TALLY HO

TOMORROW: "SIGNS, SIGNS, EVERYWHERE A SIGN..."
UPDATE: A retired Judge writes in on the Ties that bind, below.

The Mail Online, one of the UK rag sheets has picked up the story of the case of the "pictures in the potty"
here.

The Broweird SAO has announced that they will be prosecuting the snap-happy traffic mag since the SAO does not handle measly traffic infractions.

What we didn't know about Derek Jeter getting his 3,000th hit was that he was the first Yankee to reach that milestone.

We'd like to pick a day soon and have a TIE-OUT where all male lawyers in court in the REGJB (who are not in trial or in motions) don't wear a tie. Judges can opt in as well if they want.
Who's in? When?

Rumpole - I agree on the tie issue in the summertime. For those who are old enough, Judge Howie "the mouse" Gross always wore a guayabera shirt with no tie. Judge Jose Rodriguez never wears a tie. Attorney Michael Kaufman runs courtroom to courtroom and never wears a tie. I always came in on a Friday during the summer and would never wear a tie (although I wore a robe and zipped it closed). I would never have faulted a hard working attorney, who was not picking a jury, for coming into my courtroom in a casual manner - so long as they did not treat the everyday proceedings in an informal manner or without respect. My advice, just do it. I would be shocked if any of my colleagues would say anything. If they do, I will come out of retirement to vigorously defend you!

Alcee's in hot water again as he's being sued for sexual harassment by a staff member of the Helsinki Commission (what do they do?). For those of you who studied for the Bar in a Starbucks, Representative Alcee Hastings was a Federal Judge in our district until he was Impeached!

It feels like it's going to be a long hot summer.

I like to treat my hearings in an informal and disrespectful manner. That's why I wear a tie. Seems to allow me to get away with it.

If I have to take the daily courtroom to courtroom grind seriously because I am not dressed appropriately, the trade off is not worth it.

kaufman is a taxi cab attorney. he does not know what case he is defending. I tried a case with him and he was rarely in my court. he gave a five minute closing argument that had nothing to do with my case. I was only acting as local counsel to an out of state attorney. Imagine how i tried to explain this to him. Kaufman and his taxi got hammered.He is the SY Gaer of the civil side.

This tie/jacket thing has been discussed over the years and evokes strong feelings. If you have respect for the court system and think it is serious business to be conducted by serious people, then wear a nice suit, shirt, and tie. And shine your shoes. I don't care what anyone says to the contrary, any judge, client, or opposing lawyer will look at you with more respect if you are dressed properly. Otherwise, why not just show up in a pair of shorts, flip flops, and a tee shirt dripping with ketchup stains? I can remember a time when male jurors showed up always dressed formally. And stop the "hot weather" justification. Wearing a tie and jacket in an air conditioned building after driving in an air conditioned car is not exactly combat duty.

If it's Sunday....It's ANGRY GURL (and also Meet the Press, but that's way too intelligent a show for most of you creeps who read this blog)

I just ate a cracker that said "Seven Grains" on it. Who cares? Why is seven grains better than six? And should I be looking for 8 grains?

Ties? Get off your high horse. You don't want to wear a tie? Don't wear a tie. 95% of the attorneys (male and female) dress like they didn't open their eyes until half way to court. Just buy nice clothes and dress with class and you will not get any trouble from most judges (In State Court that is.)

That movie with Tom Hanks and Julia Roberts is stupid swill. Some guy took me to see it and when he said afterwards he liked it I dropped him like a hot potato.


There's got to be more to that story about the traffic magistrate in Broward.

So now its 6-7 weeks of labor until Labor day when everyone can celebrate the end of the summer by stuffing their face with hot dogs and hamburgers and swilling beer.

Until then keep those billable hours up.

Check the posting outside Judge L. Schwartz chambers. NO TIES OR JACKETS during the hot summer months June, July, August September UNLESS lawyers are in trial. He had the same procedure while in the criminal division and for the last three years while in Civil.

Angry Gurl- we should get together......

I live downtown. I am 30. I believe in taking care of myself, and a balanced diet and a rigorous exercise routine. In the morning, if my face is a little puffy, I'll put on an ice pack while doing my stomach crunches. I can do a thousand now. After I remove the ice pack, I use a deep pore cleanser lotion. In the shower, I use a water activated gel cleanser. Then a honey almond body scrub. And on the face, an exfoliating gel scrub. Then apply an herb mint facial mask, which I leave on for 10 minutes while I prepare the rest of my routine. I always use an aftershave lotion with little or no alcohol, because alcohol dries your face out and makes you look older. Then moisturizer, then an anti-aging eye balm followed by a final moisturizing protective lotion. There is an idea of me, some kind of abstraction, but there is no real me. Only an entity, something illusory. And though I can hide my cold gaze, and you can shake my hand and feel flesh gripping yours and maybe you can even sense our life styles are probably comparable, I simply am not there.

Louis Jepeway is Right. I have always hated that motto in court. It has NOTHING to do with the Juries duty of deiding if the State proved its case in court beyond a reasonable doubt.

Do you really think that juries make mistakes because there is a wooden sign stating that the litigants are seeking truth? If that persuades anyone, the lawyering would have to be awful.

Holy Cow! Stay in the PD's office and hope that you can retire after 30 years in fairytale land.


By the way, as much as I respect Jepeway - when was the last time a jury announced a Not Guilty in his cases? Can you think of why?

How many times have YOU heard ASAs argue the 11th Circuits Motto about ' We who labor here'. It shouldnt be up in the courtrooms to make that argument. It is a Motto not the law. If We take phones from jurors we shouldnt put something up that isnt an instruction and is misleading. It aint right and it aint true. Louis is Right.

Thanks for the article. Everyone should read it. Whether or not you agree with the verdict, it is the jury's verdict. The public is crucifying these people who were only doing their civic duty. If we cannot respect the verdict of a jury, then we have lost our justice system.

I would hate to see a Casey Anthony backlash, where jurors in high-profile (or even low-profile) cases are afraid to find somebody not guilty if the evidence supports such a verdict due to possible reprocussions.
