HECKLE THE CHIEF JUDGE TONIGHT

Tonight. One night only. Those crazy and wild lawyers at the 11th Circuit Historical society are doing it again with a wild Symposium in which Chief Judge Joe Farina and former Chief Judge Gerald Wetherington will appear together in a reunion rivaling the Beatles reunion in historical significance and pure entertainment.

The Symposium is entitled Reflections on Justice” and the Chief Judges will discuss the direction the Justice System has taken in the last 30-40 years and where we can expect it to go.

WHERE: Miami Historical Museum 101 West Flagler Street

WHEN: 6:00 PM Thursday evening.

Be there or be square.

And don’t pass up the chance to heckle Judge Farina on those long lines this past Tuesday at the Justice Building.

ELECTION UPDATE:

With the appointment of Judge Sarduy to the Circuit Court, that opens up the GROUP 34 seat in County Court. Judge Sarduy was originally running for reelection to that seat.

If the Governor appoints someone to that seat, then they will serve until the 2010 election.

NORTH OF THE BORDER ......

In the never ending saga of the tales of the Broward County Judiciary, they're at it again.

This time, Judge Mark Gold is being accused of acting in "one of the most arrogant, discourteous, unprofessional and lacking of judicial temperament behavior" that attorney Kathleen Achille had ever seen a judge display.

It seems that Ms. Achille was in the middle of a jury trial, in fact, doing her closing argument, when she was scheduled to be in front of Judge Gold for a sentencing. Ms. Achille was informed that they were waiting for her and she did personally call the prosecutor and had the judge that she was in front of call Judge Gold's court to let them know that as soon as she finished her closing and they charged the jury, that she would be available to get to Judge Gold's courtroom.

Now she is sorry that she showed up to Judge Gold's court. And now she is considering filing a JQC Complaint. The Broward Blog has all the juicy details.

It is pathetic how many of you bitch and moan about the judges. You complain when they don't make a decision and when they do you complain about the decision they make. You complain when things they have no control over (construction, holidays, etc) get in your way and when they have a degree of control over it (setting calendars) you complain they use it too much. Grow up. If you don't like the decision they make then appeal it. If you don't like them, get over it. Unless you have the balls to run yourself, shut the f*ck up.

I wish I were under 33.

I am a pretty good attorney, even if I am the one writing it.

I practice before judges who should be ashamed to show up every day. They are rude, nasty, and thoughtless -- probably all to cover up for the fact that I am just one of the many attorneys who argues before them + is obviously much brighter than they will ever become.

No shame in that, just do not treat us as though we were the stupid step-chidren.

You may be on the bench because of the amount of money you have to run for election, the voting appeal of your last name, your 'special' relationship with the Governor or his party -- or any combination of the above-listed factors.

None of those makes you brighter, more caring, or a better tactician than we - the trial warriors. Treat us with the respect we are due. We will try to forget how you got on the bench, and then treat you with equal respect.

emphasis on the word "constantly". we all face the occasional asshole but I can count on one hand the number who I felt were totally unfit either from a temper standpoint, respect for the schedule and challenges of lawyers in private practice, or just plain a lack of experience and knowledge of the law. one of those judges I only appeared before for a couple of pleas. so I reiterate, if you are constantly bitching about most of the judges the problem is probably you not them. most new judges are appointed, go thru the jqc and beat out a dozen qualified people. yes they may not be the best but few idiots slip thru the process. someone who does 100 trials as a pd or asa is not an idiot because maybe they are not roy black. the flaw in the jqc appointment system is if you are in recovery, ever been arrested, divorced, sued etc. you have virtually NO chance of being appointed which is unfortunate. there are many fine attorneys who are recovering addicts and alcoholics for example, including at least one at the sao, but no governor has the balls to give one a chance.

Damn you're naive. If you really think these judges are good, you haven't been around for long or must not know the law. Today's bench isn't close to what it was 15 or even 10 years ago.

The Judges on the bench in the 11th Circuit & the 3rd DCA will rule automatically for th BIG firms. Once in a blue moon you get one who is actually impartial or even knows the law and the Fl Constitution. I would take the Judges from the 70's anyday! They had integrity and didn't rubberstamp everything, in fact, getting a summary judgment was almost impossible! Today they are handed out like candy.
