UPDATE: THE CONE OF DEATH RETURNS
Judge Rosinek was back in the REGJB Friday presiding over his last Drug Court graduation as a Judge. It was by all accounts a wonderful afternoon in the big courtroom on the fourth floor. It is bittersweet to see someone who has done this community so good leave us, and yet his retirement is well deserved.

And we're sure the Captain will update us with details of a goodbye dinner to be held at the end of the month.

Why should we be voting for Obama:
"Obama was also asked who on the U.S. Supreme Court he would have never nominated. His reply: Clarence Thomas. "I don't think he was a strong enough jurist or a legal thinker at the time for that. I profoundly disagree with his interpretation [of the Constitution]," he said.
When asked the same question, McCain said he would have never nominated Justices Ginsberg, Breyer, Suter and Stevens.
"This nomination should be based on the critera on a proven record of strictly adhering to the Constitution and not legislating from the bench," McCain added.
The Arizona senator said he was "proud" of President Bush for nominating conservative justices Alito and Roberts to the court.

(chomp chomp) a tropical storm warning has been issued (smack chomp) I can't imagine the state is ready for trial.
Now that Judge Rosinek has retired, it is time to re-evaluate the entire philosophy behind drug court. The purpose of the criminal justice system is to determine who is guilty and then to impose an adequate punishment for the crime. It is not to be a glorified hospital/rehab center for people who are addicted to drugs but not necessarily criminals. Drug court may be a good idea in the abstract like AA is for alcoholics, but its existence is a testament to the stupidity of making simple cocaine possession a felony. If coke possession were a misdemeanor, would there be drug court? No. Everyone would plead out at arraignment and go home. We have drug court because it is unwise to treat these Defendants as criminals. Why not have booze court for DUI defendants? And I wonder what the recidivism rate is for drug court? Is it all just good PR with no results? Drug addicted coke heads are like the village drunk: pathetic people who should not be warehoused through the criminal justice system. Got an addiction problem? Deal with it on your own. But don't look to society to solve your problem for you.
This email came in: "I am graduating U of M law school next year and I am wondering what entry level positions the Q has available?"
And this was the response:
Dear Naive Law Student:
Please do your home work next time. The Q does not take applications. The extends offers. Most "entry level" positions are filled by non-equity partners from large law firms, or senior level assistant united states attorneys or above, or federal judges or state supreme court justices. Go to work for 15 years or so and distinguish yourself and maybe one day a letter bearing the return address "Q" will come to you.

The Miami Herald, the last daily newspaper standing in Miami, doesn't have enough fiber left to be call a rag. Migna appears back on their endorsement list with no explanation as to why she was mistakenly dropped. For those of you who think this is not relevant, consider, there is virtually no rntity left in the 4th estate to monitor crooked govt., onerous proposed legislation etc. For democracy to work, you need a strong media...and all we have is a lot of regurgitation of press releases from vested interests...with a few exceptions.
