SAME OLD SONG BUT WITH A DIFFERENT BEAT....

We'll post a last word about the PDs office later in the week.

Lets see....the SAO passed on prosecuting the AUSA Sean Cronin for hopping into a local bar's pool in his skivies. No surprise there.

Tomorrow (Thursday) is the Bench-n-Bar mixer at "Delores but you can call me Chief Judge Brown" next to Brickell Village. No word on whether the Chief will show. Trust us, skip it.

Our favourite federal blogger beat us to the punch and has the video of Delaware senate candidate Christine O'Donnell (Salem, Wicken) not knowing that the concept of the separation of church and state is in the first amendment.

There's a nasty email floating around re: The bar complaint about judge elect Milt Hirsch, and his counsel, and their efforts to beat back the bar complaint without a hearing. Blog worthy?

Same Old Song, but a different beat: Broward lawyers are up in arms and this time it is the PD filing boatloads of motions to recuse on lame...err lame duck Judge Lee Seidman (he was beaten in his attempt to run for a circuit seat while on the county court.) You can check it out on the Broward blog.

Trivia: We can think of two judges in the last 25 years who ran for circuit court from the county bench. Can you name them and where are they today? Hint- the one who won later went to prison.

Kind of busy, so that's all for now. See You In Court (actually we're in court, and loving the wi-fi).

I saw the email re Hirsch as well and I didn't think it was nasty at all. I for one believe Hirsch told Casey to flee and the bar should investigate. I think it was wrong for Tannebaum to try to hide his emails. What is he afraid of?

okay. here's my two cents for today. I was all set to go out and vote early. I planned on going Thursday morning. Last night, I was watching a debate between the three candidates for the senate. Normally, I turn that off because my mind is already made up that I'm voting for Charlie Crist -- that is until I heard him talk about ObamaCare. When did he pick up that little tidbit? I mean, I was floored and now I'm more confused than ever. I can't vote for a man who says whatever is going to get him a cheap vote, I can't vote for Kendrick Meek because I don't think he qualifies, and Rubio -- well, I just can't do it. This is the sad state of young voters' minds these days, which is why I'm just going to stay home and not vote. I JUST CAN'T DO IT. Next time, give me some real choices, not those puppets........

I believe one would be Al Sepe. When you throw in a qualifier like judge and prison, it kind of narrows the choices. Sepe was cut from the same mold as Art Snyder and Ellen Morphonios, for better and worse. The only difference now is that he is alive and they are not.

My guess, and I am not 100% certain, is that it was Roy T Gelber (be careful what you ask for in life, you may get it) who won, and went on to take bribes and go to federal prison; and Loriee Feiler, who lost to Victoria Platzer.

The point about the separation of church and state was by design, it was her poor communication I guess, her idea seems to have been that the freedom of religion clause has been taken too far. That is my understanding of what she attempted to say. At least that is a theory that I have heard and I believe is true

Rump:

A County Judge who runs for Circuit while a sitting Judge and loses, does not gain retired status. Judge Feiler recognized that all resigned from the County bench and then ran for Circuit Court. When she lost the election, she was still able to sit as a retired Judge.

So, technically, Feiler was not a County Judge running for Circuit. Seidman, on the other hand, did not resign and now he will not be able to serve as a retired Judge.

David ran for county court and then I believe was promoted to circuit. As for Feiller, you are wrong captain crunch. The rule was amended after to feiler to prevent people like her from losing elections and then then still working as a retired judge.

you all believe ASA Rifkin is a contender lawyer. Ask what she's been doing on her recent Death cases. Her trial team focus's the cause. She takes a total backseat to her trial partner and isn't half the lawyer.

Hirsch told someone to flee and Tannebaum concealed emails? Huh? What? It seems everything these guys names are mentioned it has something to do with some shady legal wrangling. Do any of these "big wigs" actually try cases? Say what you all want about Alex Michaels, but at least he goes to court and tries a case every know and then.

Pam Bondi is not a credible candidate. She has refused to engage in any meaningful debates with her opponent, she has no statewide political office experience, she is the Republican candidate only because she was endorsed by Sarah Palin, she is twice-divorced and does not deserve your consideration.

Just read the complaint against Milton Hirsch. Very nasty stuff indeed. The only problem with discussing it in this forum is that neither M. Hirsch nor Tannenbaum will respond, nor should they.

I don't know either party, but maybe a bit of professional courtesy should be extended to M. Hirsch until the grievance is resolved. After that..................

I received the Tannebaum email and was astonished at the Professional manner in which the details of the event were presented by a "client.". I think the entire situation stinks and reeks back of door deals and intimidation. From sealed audio tapes to consealed secret emails, the entire event should be reopened and the tapes released. Then the bar complaints should be handled by a bar counsel outside Dade cnty. This is why Lawyers hate the Bar and why everyone else hates lawyers. Post the email so everyone will know and judge for themselves.

Captain, I hate to correct you, but Loree did not resign to run. Her term was expiring. The Supremes said that she and others like her can not serve as a Senior Judge. This was after she sat Senior for several years. You forgot about Scott Silverman who ran for Circuit from County.

Loree let her term run out in county court adn she ran for circuit court and lost. Back then, even with a loss, she was allowed to sit as a retired judge.

A few years later, the legislature made up that statute that said that if you get the boot in a judicial election from any spot, you are out and cannot work as a retired judge. No exceptions.


When that happened, Loree was told that she could not longer work as a judge.

That asshole Lee Jay Seidman in Broward is out in January.... just like Flora Seff. They cannot be a judge unless reelected or appointed and Flora did not even get out of committee this time.

They should both be poster children for bad judgment from the bench.

In mid January,we can finally tell both of them what we really think. Kinda like what many of us did years ago when Ana Maria Carnesoltas was booted. It was fun telling her what kind of a jerk she was when she was a judge.

By the way,Loree was a nightmare on the bench but, as a retired judge she was not so bad. Go figure!

I will always accept corrections from you, my friend. So, basically, she did not file to run for re-election to her County Court seat and she therefore, retired. She ran for Circuit and lost. She was permitted, for several years, to sit as a Senior Judge, bases on her retired status from County.

Then, did they subsequently change the rule? Or interpret it differently? Was this statutory? A bit confused on that part?

The Supremes said that if you resign your seat and then run and lose you can not sit as a Senior Judge. It is up to the Court to certify the Judge. The interesting question becomes, what happens to those cases Loree presided over and adjudicated. Did she have jurisdiction? If my client was HTO'd on one of her cases, I would do some research.. Just saying! If I knew who you were Captain, I would say the same thing my friend!

Loree Feiler was a fine judge. She could be loud, but she listened to good legal arguments, followed the law and made sound legal and commonsensical rulings. I wish she would run again.

Loree Feiler was an excellent judge with a troubling temperment (I got along with her very well, but didn't like how she treated some of the other lawyers). That said, I'd vote for her against 90% of the folks on the bench today. We could use her common sense and intelligence.

Jerry "The Hawk" Hubbart won county, was appointed mid term to sit "Circuit" (though stil officially in County) in Sepe's Division due to Hawk's criminal experience as a PD, ASA and private practitioner then successfully ran for Circuit Court in 1992 where he has been ever since.
