RUSTY

 Some thoughts on the dismissal of charges against Alec Baldwin because of the discovery violations in the case. 

Overwhelming first thought: That would NOT happen here in Miami- but for perhaps one or two judges in the REGJB. And you know who they are. 

2- Broward would remove the judge from the bench who had the temerity to dismiss a case for a discovery violation. And then disbar them. And then prosecute them for obstruction of justice. Mike Satz lives on.

3- This was live ammo placed in a gun handed to Alec Baldwin after telling him the gun was "cold" not loaded. The prosecution knew this months before the trial- and did NOTHING. One prosecutor resigned after the case was dismissed. 

4. Remarkably, we have a similar situation here in Miami- land of the Chess- Game- Discovery-Responses ( (c)  Michael Von Zamft and Kathy Rundle, 2018, all rights reserved). And what is being done? Some hand wringing over how this is a big nothing and pablum that the Miami SAO is the most ethical office in the land.   If you believe that one, then Joe Biden can beat you at Wordle. 

5- Back to our DeSantis drones. Can you imagine the scenario? The same situation unfolds, the prosecution is caught (K to Q 2) withholding exculpatory evidence and our 30 something DeSantis Drone races off to chambers, sweat dripping from their brow, calling every judge friend they can find, begging for a way to make a decision that does not dismiss the case and place them in the crosshairs of being called a liberal defense oriented judge who has one set of rulings for celebrities and  who legislates from the bench thus jeopardizing what has otherwise been in their mind a sure- Federalist Society paved path to the Florida Supreme Court as every day they deny motions while gravely explaining that the legislature has not authorized such a decision and the resolution lies in enacting new laws and not expanding them from the bench. 

Is it any wonder that we jump at the chance to take a case out of Florida? We have one in Indiana for gosh sakes, and another in Oklahoma, and even there, we are treated better than at the crossroads of 12th street and 12th avenue.

Sandra Miller Baptiste and Isis Perez did worse on German Bosque,a horrible Opa Locka cop. They really needed to get his badge, calling him the worse cop in Florida history. (That was true). They had a tape recording that cleared him and kept it secret. 3rd DCA was pissed off. Isis retired and got a pension. Sandra is still at SAO.

After the MVZ mess, why is Steve M still there?

Similar situation in Miami Dade nah never. We have the most ethical prosecutors in America.

Wow, you are such a great lawyer that people hire you in Indiana and Oklahoma. Frankly, I think on these facts almost all of our criminal judges would have done the same thing.

I'm not a huge Alec Baldwin fan, but, even looking at a quick summary of the facts, he didn't deserve to be criminally prosecuted. Maybe the Judge realized this too and made sure the criminal case went away forever by dismissing it with prejudice.

Why is he still there? Hell, they haven’t even conceded that MVZ was dirty. Either they take it serious and start righting some wrongs by MVZ and his minions or they will be cleaning up his messes for YEARS to come. And many more than just Mitchell will be implicated. Numerous sitting judges.

Hello Rumpole. Long time reader of the blog. Several questions:


1) Did the Judge in New Mexico also have the option to dismiss the case without prejudice?


2) Is the law in Florida the same as in New Mexico? The judge has discretion in a case like this? For discovery violations, a judge in Florida can dismiss with or without prejudice? Also, is there a rule of criminal procedure in Florida that requires continuances, dismissals without prejudice, or dismissals with prejudice for discovery violations in criminal misdemeanor and felony cases? Or there is no such rule of criminal procedure and the law just leaves it to the discretion of judges? Thank you for any input.

Rump, I eagerly await your input on the Young Thug trial in Fulton County, GA. Between ex-parte meetings between the state and the judge, defense counsel thrown in jail for contempt, motion to recuse, and hilarious and uncooperative snitch with an utterly incompetent stand-in counsel, who acted like another prosecutor, it looks like another day at the Gerstein. P.S. Since MVZ moved to Georgia, maybe he was hired by Fani Willis?

Basic Con Law. Once a jury is sworn in, any dismissal is final and double jeapordy kicks in. No fan of Alec here, but ask yourself, if his name were not Alec Baldwin, would this case ever have been brought?

Sitting judges implicated? Do tell more please!!! That will not surprise many as he had multiple minions who are now judges. Two in particular that were his soldiers. Can’t wait to see that play out….

Rumpole, your blog has, seemingly permanently, departed from limiting itself to matters of or pertaining to events/people at the Gerstein building. No fun to read any more.
