exception to tribal immunity has been established in this case, we reverse the trial court’s denial of the Miccosukee Tribe’s motion to dismiss.

I believe Paul won a 5 million dollar fee award previously, according to the Miami Herald. Wasn't that when Judge Cooke ordered Roman and Pepe Herrera disbarred?

Roberto Martinez and Curt Miner and Stephanie Casey of Colson Hicks Eidson in Coral Gables represented Lewis Tein in this case, according to the DBR.

5:51 a.m. get your facts straight, Judge Cooke did not order anyone disbarred. Roman was the only one in the case before Judge Cooke and only Roman was sanctioned by Judge Cooke, no one else.

Hey 8:50 am, smartypants, Roman was NOT the only one sanctioned by Judge Cooke. She also sanctioned his client, the miccosukee tribe.

You're correct that she didn't order The clown disbarred, but she did refer him to the Florida bar. They will do the honors and take his license.

Cowards are people like Bernie Roman and Jose "Pepe" Herrera who use their law licenses to commit fraud on the court by peddling lies and withholding evidence to ruin lives, like common street thug drug dealers.

The legal profession will be better and more honorable without them.

Rev, your use of the word "malign" implies that the things being said are untrue. These things are FACTS.

IN FACT, if that miscreant hadn't spent the past five years maligning others and abusing the legal system, going after innocent people, in furtherance of his own personal vendetta and the fattening of his wallet, he wouldn't now be on the brink of losing his license, and nobody would be talking about him.

He is reaping what he sowed.

The sad part is that he won't get nearly what he deserves. The criminal belongs in jail.

He is getting off easy. He got paid millions and didn't ever plan to have any other clients anyways. And what kind of idiot would be stupid enough to hire him? Only Colley, and that genius isn't getting elected again.

If they're dumb enough to elect one of his ilk though, the scumbag can go back to being a "legal advisor" and kissing tribal judges' asses all day. Nobody of course needs a license to practice law in that "court".

Why not ask Rene Caro and Nevin Shapiro for an opinion? Why not read the Bankruptcy filings in The Shapiro case or the filings in the Juan Rene Caro "La Bamba Check Cashing" case or ask Art Hernandez or AUSA Luis Fernandez for an opinion.
