YEAR IN REVIEW

It's never too late to look back at the last year. And especially for our intrepid prosecutors and their office, more than two months into 2018, they have published their 2017 year in review. "Better late than never" they often say about discovery and their Year-In-Review. It's perhaps the most anticipated document in the South Florida Legal Community, other than, of course, the yearly traffic citation stats, and the pedestrian flow analysis for the south end of Brickell Avenue.

So here it is, and pay particular attention to the crowing about the prosecution of former North Miami Beach Mayor Myron Rosner (husband of Judge Sarah Zabel) in the FRAUD section. 

The entire document cannot help but engender in our mind the wise words of the greatest man of the 20th Century- Winston Spencer Churchill: "In War, Resolution. In defeat, defiance. In Victory, Magnanimity. " Magnanimity doesn't appear in their dictionary. 

The Russians, so often in the news these days, have word for this type of document:  агитпроп,  which means Agitpróp

Multiple times a week you write thinly-veiled self-congratulatory posts but you begrudge the SAO their Year in Review? This entire blog is you attempting to show off your political, social, and historical knowledge (even though people only read this blog for the court gossip) and to over and again tell us how experienced and respected a defense attorney you are. And to constantly misrepresent prosecutors as dishonest, clueless, and unfair. As the saying goes, people in glass houses shouldn't throw stones.

In any event, I doubt even 10 percent of our office knows or cares that we turn out this pamphlet. Most of us just do our job as best we can regardless of any recognition. .

How about a defense rebuttal of the not guilty verdicts and the other blown cases by the SAO?

I rarely talk about how experienced and successful I am. But when I do I would rely on the aphorism that "it's not bragging if you can do it."

I challenge you to find one post this year- ONE- In which I have called the Dade ASAs "dishonest" "clueless" or "unfair". JUST FIND ONE and you can have a Burger King lunch on me.

The fact is that I think the Dade SAO has a tradition of being the finest and fairest prosecutor's office in the nation. Bar none. I do think that tradition has suffered under the current administration that is becoming more like Broward in their disregard for prosecutorial discretion. I especially dislike that the Dade SAO routinely abandons their judgment and discretion for that of a victim, who by their very nature is biased and traumatized by a criminal act. I have rarely seen a victim that doesn't want "the max". Although in some very publicized cases some victims have asked for mercy for the defendant.

So again, show me ONE post where I have called the Dade SAO the adjectives you have cited and your next whopper is on Rumpole. And let me know if I am in wrong in writing that the Dade SAO routinely abandons their legal view of a case and a professional opinion on what the punishment should be for that of the victim's desires.

10:03 is spot on, hot shot. I’d like to know where is the coverage of the Clinton Foundation meddling in the Russian elections. There is a word for that. Rumple just needs to google it.

And please don’t ever write OMG again. That’s for teenagers. You’re an older, single guy. Act age appropriate. Leave the acronyms for the Millenials

But rump, even apart from whether you have used the exact words "dishonest" "clueless" or "unfair", we don't have to go back to old posts to confirm you are taking pot shots at the SAO. READ YOUR POST AGAIN for god's sake.

Here is how I would summarize it: the idiots at SAO are so lazy it takes them until March to publish their year in review, as it's no better than Russian propaganda.

So while I'm not at the SAO, I can hardly fault 10:03 for his response.

And you cannot distinguish between criticism of the SAO administration which I openly disdain and line ASAs which I do not?
It is significant that I have never called prosecutors the names I was accused of. And calling that ridiculous year in review which is poorly written in places (see above) and was published in Mid-March- propaganda is a far cry from calling in court ASAs dishonest, clueless or unfair.
However, let me be more clear. The ASAs aren't dishonest. The young ones can be clueless, but then- weren't we all at that age? And I do think they are unfair when they ignore the facts of a case that scream out for mitigation and only offer a max sentence because that's what the victim wants. But the real responsibility for that policy begins at the top and the top of that office has abandoned the guts and fairness of prior administrations.

So there!

That Broward judge is a moron, but a pandering to the press moron. She is an embarrassment to the bar and to the judiciary.
