Gov. DeSantis Announces First of Three Supreme Court Justices .....

BREAKING NEWS .......

Governor Ron DeSantis today appointed BARBARA LAGOA to the Florida Supreme Court.  It is his first of three appointments to the open seats on the Court as the result of the retirement of Justices Pariente, Lewis, and Quince.

The announcement was made at the historic Freedom Tower in downtown Miami this morning.  Newly elected Attorney General Ashley Moody opened the event, followed by Lt. Governor Jeanette Nunez, who introduced the Governor.

Judge Logoa, 51, has been on the 3rd DCA for the past 12 years, authoring 470 opinions. She was appointed to the 3rd DCA by Governor Jeb Bush in 2006 becoming the first Cuban American woman  appointed to that Court. She was the Chief Judge of the 3rd DCA, having assumed that role just nine days ago.  She was born in Miami and grew up in Hialeah, graduated from  FIU (BA, 1989) and then Columbia Law School (JD, 1992).  Her husband, is attorney Paul Huck, Jr, and her father-in-law, Judge Paul Huck, is a Senior Judge on the Southern District of Florida. In 2003 she joined the United States Attorney's Office as an AUSA where she tried numerous criminal jury trials, including drug conspiracies and Hobbs Act violations. She also handled a significant number of appeals.  She spent three years three before becoming an appellant court judge.  Prior to her work as an AUSA she worked at Greenberg Traurig and Morgan, Lewis & Bockius, among other firms.

THE STATE OF THE 3RD .......

The Third District Court of Appeal has a total of ten judges. Last month Judges Leslie Rothenberg and Richard Suarez retired. They were replaced by Judges Eric Hendon and Bronwyn Miller.

Today, Judge Barbara Lagoa became a Florida Supreme Court Justice. She had just assumed the position of Chief Judge of the 3rd DCA. The JNC will soon begin the process of accepting applications and scheduling interviews so they can eventually send nominees to Gov. DeSantis.

Judge Vance Salter becomes the longest serving 3rd DCA Judge and he will likely assume the position of Chief Judge in the next few days. But Judge Salter, who turned 70 years old in 2018, is expected to retire in the not too distant future.

With Salters eventual retirement, Gov. DeSantis will get to name two new judges on the 3rd DCA, making four new judges out of ten, appointed in a short period of time.

Whenever Salter retires, next in line for the position of Chief Judge of the 3rd will be former County and Circuit Court Judge Kevin Emas. Emas has been a member of the 3rd since November of 2010.

The fact that Judge Lagoa has been named does not preclude the selection of Judge Luck for the Supreme Court

Oh boy, we finally get rid of Leslie and now Luck may stay. Luck is Leslie in a man's body. Luck never gave a single break to any defendant. Luck thinks cops are always right. It seems like the defense never wins at the 3rd DCA. Will they ever be fair again?

Speaking of Judges, we who labor at the Justice Building are losing to the civil division, without a doubt, the premiere Judge in Miami Dade County, Martin Zilber. I am sure I speak on behalf of all those who toil in the bowels of the Justice Building, when I say that Judge Zilber will be missed. He has left an indelible mark on those of us who have practiced before him with his quick wit, wry sense of humor, and poignant thoughts. His command of the law is beyond reproach. Let this be a warning to you, Judge Rebull: You have big shoes to fill. The civil division just got that much better, at our expense. Please come back soon Judge Zilber. We wish you well.

3:42: ingesting hallucinogenic drugs is bad for your health. Rebull is 10 times the judge Zilber could ever hope to be.

How about that, Paul Huck, Jr. got the weakest member of the appellate bench in the state a seat on the Florida Supreme Court. Of course we won't talk about the unethical conduct a few years ago which forced her off of an en banc motion, will we Alan Schwartz?
