ORGINAL INTENT

UPDATED: Just to let you dear readers know that we do not have a high opinion of our abilities, we are going to leave up our incorrect spelling of the state song, so as to give those readers in the comments section the glory they are entitled to.

Maybe the legislature can devote time and money to a "how to spell the river in our state song" program.

Very quietly there is a revolution going on North of the Border as more sitting judges have received opposition this year than any time in recent memory. We don’t know most of the Judges or candidates for that matter, but check out the Broward Blog for the latest happenings.

The Federal Blog had “gavel to gavel coverage” of the second hung jury in the Liberty Six trial. David Markus posited the question of how many juries unable to make a decision does it take for the Government to recognize that they do not possess proof beyond a reasonable doubt?

Just for the fun of it, and we will award a valuable prize, email us your predictions for the top ten picks in this Saturday’s NFL draft. We will post ours by next Friday.

Over on the Supreme Court Blog SCOTUS

they are examining the extent of appellate review for convictions on military trials at Guantanamo.
Here is our question: if the next president closes Guantanamo down, where do they send these guys? Do they just spread them out over the entire federal prison system?

The SCOTUS blog also has this little snippet:
On Monday, the Court is scheduled to hear argument in
Sprint Communications v. APCC Services (07-552), involving Article III standing in a dispute over pay phone fees...

Query: how did a “pay phone/Article III” dispute get past the “Original Intent” gang of Thomas, Scalia and Alito” and make it on to the docket? We mean, phones were free in 1796 right?

For those of you that care (and we don’t) Swanee River will remain the our State’s song. The Herald has all the details here on the new SWANEE RIVER
.
Apparently the Legislature is going to keep the song, but update the lyrics. Yup, now they’re writing songs instead of laws in Tallahassee, which if you think about the spread of minimum mandatory sentences lately, is not necessarily a bad thing.

Nice to know our elected politicians in Tallahassee are working on the serious problems. The cut in funds for stupid things like Emergency Room visits at Miami Children’s Hospital or home health care for the elderly. Those problems can wait until we resolve these song issues.

And word reaches us from the Sun Sentinel that a top trial lawyer in the West Palm Beach State Attorneys Office has resigned to go into private practice. Patrick McKamey resigned citing the effects on his office of the State wide budget cuts that are about to go into effect. But, those same lawmakers who passed the budget are re-writing Swanee River, so things can’t be so bad right?
SUN SENTINEL.

See You In Court...."Way down upon the Swanee River..."

The Captain Reports:

The clock is ticking on the 2008 legislative session. Only two weeks left and lots of work to do and many bills to vote on.

Most of the new bills related to crime have been stuck in committee. Budget shortages are effecting even these bills.

Sine Die is on May 2nd, coincidentally the same day as the deadline to file for judge.

Let's hope that they include enough money in the budget to keep the courthouse open.

Cap Out .....

Small nit: It's "Suwannee" or "Suwanee" River.

Now to a real issue. The cuts, both state and local, are real and severe. But the people are asleep. When the reality hits, when the effects are felt, their will be an awakening. That awakening will be ill-timed for a Republican led legislator facing re-election.

If it were not for world class fishing, diving, Disney, and our beautiful beaches, what exactly would separate Florida from our backward neighbors like alabama and Mississippi?

We are all run by intellectually challenged rednecks, are unable to balance our budget, rank very low in education and quality of social services, yet all the elected "bubbas" are always finding time to enact gun law and southern songs as official state anthems.

Pick up driving, no education having, three rotten tooth having products of incest have no place in florida government ( send them on a bus to Kentucky).

News is that numerous Judges will face opposition. Last minute filings as in 2006.

Rumpole censored my Bill Maher comment and link to petition.

Is the almighty one really a good friend of Bill?

There is a movement underway to secede from Florida and create the great new state of South Florida. We are also going to take Cuba as part of South Florida. More on that later.

There is no sense in denying what everyone already knows. Everything south of Palm Beach isn't really part of the Florida.

Since Broward is a cesspool anyway, Fort Lauderdale will serve as the state capital.

Don't forget that important piece of legislation banning the display of "truck nutz" that took up some more of the little time left. Nice to know what the priorities are.

Yes, and the "news' is that the sun will come up tomorrow. Good grief, 7:54 am, you're almost as well-informed as the Captain. Della Street

Please resubmit the Pope video link and I post it if you wish. I thought it was a joke at first and a link to something else.

Forward this video and link back to http://www.firebillmaher.com to friends and business owners — especially Catholics — via this hyperlink: http://blip.tv/file/832753.

Bill Maher slanderously attacked the pope and Catholics everywhere, and for that he MUST be fired!
- He lied when he called Pope Benedict XVI a “Nazi.”
- He lied about Pope Benedict coordinating a cover-up.

If Bill Maher had said these things about Jews, Muslims or African-Americans, he would have been fired that day!

Call your cable or satellite provider and CANCEL HBO until Maher is fired. Be sure to explain why you are cancelling. No "damage control" apology will suffice!

judge julio gonzalez in broward has opposition from some white guy who loves to run against latins up there. apparently he tried before against a latin judge and had to drop out when someone told him he had to be a memeber of the bar for at least 5 years.. judge gonzalez is an excellent judge there is no reasoning behind it other than he thinks he can win against a name like gonzalez.... shameful

Thank you 2:29. Any port in a storm I say.

One week before qualifying for judicial office is over.We have a few contested races, with some qualified incumbents facing opposition. We have some "wanna be's"having no opposition. Some are most definately not qualified.
If a qualified bench is what is desired, perhaps those qualified and desirous to do some publiuc service look into some of those open slots or some who have filed against qualified incumbent review their position and go into an open seat.
It is up to all of us,unless we truly do not care.

Let us not get too silly. Benedict was a German soldier under the Nazi regime. We call those people Nazis, correct?

This isn't the Captain, but I'll borrow a phrase:

BREAKING NEWS HERE

There's a request for extension on the trial in front of Judge Dava Tunis. See her motion to the Florida Supremes and an article here:

Captain out....

(Just kidding, not really Captain; isn't imitation supposed to be the greatest form of flattery Cap't? No hard feelings.)

1st verse
Way down upon de Swanee ribber,
Far, far away,
Dere's wha my heart is turning ebber,
Dere's wha de old folks stay.

All up and down de whole creation
Sadly I roam,
Still longing for de old plantation
And for de old folks at home.

Chorus
All de world am sad and dreary,
Ebry where I roam,
Oh! darkies how my heart grows weary,
Far from de old folks at home.

This song is seen by some as showing racism about black Americans for its imitation of Black English Vernacular (the song is sung from the perspective of a black man), with its original lyrics referring to "darkies" and "a-longin' for the old plantation." At many public performances, words like "lordy," "mama," "darling," "brothers" or "dear ones" are often used in place of "darkies."

I cannot tell you the name of the lawyer who will be filing in the open seat with Migna Llorens Sanchez.

I will tell you that he has over 30 years experience in good standing with the Florida bar. He has countless reported cases on the books and is one of the few honest men left in the Bar.

I will break the news the day before he files.

Dear 8:10 p.m. "Anonymous"...
I am so glad you will break the news but how will we know it is you, as there seem to be a lot of posters named "anonymous" here. They may steal your glory! At least I use my real name. Best, Della Street
P.S. Let's ditch Stephen Foster for:
"I want to wake up in the morning where the orange blossoms grow...
Where the sun comes peeping into where I'm sleeping...and the song birds say hello!"
