GRATITUDE

 Because of our anti-Happy-Thanksgiving-rant earlier this week, we cannot send such felicitous thoughts at this time. But can take stock of all we are grateful for. Starting with the important and ending with the sublime. 

If you peruse our Great Jail Adventure post yesterday, it may become apparent that before heading out to the jail, we were actually in the Old Gray Lady (The REGJB) and went inside a courtroom for the bond hearing. We walked into several courtrooms and this is what we saw: Judges in Masks, PDs and ASAs (mostly maskless); clerks; corrections officers, bailiffs, and all of the people needed to run a court calendar and run a court system. We are grateful for all of you. In the face of a pandemic, you marched into court and kept the system running, at personal risk to your health and life. Thank You. And while we are at it- you twenty something prosecutors and PDs who feel the invincibility  of youth- you're not. Wear a mask please.  

Second, we are grateful for the opportunity to blog. We couldn't do it if this was Beijing. The equivalent of Chief Judge Soto and now Sayfie would have had us arrested and sent to a reeducation camp. Instead, because of the First Amendment, our chief judges, our administrative judges, our judges, endured the slings and arrows of the blog with public grace. True, we've been dressed down privately in scathing emails from a certain Judge - but it was mostly deserved  and we reached a detente. 

We are grateful for our health.  "Good health...the most important thing." (identify the movie quote for valuable prizes). 

About ten days ago we walked into a medical facility and got a booster shot. It took all of thirty minutes with a reservation, including observation time. We are grateful to live in a country that protects intellectual property rights and rewards innovation. This is why we had scientists who had the knowledge and skill to develop a vaccine. Want the Pfizer or Moderna or the one from Russia or China? Moderna please we said, and we got it (get the full dose BTW). 

We are grateful for Hulu TV which we discovered during the pandemic. If not for the NFL ticket, we would cut the cord on cable. 

We are grateful for our Kindle. We can read whatever we want where ever we are. If you like to read, get one. Trust us. You won't miss the feel of books and the ability to manipulate the font and lighting makes reading so much easier. 

We are grateful for our barista at our local Starbucks, who five days a week has our favourite drink ready for us when we walk in. Just the right amount of espresso and coconut milk and shots of vanilla and she even knows that on Friday, just to mix things up, we want it on ice. She was out sick one day and called a colleague to have our drink ready.  You don't see that attention to customers much these days.

In no particular order, we are grateful for home baked crusty bread, the coffee and croissants  at the Pierre in Manhattan that they bring to our room every morning, our Peloton,  the Bills getting beat last week, the series the Kominsky Method on Netflix- Alan Arkin is brilliant and the most underrated comedic actor of his generation, the Noability App on our iPad, which makes reading discovery a breeze, a certain recent opinion in the First, and last, but not least, a majority of our readers, who make writing the blog a fulfilling experience.

HAPPY THANKSGIVING


They began now to gather in the small harvest they had, and to fit up their houses and dwellings against winter, being all well recovered in health and strength and had all things in good plenty. For as some were thus employed in affairs abroad, others were exercised in fishing, about cod and bass and other fish, of which they took good store, of which every family had their portion. All the summer there was no want; and now began to come in store of fowl, as winter approached, of which this place did abound when they can be used (but afterward decreased by degrees). And besides waterfowl there was great store of wild turkeys, of which they took many, besides venison, etc. Besides, they had about a peck a meal a week to a person, or now since harvest, Indian corn to the proportion. THE MAYFLOWER COMPACT

On November 11, 1620, off the coast of Cape Cod, forty-one passengers of the Mayflower signed what is now known as the Mayflower Compact.  Some passengers of the Mayflower were fleeing religious persecution; others were adventurers and tradesmen looking for a new life in a new land. 

This was the first document, signed by individuals on these shores, that provided for the creation of a government, among the people, by the consent of the governed, to organize a society under "just and equal laws." A small and humble beginning to what eventually became a nation founded under the philosophy that all people are created equal, and that they have the inalienable right to life, liberty and the pursuit of happiness. The Compact states, inter alia: 

...do by these presents, solemnly and mutually, in the presence of God, and one another, covenant and combine ourselves together into a civil body politic; for our better ordering, and preservation and furtherance of the ends aforesaid; and by virtue hereof to enact, constitute, and frame, such just and equal laws, ordinances, acts, constitutions, and offices, from time to time, as shall be thought most meet and convenient for the general good of the colony; unto which we promise all due submission and obedience.

These people, who we now call Pilgrims, endured a difficult journey through the rough Atlantic ocean winter waters, and landed in an new land, where they faced deprivations, starvation, and attack by native Americans. 

Yet in the face of all these obstacles, they not only survived, they prospered, and their sons and daughters, and their grandsons and granddaughters, founded a nation that twice saved the world from tyranny; that  put a human being on the moon, and has always been the last, best hope for freedom and peace on this planet.

As we gather with family and friends and give thanks for our freedom and prosperity, let us spend a moment and remember it all began with a small group of people who risked their lives so that they would be free to worship as they pleased.

The holiday season has arrived once again in South Florida.  How do we know this?  Well, for one, the damn roads are more crowded than ever.  You can't find a parking space at a mall.  And the line at Joe's is getting longer and longer.  And Horace has gone into hibernation; likely at his winter home outside of Truckee, in the Sierra Nevadas.

One thing that never changes in the "Magic City".  The WEATHER.  While folks are already shoveling snow in the Midwest and Northeast, we topped out at 82 degrees today with a low of 68 tonight.  Sucks to live up North, doesn't it.

So, today's assignment for our loyal readers, is to post a Comment that tells us what your three wishes are, (assuming of course you manage to run into Christina Aguilera on a beach somewhere while looking for that Genie in a Bottle).  And be creative.  We don't want to hear "peace on earth" kind of wishes or "we wish that Bill and Hillary" would both go to jail wishes.  Get creative, be funny.

WHY WE DISLIKE THANKSGIVING

Facebook killer found guilty of second degree murder. 
The defense did an admirable job in the face of very difficult evidence. Second degree was probably the best they could expect. And in Florida's messed up (we wanted to use a curse work) criminal justice system, the defendant can be sentenced to the same sentence as first degree murder. Which means, while the law recognizes a difference in why people kill, Florida says lock them all away for life. 
Coming soon: life for manslaughter and culpable negligence. 

Things we don’t like about Thanksgiving.
An overload of emails from vendors promising 98% off that supply of hand sanitizer we’ve been putting off getting.
Pressure of the Holidays.

Emails from clients long past, lawyers we never see, all compelled to wish us a happy thanksgiving.
Ditto text messages.
“How was your Thanksgiving?
Lousy. That client we represented in 1998 for Petit Theft? He never wished us a happy holiday.
But your local counsel in Sarasota on that drugs case in 2003 did text.
True. But still…”

Almost the entire Washington Post this week has been devoted to three things: Thanksgiving recipes and how to carve the turkey, getting us in the holiday spirit…. And bombing Isis and Donald Trump. 
And that means less coverage than Trump than usual and that’s disappointing.

Monday in the REGJB sucks after court being closed for two straight says.
Some judges may work until 2.

We just got an email breathlessly announcing a sale on pens. And tide detergent. But only until six. Limit two per customer.

Certain obnoxious relatives who loudly announce “Can’t we try a thanksgiving with the TV off and no football?”

Every family has one. Move to China. Or France. Or Syria. No football or TV there. Otherwise shut-up and eat your vegan turfurky and look smug. 

Pass the gristle please.

Thanks: A heartwarming Broward story of Thanksgiving:
As a lawyer practicing mostly in Dade County, maybe you are wondering what you should give thanks for? Look no father than twenty seven miles north on I95 to the Broward County Courthouse. On the JAA Broward blog is the story of a lawyer who had an agreed order to allow his client to leave his home on house arrest to eat Thanksgiving dinner with his family and the judge who would not allow the five second hearing on her calendar before the holiday and the JA who would not return phone calls and who would not give the lawyer the name and number of the on duty emergency judge. 

The first thing that popped into our mind after reading this story was....if that's how they treat a local lawyer in Broward, then they really need to put up a sign at the front of the courthouse: "Abandon hope all ye from Miami who enter here."


All that glitters is not gold.....

And nominees for the Federal Bench of the Southern District of Florida should not be bold. 

Don't start measuring the drapes for your new chambers in that big glass building that looks sort of like an upside down boat if you're lucky enough to be nominated to the federal bench. Because even though Senator Harry Reid (D- Nevada) set off a nuke and removed the ability of senators to filibuster judicial nominations, the nomination must still be forwarded to the Senate Judiciary Committee for a vote. The actual piece of paper is a blue slip. And until a Senator such as say,  Marco Rubio (R- Tea Party Bizzaro World) releases the blue slip on the nominee, nothing happens. It's as effective as a filibuster and any senator can place a hold on any nominee, anonymously.  So all the that glitters is indeed not gold.

Feeding America: Before you spend all of next months salary on black Friday junk that commercials have convinced you that you cannot live without, go to Feeding America. Hunger is a problem right here in the supposedly wealthiest nation on earth. You can feed a family for three weeks for less than thirty bucks- we reset our Starbucks card for $50.00 at least once a month. Donate. You will feel good and it's a better way to give thanks than stuffing yourself on leftover turkey or pushing the old lady down in the aisle of Best Buy as you yank the last GT V video game out of her age spotted hands.

A BLACK MARK




So this is what Thanksgiving has come to: not giving thanks, but fighting with our neighbors to save a few bucks over some cheap item made in China. Disgusting.  The above video is from a Walmart in Georgia.

AU BON PAIN in our stomach: Speaking of black marks and disgusting, an alert reader sent us this link which gives the report on the health violations at Au Bon Pain which serves the REGJB community. It is NOT just a licensing fee issue. Apparently, the county is upset because the cockroaches found residing in the  troubled estaminet were not paying rent.  So far in our poll, the clear winner is bringing back The Pickle Barrel at 49% with keeping ABP at 33%. Nate Silver now puts the chances at a final vote surge for getting rid of ABP at 74.23% based on the release of the health report.

What Rumpole is reading: We're going to try and end on a good note. We took a break after the battle of Britain,  and put down for a moment William Manchester and Paul Reid's  Defender of the Realm to pick up Julian Barnes'  "A Sense of an Ending" : a powerful 163 page novel about  a man looking back on his life. The story is compelling and we read the book -cover to cover- on Friday while digesting our thoroughly vegan Thanksgiving day repast. 
From the NY Times book review: What had happened to the energetic boy he used to be, “book-hungry, sex-hungry, meritocratic, anarchistic,” who thought of himself as “being kept in some kind of holding pen, waiting to be released” into an engaged adult life of “passion and danger, ecstasy and despair”...The Sense of an Ending” is a short book, but not a slight one. In it Julian Barnes reveals crystalline truths that have taken a lifetime to harden. He has honed their edges, and polished them to a high gleam."
NB: The novel was recently espied on President Obama's desk in his study in the residence at the White House. For whatever that is worth. 

The weekend is just beginning. It's a nippy 20 where we are. Stay warm, stay out of Walmart et.al.,  stay out of Au Bon Pain, and enjoy the weekend and see you in court on Monday.

BLOG MAINTENANCE

NFL TURKEY DAY: One more time because we never learn: Cowboys at home +4 over Saints for 100 Turkeys.


UPDATE: Sometimes Judges do good things, and sometimes Governors elevate good Judges. Governor Charlie Crist has appointed Miami Circuit Judge Kevin Emas to the 3rd DCA and it is a great appointment. Congratulations Judge Emas, who takes the spot of Judge Cope. Well done.

"Here Kitty kitty" Update: What kind of animal would do that to a cat? Some kind of animal apparently and not a person, and that was good enough to put to an end the long and difficult case of Tyler Weinman who had previously been charged with being a serial cat killer. The Herald has the purrefect details here . Our hardworking State Attorney took time from a vacation to say this:
``They peeled back underneath the skin and found puncture wounds and that was the end of the case,'' Fernández Rundle said. ``This is a classic case of scientific evidence trumping a circumstantial case.''

Rumpole says: This is a classic case of the SAO once again filing charges first and sorting it all out later. Same old song, but with a different beat.... Kudos to David Macey for sticking with the case and believing his client.


A few house keeping matters this short holiday week.


A thank-you to the Captain for remembering our birthday last week. You know how it is, the older you get the less you like your birthdays. Just how many Heat seasons has it been since some cocky federal lawyer shot his mouth off to the press that before the end of basketball season our identity would be known? He thought he was dealing with an amateur.


As old as it is, creaky knees and all, the blog will be down for a spot of maintenance for a few days during the holiday season. Rest assured we will be ever vigilant in case one of our dear robed readers get caught doing something stupid. But otherwise it's time to change the oil and rotate the tires on this lorrie.

Worry not that we will over indulge and you will wake up one day soon with the blog's familiar colours and beloved polka dots changed, ala the unfortunate circumstances over at the blogs run by DOM and South Florida. We abhor change of any type. That will not occur.
And wasn't there some sort of coup de tat over at South Florida? Civil lawyers will do that-stab each other in the back for an extra buck.

Enjoy your holiday but watch what you eat. It was Ben Franklin who opined : "To lengthen thy days, lessen thy meals."

Speaking of eating, a tempest in a pizza box has erupted over the 112th Supreme Court Justice (Kagan) seen on a recent saturday night with a box of pizza (from DC Pizzeria "We the Pizza") and a pair of "mom jeans". Ouch. The controversy rages: "What size pizza box was the justice carrying?"; "Why is she getting her own pizza?"; "Were there leftovers?"; "Does Scalia eat pizza?" we need answers and we need them now.

HAPPY THANKSGIVING!!!!


Good morning. From 4 AM through 7 AM it was 59 degrees in Miami.

Then go here to Zo's Fund for life and help Miami Heat Star Alonzo Mourning raise $250,000.00 to Save Omar. Zo says there are about to million people in Miami. If 25,000 donate ten bucks, Omar gets the transplant he needs. Celebrate the holiday and take ten bucks from your Black Friday shopping fund (that's two large drinks at Starbucks) and help save Omar. 

Breaking Blog Thanksgiving Day News: The Federal Government says DONT WASH YOUR TURKEY BEFORE COOKING IT.  The title of the post links to the article. 
Based on our dealings with the government, we will be washing our turkey twice as much this year.  Remember, Rumpole says one of the three great lies in the world is: "I'm from the government and I'm here to help."  The second is "the check is in the mail." And the third has to do with an act not fit for discussion on a family blog.

Rumpole saves Thanksgiving:
The stuffing's stuffed; the mashed potatoes are mashed. The sweet potato pie is sweet. You have a house full of guests and turn to your husband and ask when the turkey will be done. He replies that he doesn't know, "when did you put 
it in?" You gasp!   You both forgot to cook the turkey!!!! Relax. Go here and watch this NY Times video. Roast turkey in 45 minutes. No kidding. It involves removing the backbone and flattening it out to give it more roasting area. It works. Take a gander. 



We're Thankful for:

1) Having a winning season with our football picks.

2) The FACDL List serve does such a good job keeping us updated on legal questions and issues.  

3) For the new Judges coming to the Justice Building. We have some cases in front of some of the Judges who are leaving, and lets just say.....whew!!!!

4) That we are still anonymous. 

5)  That not all our appellate panels have former Justice Building Judges on them.

6) That we don't have ANY cases North of the Border. 

7) Actually we're really really happy some Judges are leaving. Lets just leave it at that. May they go to civil and try and pull the same crap they did in the REGJB so that come election time they get multiple opponents. 


There are three NFL games this Thanksgiving Day and we have an unusual opinion on one of the them. Just four days ago the Philadelphia Eagles were manhandled by the Baltimore Ravens. Eagle QB Donovan was so bad he was pulled from the game. 

The Eagles are three point favorites over the high flying Arizona Cardinals.  It wasn't that long ago that Rumpole was being laughed out of the Association of Football Touts for declaring that the Seahawks were history and the division belonged to Arizona.  So why are the Eagles favored? A few reasons. Their not as bad as they appear. Arizona is not as good on the road as they appear. And when a line seems to beg you to take the one team, be a contrarian and take the other This game should be even based on the Eagle's performance a few days ago. It's worth 50 turkeys on the Eagles -3. 

Speaking of the Seahawks, they play Dallas in Texas. The line is cowpokes -14. The over/under is 47. No pick here but take the under if you must. 

The Titans, they of a one game losing streak go to Detroit for the Lions annual Thanksgiving day game. The Lions are 12 point home dogs. The over under is 44. Under 44 for 50.
