Thank you for your fair treatment of Ostriches. We at the SDL (Struthian Defense League) vigorously monitor the media and social media (Twitter, Face Book, Head In Sand) for any anti-Ostrich messages. We closely monitored and reviewed the order of Mr. Justice Milton Hirsch and while we decided against lodging a formal complaint, we did send him a very vigorous email warning him of comparing the innocent ostrich to police officer malfeasance whatever the argot used.
Hirsch stands warned- millions of Ostrich lovers (and voters) will be watching his orders.

In Spanish, "ostrich" is "avestruz", promounced "ah-veh-struth", which means literally a "struth bird" (whatever "struth" means, but it is properly used in Chief Justice Hirsch proto-order granting the motion to suppress to refer to the ostrich/avestruz animal). The improper reference comes from the use of an adjective referring to this bird to signify a bird that buries its head in the sand when fact is that ostriches/avestruces don't do such a thing.

US News and World Report just released its rankings of US law schools. No suprise at the top as Yale Law takes top honors. Followed, of course, by the usual suspects of Hah-vad, Stanford, Columbia, NYU, U Chicago, etc.
While those ultra-top schools will usually change spots every now and again, there is usually no movement amongst the Top 14 schools. Also known as the "T14," these schools rarely drop out and it is very tough to get into the top 14.
Except for this year. You see, down there at #14 was Milt's alma mater, Georgetown Law. But with a slight drop by Georgetown and a slight rise by another school, THERE IS A TIE FOR #14. The newest member of the T14 is............ The University of Texas.
Therefore, Milt will not tolerate any school where bull riding is a core course to be compared to his beloved Georgetown. As such, Milt is going all out with his prose until US News gives sole possession of #14 back to Georgetown. His theory is that Georgetown must be superior to Texas if a Texas Law grad must consult a dictionary, thesauras and a Magic 8 Ball to comprehend his rulings.

Theft by false pretenses? Um, if that were now an arrestable crime, the jails would swell. That goes on every day, it's called business and corporate transactions.
There's a distinction between fraud in the inducement, and fraud in the performance. Fraud in the inducement, is actually something the law recognizes. If you can prove someone lied at the outset to get the money and run, you might actually have a case.
But more often than not the cases end up being fraud in the performance. People don't deliver what they promise. Things go wrong. People don't get around to keeping their end of the bargain. Even if they do, suddenly the amount of money needed has increased in the interim and they won't continue to do more work until another payment is made.
They call that a civil matter, if even that.
Then what about the bribery charge?
Considering no one was recorded on audio or video engaging in the bribe, it was a circumstantial case.
Funny thing about circumstantial cases is that if someone puts forth a reasonable unrebutted hypothesis of innocence, you get JOA'd.
So what was unreasonable about a solicitation authorized by law? Sure, sure, you tell me that the def violated some other statute, that says it's bad to solicit money and don't follow thru on your promise. Again more performance crap.

To start with he lied to witnesses in order to gain their cooperation and get certain statements from them. Had they known the true facts their statements would have been different. For example, he got Codina's statement based on lies, then ran to the grand jury and got MSJ indicted the NEXT DAY. He aslo lied to Barbara Carey Shuler to gt her cooperation on the other case. When attorneys got involved and began investigating what really happened, Scruggs threatened THEM with prosecution. BAD, bad, bad.
Then we go to court. He took a major SHIT when he found out that the trial judge would be RR, not YC who he had just investigated. YC is very young, inexperienced judge, just coming off of her own problems. RR is a very experienced trial judge who knows the law, is rarely reversed by the 3rd DCA, and does not put up with bullshit. She runs her own courtroom her way and does not allow the SAO to take over, ever.
What's are a couple of ethically challenged ASA's to do when faced with a case with no evidence which is truly a political lynching of a black woman?? Why, get rid of the judge, of course. NO legal grounds to do so?? No problem. They'll just make it up. It requires sworn affidavits. No problem for a couple of ethically challenged ASA's like Scruggs and his side-kick Christine Zahralban. Just make it up. what's a little perjury by a couple of ASA's when you're lynching a black woman?! So, the motion to recuse is filed. Attached are affidavits from Scruggs and ZAhralban. Can u say PERJURY??? That's exactly what they did, and the trial had not started.
At trial, the state fumbles aroud, is disorganized and generally wastes a lot of the jury's time. Exhibits went missing. They were alwlays found on state's table. The exhibits only went missing when it was time for Raben to cross examine. Exhibits walked away from the courtroom and ended up at the SAO. The judge had to get involved and issue an order to counsel to return all exhibits to the clerk when finished questioning a witness.
6:39 must be writing from Death Row or something. Not only is Gail Levine one of the best prosecutors in the office, but she has NO history of discipline.
So where is the record of these alleged complaints? And, why should we care considering that, if they indeed existed, she's been cleared every time.

BTDT - I am an attorney and I know what I am talking about. She is one of the most unethical prosecutors in the office and I am not the only attorney that feels this way.

I happened up on the appeals floor of the PD's office when Howard came back from a hearing about a late court reporter transcript.
He was gloating. This is someone who probably sits on his fat ass watching TV all weekend and drinking while court reporters are working every day and every evening and every evening.
And this is not even to mention all the free transcripts we had to produce when JJ and her firm of XXX refused to relinquish payment authority so we could bill under a different firm.
In a way I'm glad we aren't as busy now as it helps with the turn-around of transcripts and some of the reporters who really are late can improve their writing and produce transcripts without untranslates in them.
There's a special place for Howard and JJ and you can imagine where it is.
You want to bring down Gladys because, while attending a religious ceremony, she answered a question from a religion reporter, in which she said religion matters to her?
Sure. That's a fine idea. I noticed CJ Moreno there. Seeking to impeach him, too.
I'm not a Catholic, but if they want to get together and have a mass, how does that hurt you? Most people have some sort of religious faith -- most judges, too.
And good luck running a campaign against Gladys, who is a fine judge and -- not for nothing -- about as connected as you can get.

Blumberg is a good Appeals Atty. He knows his stuff and always has an answer on complicted questions when us pit lawyers ask. His salary aint outragous for 25 to 30 years of hard work, so lay off.
