CALLED OUT

FRIDAY UPDATE: DOM reports that Bob Scola's nomination to the Southern District was unanimously approved by voice vote by the Senate judiciary committee. That prompted Southern District Chief Judge Fred Moreno to send a letter to Senators Reid and McConnell imploring them have the full senate act on the nominations of Kathy Williams (currently the nominee waiting the longest for a vote) and Scola, of whom Moreno writes "litigants are eagerly awaiting" his appointment.

And all along we thought judicial shopping was disapproved of.


It's not enough that Federal prosecutors lose their job and get bar complaints when they tangle with him in trial, now everyones favourite federal defender has CALLED OUT Assistant Attorney General Lanny Breuer over remarks Breuer made at the recent National District Attorneys Association Summer Conference (Motto:
"Convict em all- let the innocence project sort em out." )

In any event, I challenge Mr. Breuer to a debate on the subject of prosecutorial and defense ethics. Just for starters, I would ask Mr. Breuer why DOJ is opposing a change to Rule 16 (as suggested by the ABA and on July 7, by NACDL) requiring what their guidelines merely suggest.


Sunday morning traffic accident=Wednesday Mourning Lawsuit.
The Herald reports Spencer Aronfeld has filed suit against Alonzo Mourning Wednesday for the traffic accident on Sunday. (Hat tip South Florida Lawyers).
Obviously things are slow on the civil side.


Alex On Track:

The Herald reports that as the murder trial of one Coral Gables Highschool student accused of killing a fellow student began, Alex Michaels was up to his old tricks:

The trial, expected to last about two weeks, should provide plenty of drama and legal theatrics -- Rodriguez’s lead lawyer, Alexander Michaels, is known for his combative, aggressive style and on Tuesday he and Circuit Judge Dava Tunis exchanged loud, sharp words over legal objections.

Go Alex Go.
(A defense fund for Mr. Michaels will be set up shortly.)

TERRIBLE action by Spencer Aronfeld. That is such self promotion and there was no need for a news conference. This action gives all lawyers a black eye and he should be ashamed of himself for ambulance chasing. It is obvious the "victim" has zero injury as a result of Alonso Mourning's driving!

Alex is not the biggest asshole in the REG. Not even close. I think he just believes that in defense of his client, nothing is over the line. It is not everyone's style, but if your are a defendant, it is probably a good feeling to know your attorney is willing to wind up in the cell next to you, if it comes to that.

I know we all live by the mantra that at the end of the day, make sure it is only your client who goes to jail. My guess is that Alex does not buy bananas in bunches, for fear that he may not be home for a few days.

The problem with Aronfeld is that he took the opportunity of filing a case, which he has clearly had no time to research, on the weekend of the Summer Groove, solely to capitalize on Zo's good name.

No one is giving Zo a pass. But it appears that at worst, he may have left the scene of an accident which he did not cause, and did not result in any injuries.

At any rate, if someone can go to the civil courthouse and copy the complaint and post it, it may make for fun reading- as fiction of course.

But my estimation is this story disappears within a week. It just isn't interesting. Story has no legs.

3:18.......either you're Aronfeld or clueless. Anyone who's handled any civil cases knows that this isn't how you handle them no matter who the defendant is.

Aronfeld did what he did PRECISELY because the defendant is Mourning. This lawsuit is all about Spencer.

hey 3:18pm - tell us JUST ONE $1 MILLION + verdict or settlement Spencer Aronfeld has obtained in all these years? NONE. He takes high profile cases where either there is a default or a defendant with zero insurance. He just likes to see his name in the press. Compare it to Stuart Grossman or Scott Leeds and their websites with unlimited numbers of huge results.

--- and who really cares when our economy is headed for Armageddon and default.

PS: sell your stocks on Monday at 9:35am (right after I sell mine at 9:30am)

Go Alex!! We love you!! Fighting for your client is what it is supposed to be about, THE CLIENT; however, some attorneys are what we call dumptrucks. Back your client up and dump him out and at a pretty price, I might add.

It's not about the attorneys who HAVE to wait in the hot line. Please just change your diapers if they scratch you!! It's about the client. Do you get it!!

Took a spin out to two dudes cigar shope ( formerly Shumie's Cigar Emporium of Texarkana, Decatur, Waco, Brussels, Estonia and of course Milan). Had a great smooth Robusto and took 3 home to smoke in the lines outside the courthouse this week, Service was A plus although I 'd suggest a babe at the register and not the big guy. So B- on atmosphere but a great inventory. It is worth the trip.

I trust you all followed the DBR's coverage last week when Judge Bagley called several attorney on a conflict of interest and booted him out of a case.

Not sure if Bagley is up for election in 2012, but if he is, look for Hector's sock puppet -- a very well funded sock puppet -- to be sent after him.

I think we can start calling this "Newmaning" a judge.

My favorite part is when he gets quoted in the paper talking about how it's all for the good of the bench and por arriba la raza. Personal revenge and power diddling? Heavens no.

Do me a favor, as Judges go, there is no comparing a Newman to a Bagley. Newman needs to go. He continues to disrespect the people who appear before him, both pro se litigants and attorneys. Bagley is the exact opposite, and the fact that no one has filed against him since 1996 is a testament to same.

Bagley is a good judge who should be a great judge. He just needs to loosen up a bit and listen more (sometimes he makes decisions on partial information, which leads to unnecessary mistakes). I'd still put him in the top 25%.
