THE CAPTAIN REPORTS:
ELECTION UPDATE .....
It's Part Five of our weekly series breaking down the contested judicial elections in Miami-Dade County. In Week One, we focused on the only contested County Court race of Lindsay v. Lesperance. Since then, we have provided you with the Circuit Court races of Cueto v. Velis; Migna v. Manny and Colodny v. Kopco v. Millan. As we reported on May 2, 2008 on this blog, there are nine contested races here in Miami-Dade County; eight in the Circuit Court and one in the County Court.
Today, we discuss Group 38 of the Circuit Court. Our goal will be to attempt to provide you with a weekly contest overview and then let you have at it and give us your opinions on why we should or should not vote for a certain candidate.
Group 38 is presently occupied by the retiring Judge Leonard Glick. Vying to replace him are Mario Garcia and Stacy Glick (yes, she is related to the sitting Judge Glick).
DR. MARIO GARCIA .....
Mario Garcia has been a member of The Florida Bar for 8 years. He graduated from UM Law School and joined the State Attorneys office working there for three years. He is in private practice and handles criminal defense, real estate, immigration, and family law cases.
Mr. Garcia has kept himself very busy. He is also a US Army Captain, a Licensed Mental Health Counselor, and a Certified Addictions Prevention Professional. Garcia earned his doctorate in 2004 from Capella University in the field of Psychology. Capella is an online educational institution. The "Dr." in Garcia is as a result of that online degree.
Garcia filed to run in February of 2007 and has reported raising $14,800 from 71 contributors.
You can read all about Mario on his web site at mariogarcia.net.
STACY GLICK ....
Ms. Glick is a lifelong member of the Miami-Dade County State Attorney's Office. She obtained her law degree from St. Thomas University and has been a member of The Florida Bar for 9 years.
While Stacy may be the daughter of Judge Leonard Glick, she has made a name for herself at the GJB and has obtained a wealth of experience in the trial court over the last 9 years in virtually every division of the SAO. Her last position there was as a supervising attorney.
Ms. Glick has been impressive in the fundraising area since her filing in June of 2007. Since then she has reported raising $47,100 from, get this, 299 supporters. Also, she has kicked in $100,000 of her own money toward the campaign.
Check out Stacy at glickforjudge.com.
Please do your homework on the two candidates. Help out our readers by giving us your comments, pro and con, on each of the candidates.
The election takes place on Tuesday, August 26, 2008.
CAPTAIN OUT .........
When you see something that is not right, not fair, find a way to get in the way and cause trouble. Congressman John Lewis

The Miami-Dade Public Defender's Office began refusing to represent certain poor defendants Tuesday because of state budget cuts.
Public Defender Bennett Brummer said his office cannot ethically accept more cases than his attorneys have time to adequately handle. Broward Public Defender Howard Finkelstein has said he is considering a similar move.
Brummer has refused to take cases three times over the past 32 years because of insufficient resources. The courts have consistently sided with him, ruling that a defendant's right to a lawyer means a lawyer who can provide adequate representation.
Brummer is withdrawing from felony cases that do not involve first-degree murder or the rape of a child and is considering pulling out of misdemeanor cases.
A hearing on the issue is scheduled for Friday. The Miami-Dade state attorney's office plans to oppose the motion, arguing a state law prohibits Brummer from withdrawing from cases because of his caseload.
Mario and Manny related? Is Mario his dad?
http://www.youtube.com/watch?v=GR9gtyTF1dk&feature=related
Watch the Mario Garcia 3 minute youtube campaign video. As with Manny the video shows that both may be retards.
Over 10,000 lawyers in Miami and we get Manny and Mario.
Good job as always El Capitan.
Deciding who to vote for in this race is difficult. Both of them are exceptionally qualified and are exceptional people.
This one is a no-brainer. Glick is an easy choice.
In our continuing effort to update the english language, as well as to bring back certain words before they fall completely out of use, today we bring (back) the word "swell".
"We had a swell time at the Federal PD conference last week."; "Judge Markus does a swell job on the 11th circuit."; "Judge Barzee would make a swell federal judge."
Swell- try it today, you just may like it.
glick = compassion.
Rev. MARIO GARCIA, J.D., N.C.P., C.A.P.P., L.C.P.C, DAPA
Is this guy just trying to add another title to his name? First he is Dr., then he is Rev. and what are all the acronyms (alleged degrees)about? google him, he's the jack of all trades, master of none.
ps. His video on youtube tells the voters to vote for him September 2008. Dude, the election is in August!!
Barzee a federal judge. She is clueless on civil matters. Of course, with 2 law clerks to do your work maybe being a federal judge is a swell idea after all.
Mario is a very nice guy and a good candidate. He carries himself very well and is a charismatic person once you hear him speak. Stacey is also a good candidate and a good person. She has been a very hard working prosecutor and is more than qualified. It is hard to decide.
Can someone with a mechanical or engineering background or with previous experience in a department store or any building outside the Justice Building please advise what a reasonable time period is to fix an escalator?
New contest: Can you idetify the Judge in the "photos" section of the following website:
www.riczweig.com
Haven't had a case against either one, but Glick is HOT! HOT! HOT!
She gets my vote.
Why is Mario targeting a Jewish Women, with so much experience and support was he positioning himself to lose again? Who is helping him make these terrible decision?
GO STACY love working with you..
Captain, wasn’t Mario involved in some legal issue regarding some vendors he scammed. If i am correct there is an open case on this can you look into this and let us know. Also do we know the reason Stacy is running is just because it is her Dad’s Seat? I am still open on who to support but would like some answers on this.
What is scary is that Dr. Mario received his undergraduate degree from Regents. That is the University the Pat Robertson founded.
It would be swell if you learned how to spell 11th Circuit Judge Marcus.
@fake matters and adelstein
Swell is a swell word. And when you mention Judge Barzee, I can think of at least one thing that swells.
Gotta love those chicks with the librarian glasses.
I stood in line for an elevator and watched my feet swell. Fake Anonymous
I have just had the privilege of entering Manny Seggarra's web site at http://mannysegarra.com/index.php
I haven't laughed so hard in ages. The guy can't spit out one coherant sentence. If you want to laugh today, please visit. One note, the woman in the video is his girlfriend, not his wife as someone had posted earlier in the week. She is an ASA.
Ms. Glick, while having years of experience w/the state attorney's office, has yet to learn that your word and your credibility is what matters most! And lacking both, is not ready to be a judge.
I can not verify this, but rumor has it that Mario is a right wing christian fundamentalit quack
Look, the bottom line is: as long as BIG DUH is not elected, the Dade bench retains credibility.
The idea that Stacy Glick lent her campaign "$100,000 of her own money" makes my head SWELL.
Is that a proper use of "swell?"
Are judgeships in Dade County hereditary?
The Glicks seem to think so.
Judge Barzee would indeed make a swell federal judge. Indeed, I believe things in her federal courtroom would go quite swimmingly.
So, 8:10, does swell mean educational, arch-conservative, or adorable?
I'm sorry, but this PD crying is crap. I have a few very close friends who are PD's, and they are almost always out the door at 4:00pm. Try calling over there to speak to most of them after 4:30...gone. Not to mention that they have about 1/3 of the ammount of cases as their ASA counterparts and they only show up to court one week out of the month!
I watched the segarra videos, and all I can say is... holy Bobcat Goldwaith!
Any Shumie updates? He's a SWELL guy.
I think fake matters and adelstein should have a 'word of the day" column.
re..12:05p.m.
I think you're right about Garcia. Check out the pending civil case 06-7931 (Amencer Investment v. Amencer Christian Network). Garcia was just mentioned in a very recent Emergency Motion for an Injunction written & filed by 2 associates of Holland & Knight whereby it's alleged that Garcia purchased a Christian radio station at FAR below market value from a Judgment Debtor so as to help the Debtor avoid paying it's debt (the original subject of the case) to the Judgment Creditor. And Garcia allegedly formed "Garcia Communications, Inc." to purchase this radio station, not only after the judgment had been entered against the judgment debtor, but even later... the very day AFTER the Judgment creditor filed its Affidavit of Non-Payment with the Court. Sounds EXTREMELY shady to me.
Don't know, but at worst it seems like fraud, and at best, some seriously questionable ethical decisions on Garcia's behalf.
Garcia a Judge? Yeah right!
For a real laugh, Google Capella University...
and Mario claims to be a "Certified Addictions Prevention Professional," which happens to be a NON-EXISTENT certification in Florida. Know what you are, Mario.
And Ms. Glick, come back when you've lived. "Toys for Tots" ain't gonna cut it.
Mr. and Mrs. Voter, to your left, rock, to your right, hard place. This is like choosing between Vlad the Impaler and Attila the Hun.
Heaven help anyone who comes before the eventual winner.
Due to court order I rarely venture away from this blog but our dear friend has a very interesting post on school board attorney:
http://southfloridalawyers.blogspot.com/2008/06/school-board-attorney-thinks-her-home.html
well if she were a civil judge at least you all whiny defense attorneys couldnt say all teh judges are pro-government. ausa's heads would explode if she did her public defender on the bench routine where she rules against the gov in trial to force her desired result.
it would really be a slap in the face to many great judges if she became fed judge
OMG
That Ric Zweig (Margolius) website is
swell.
Looks like Ric is having mucho bien tiempo con las chicas en Panama. He must have told them he is Barrri Mannilo.
mary barzee would be fantastic as a federal judge!!!
i don't know ms. glick nor her opponet. however, it strikes me as quit odd that her opponnet took an on-line unaccreditted course to be call a "doctor". that is not lawyer like. he seems like a kook. Ms. Glick probably has good qualities acquired from her father, who I have known and respected since he was an asa. her law school, st. thomas bothers me as one would think she has the brains to get into a respected law school. the trialmaster believes that ms glick is the better choice. Again, living ur whole professional life in the mjb does not give one the life experience to be a good judge. the trialmaster endorses Ms. Glick over her opponnett.
10:04 FYI
The Florida Certification Board provides certification for substance abuse counselors, prevention specialists, criminal justice professionals, mental health professionals, and behavioral health technicians in Florida.

I guess it is a certification!
Questions: Hmm... What does the law indicate are the requirements for having a Miami-Dade Public Defender appointed? Does anybody verify that the info written down on the Application for the Services of the Public Defender is nothing but a pack of lies from defendants who got caught with their hands in the cookie jar but don't want to have to pay the retainer to hire an attorney? Why do judges constantly make a blanket appointment of PDs at bond hearings? How would the private attorneys like it if they got assigned cases on a whim?
so nice to have a forum where people talk so much shit!
Who gives a fuck what "the Trialmaster" thinks? He probably hasn't tried anything more serious than a speeding ticket in more than a decade.
The trialmaster obviously did not win the spellingbee in High School. Perhaps it was a residential program?
Do you really believe we ought to vote for someone based upon a claim to be the rightful heir of the throne? Hum.......Let's think about this. NOT!
There is an old addage " If everyone lights just one little candle, what a bright world this would be". In regards to Ms. Glick's lack of experience in the "real world" I say it's not how much you do but the quality of the things you do. You can very quietly help a young girl who is having a tough time (not job related) in school, you can help at your place of worship, you can volunteer for the diabetic street drives, you can collect money for muscular dystrophy, you can volunteer in fundraisers for breast cancer. These are thing that most people do silently. From what I calculate, being an Assistant State Attorney, as Ms. Glick has been, most respectfully for almost 10 years, with the long hours she has devoted to all her cases, even into the weekends, I calculate that she has been volunteering her talents as an attorney for 10 years.
For those of you that believe Ms. Glick thinks the bench is inherited, why don't you stop and look at two things. 1) That she has been campaigning (extremely hard) for the last year, not sitting around waiting for her "inheritance." 2) Ms. Glick could have done it the easy way and had her dad file the papers in Tally (acting as if he was going for one more term) and really filing her papers at the last minute. She would have slid right into his seat. Also, prior to becomming an ASA she founded and operated a small business. Do your homework! She works her butt off at the SAO and has tons of trials under her belt. If working at the SAO isn't helping the community, I would love to hear what those criticizing her have done (volunteer work) in your off time.
She has my vote!!
Trialmaster, for someone who calls himself that, you sure do not even sound like an attorney. Go back to school and learn how to spell, after that, maybe you could go to college, get a law degree, try a few cases and maybe someone will give a $hit what you think or whom you endorse.
3:50 a.m.
So now we equate volunteerism with "real-life?"
Recognize the difference between 'sympathy' and 'empathy' and, for that matter, padding one's resume.
Glick is going to win this race. Want to know how I know that?
Because Garcia & his supporters will be home SLEEPING on election day b/c they THINK the election is in September (instead of the correct date of Aug. 26) Just watch Garcia's YouTube video and he'll tell you so. What a MORON!
go Glick!
To think a person would be attacked/criticized for wanting to "add" another credential to his name. (ie. Mr Garcia) If someone has put in time to something and earned it what is the problem with that? Did you go to Stanford and Yale to criticize others? Grow up.
