ROCK A ROBIN

You knew this would happen.
A defense attorney has filed a motion for a new trial because a juror tweeted- not necessarily about the trial, but about the whole REGJB/juror experience. From the view to the food, to the spotty Judge Stan Blake memorial WIFI, we got trashed.

The juror: Cocaine Cowboys filmaker Billy Corbin.
The Judge: Jose Fernandez.
The Defense Attorney: Sara Yousef.
The Herald story by Ovalle- here.
And somehow, because he can't just stick to his side of the city, federal blogger DOM is mixed up in all of this.

WHO'S  RESPONSIBLE?

For this mess?
Monday morning REGJB 9:15 am.

The NFL draft is this week. Want to be depressed?
The Fins passed on Aaron Rogers in 2005 and Matt Ryan in 2008 and we all remember they decided not to sign Drew Brees as a free agent, opting instead to let 82 year old George Blanda have another shot. Or something like that.

Dumbest program ever.

Who would participate in this? Just flush them down any toilet. No questions asked there either.

But I have the motivation figured out.

The depository is in the police lobby, but they have a drug sniffing dog outside the door. I expect a tremendous rise in narcotics arrests.

Arthur Speigel!! Come on down!!

You join John Rodriguez at the douchebag table for running against a more-than-well-qualified, well-liked, hard-working judge.

You, Sir, are an embarrassment.

Not for nothing, but who would leave Billy Corben on a jury in the first place?

Im not sure that any candidate has to explain why he/she runs against any sitting judge.

Was there an uproar for Wolfson-Ricker to explain why she submitted her name to the JNC? Of course not.

Here's anyone's top two reasons for running for elected office:
1. Because they feel like it.
2. Because they can.

That being said, I feel that Wolfson-Ricker would make a better judge than Spiegel, so I'll vote for her. No big deal.

Well that did not take long. Look at the applicants for the 3rd DCA seat. There he is, less than 16 months a judge and asking or a promotion. The Honorable, wants to be Chief Judge of the 3rd DCA, Milton Hirsch.

Yeah Milt. You are definitely Scott's kind of guy, especially after that ruling on the drug statutes. You just killed a tree for no reason whatsoever.

Just be happy you are where you are.

Judicial elections should be open and should attract the best and the brightest legal talent. Incumbants should be challenged.

However, when a well-respected incumbant whose retention is sought by both the state and defense bar is facing opposition, the challengers have an obligation to explain to the public why they chose to challenge that particular judge.

Andrea Wolfson is a pleasure to practice in front of. She is everything you can ask for in a county court judge. With a few more years experience, I think she would make a fine addition to circuit court.

If she is facing opposition, I would personally like to know why she should be replaced? There are plenty of county court judges who are rude, lazy, and ignorant. Wolfson is a public official and is subject to opposition, but I don't think Rumpole is out of line in asking her challengers to explain themselves.

With all the complaints Hirsch has had against him (most recently this past Christmas), I can't believe he now wants a seat on the 3rd DCA!

leon firtel has balls. u gota respect him

Anonymous said...

Firtel is a great judge. He is fair, strong on the law, and tough when he needs to be. Too bad he has moved to back up.

He made the right decision today but an unpopular one. However, a judge cannot be swayed by how many signatures you can get on a petition or how many people you can bring to court. The law is the law. If the defendant is guilty of killing a 13 year old while drunk and fleeing the scene, he should get all the prison time in the world. But he is entitled to bond for those offenses.

Anonymous said...

It's not a question of balls. It's a judge doing his job and following the law.

Here is Firtel's quote as reported by The Herald:

“I have heard you, via the press both TV and print,” Firtel said. “But this is not a popularity contest based on the numbers of people you can turn out to court ... In this courtroom, we follow the law.”

Judge Firtel has always done what is right. That is why he is one of the better judges at the MJB.

Anonymous said...

I too really like going to Andrea Wolfson's court and I will vote for her and will ask everyone I know to vote for her.

Anonymous said...

Lots of talk about bonds lately.

Bottom line, if I were Zimmerman I would have been out of the country before the new prosecutor even had a chance to file charges. Let them try to extradite me from Bolivia.

And if I were charged with a DUI manslaughter where it appeared that I was very guilty, and entire community were calling for my head, if I made bail, I would cut that thing off my ankle and make a run for it. Again, Bolivia may suck, but it can't be as bad as prison.

I don't know if that makes me a pussy for running, but bad enough I did something to get arrested, I can't bankrupt my family to have them try to save my life.

By the way, I am not fluent in Spanish. Anyone have any other suggestions for countries with no extradition with the US?

Mr. Justice Hirsch is the most qualfied. He was a proscuter for years, a defense attorney in private practice so he knows more than a career prosecutor who would not know how to sign a paycheck for his employees. and he has civil experience by virtue of being sued by his landlord and others. What more could one ask for?

DS said...

Stop the complaining about people you dont support running against someone you think is better qualified. That is the System we have agreed to live by.

If you like a Judge, do more than vote for the Judge. Get out and help them. Donate, especially those of you in the private Bar. Your actions matter now.

Dont complain come January. Participate .

We have all agreed to a Constitution and to live by the laws. WE know the system is imperfect. Do not complain , change the world .

I have seen campaigns , worked in them since 1970. What matters is you.
If Your Judge Could say something to you about the campaign it would be:
Participate and Donate.

Judge Jose Rodriguez -- the guy who throws the little sacks up in the air, like Captain Queeg? Then looks at himself in the mirror that faces the witnesses?

I will settle for Milt's huge ego over a neurotic with a very short attention span -- like someone with ADHD !

Mr. Chief Justice-Designate Milton Hirsch said...

I have been advised by those who know me to gain some appellate experience on the bench before taking my seat as Chief Justice of the United States Supreme Court. Do not forget that I became Chief Justice-Designate shortly after my gglorious ascencion to Circuit Court.

Hirsch was sued by his landlord for non- payment of rent. Who skips out on rent? Then, as a Judge, he refused to help an attorney on Christmas Eve (he was the assigned judge that night) – a letter of complaint was sent to the Chief Judge. The list of complaints for attorney and judicial misconduct could go on and on. He should NEVER be allowed a seat on the 3rd DCA – they don’t need any more controversy.

10:26 am, I suppose that "gglorious" with double "g" is not a typo but that it was written that way for emphasis.

Is there an accurrate published list of who applied for the third?????

I gave at the office said...

I just dropped donations into the coffers of BOTH Judges Teretha Thomas and Andrea Wolfson. They have my full support.

Artie Bugsy)Spiegel and John "Mr. Personality" Rodriguez are douchebags.***

Anyone know why Chip Walls from the DUI lab was fired?

Anonymous said...

5:23............Chip wasn't fired, he resigned. Check your sources.

Anonymous said...

Was it a resign or else?

Anonymous said...

I've heard the Family Bar hates Jose Rodriguez.

Anonymous said...

Chip quit on Monday after a long drawn out pissing match with his supervisor. And he worked for the toxicology lab. WTF is a DUI lab?

George Frobisher said...

Actually, Bolivia is a lovely country.

George-

Thanks for putting my mind at ease. Going to start learning a little more Spanish, just in case.

Anonymous said...

Judge Rodriguez is fine. Sometimes he has no patience, especially when he was covering dockets for two other judges, but otherwise, he was an excellent judge to appear before.

By the way, those in the Family Bar that don't like him are those who probably bill their clients by the word.

Anonymous said...

Both Judges Hirsch and Gayles have my full support in their aspirations to the Third DCA. Ego aside*, Judge Hirsch is one of the brightest minds in our legal community.

* Let's be honest. In large part, ego is what motivates most judges to ascend to the bench. At least with Milt, he's got substance to back the ego, unlike a number of our other circuit court judges, whose egos are surpassed only by their vapidity.
