Martin Luther King, Jr.: I Have a Dream

I think what I take most from this speech every time I hear it, is the declaration that "I have a dream that my four little children will one day live in a nation where they will not be judged by the color of their skin but by the content of their character."

That sentence is the quintessential definition of the ideals of America and the American character as it should be and as it often (but not always) is.

We are defined by our greatness and our highest ideals and those who lead us there. It is why I am and always will be optimistic about this country.

This video is 11 minutes and 51 seconds. It's more than worth the investment of time.

See You in court tomorrow.

The dream is missing in action. We have affirmative action now so we can judge people by the color of their skin.

I disagree. We have affirmative action to rectify the injustices of the past. Whether or not the sins of the father should be visited upon the son is a discussion I would be happy to have. And indeed affirmative action is judging someone by the color of their skin albeit in a positive way. Careful readers know I do not approve of valuing anyone by anything other than their character, their intellect, their actions, and their values.

At best, affirmative action should be a limited program whose existence diminishes as generations are raised in a society that does not discriminate based on the color of a person's skin. What we do about systemic economic disenfranchisement is another question. But I'm busy working on a trial for this week, so my time is limited.

9:22: what an obnoxious email to send on a day intended to celebrate the life of a man who set the bar for humanity. Too bad for you that your bitterness keeps you from seeing the beauty in MLK's message.

I was in a park today with my family. I happened to see two girls, about 3 or 4 years old, walking along hand-in-hand, frolicking, playing, not for second noticing that they were different colors. On this day especially, it brought a tear to my eye. Every parent should sit their children down and play them the Dream speech; and if they'e old enough to understand "prophetic," play them Dr. King's last seech, made the night before he was killed. (Easy to find on YT.) Eerie, knowing what will happen.

Interesting fact. Martin had not prepared the I have a dream speech. He stated giving his prepared speech, and at some point, Mahalia Jackson called out, "Tell 'em about your dream!" He then launched into that impromptu dialouge that became known, rightfully so, as the greatest speech in the history of Western Civilization.

I am very uncomfortable about posting a comment in which someone asked whether a particular Judge would take a bribe. Its akin to linking a name to the question "when did you stop beating your wife?"

Outside of some proof this judge solicited a bribe, and I mean 100% iron clad proof, I cannot allow that comment to be published.

Character, now that's a word you don't often hear. A concept we should all be focusing on developing more of.

I'm getting on a plane here at Tamiami in a sec. If you find yourself in the State courts of our favourite federal blogger's law school state this week, come up and say hello and we can meet for some beans and chowdah after court.

Probation for Federal Drug Offenders?

The U.S. Sentencing Commission wants to let federal judges impose a sentence of probation for certain drug offenders if they participate in a substance abuse treatment program.

The proposed new guideline is one of several proposals that the commission recently published for public comment.

Now that's something worthy of public comment.

Undercover Sting Nets 22 Arrests in Large Scale FCPA Case

(The Foreign Corrupt Practices Act, for those that didn't know what those initials stood for. But, of course, if you didn't know that, then you don't belong in court representing anyone charged with the FCPA.)

Nearly two dozen corporate executives and employees were arrested Monday in Las Vegas and in Miami in the first large-scale foreign bribery investigation using undercover federal agents, the Justice Department announced today.
