JUDICIAL ELECTIONS

Nice DBR article on the different election problems Florida Judges face from County to County.

For instance, North of the Border, if you run against an incumbent judge and win, the Judges in power respond by assigning you the weekend bond hearings for the first 5 1/2 out of six years of your first term, with the remainder of the time spent being required to read "The collected wit and wisdom of Dale Ross." (Pompous Publishing, 2007.)

Jack Thompson: more fun with pleadings:

This from a recent filing with the Florida Supreme Court:

"Mr. Chaykin, who is presently serving the best interests of the citizens of Florida, is the one who demands permanent disbarment for Thompson. Mr. Chaykin is has publicly branded anyone who does not agree with him on gay adoption (Thompson does not) an “enemy of The Bar” and “outside the core values of our Bar.” This is terrific. The Bar has a paranoid on its Board of Governors who actively seeks retribution against his “enemies” with enhanced punishment because they aren’t square pegs that fit into his pro-gay hole.

Thompson should like to propose a deal to this Court, since this is obviously how this Court operates: Thompson will change his party affiliate to “Democrat,” pronounce his fondness for gay adoption and the gay lifestyle, have sex with 16-year-old prostitutes, have forced sex with his female clients, launder money for the Medellin cocaine cartel to benefit Roy Black, confine his criticisms, like the aforementioned Roy Black, to Florida judges on national television rather than in Thompson’s letters to those judges, represent the porn-to-kids industry rather than attack it, stalk a former employee, as did Thompson Bar complainant Tom Tew, commit perjury like Larry Kellogg and Al Cardenas to try to nail an anti-obscenity crusader, and last, but not least, exhibit the Spitzer-eclipsing hubris of one of you sitting on the Supreme Court and announce that we need to round up lawyers with bad manners and suspend them, the United States Constitution notwithstanding.

If Thompson does all of that, will you, this Honorable Court, give me a “get out of jail free and get out of disbarment free” card? Apparently one has to be a pervert to catch a break from this Court and its “official arm,” The Floriduh Bar."

Rumpole notes: no one can ever accuse Mr. Thompson of backing down in the face of adversity.

My mother taught me to 'mind my own business." I think JT needs to learn that too. Why can his problems never be about himself? Why does he always need to mention other people? Classic psychology study: those who put others down do it to try and raise their own low self-esteem.

George Bush; not much evidence of sexual indiscretion but felony and dui arrests before assuming office. war criminal, admits that Iraq did nothing to us on 9/11, attacks Iraq, occupies their country , kills thousands of their people, 4000 american service men and women killed, over 15000 seriously injured, economy in shambles, record deficits, national debt at 10 trillion, borrowing money from china to finance war, more people in jail than any country on earth, 500 billion dollars a year spent on the military, no policy about the now daily handgun murders on college campuses in this cou8ntry. The article was pretty much the same thing that has been bantered about in the halls of the REG bldg for years. Nothing too revealing.

However, the portion on Judge Gonzalez in Broward is what Dade lawyers should be concerned with.

Judge Gonzalez is a great judge and brings some Miami-Dade type reality to the otherwise insane Broward bench. For those that don't remember him, he was a Dade ASA and Dade private defense atty, so he knows how to resolve a case fairly. If I had to compare him to a Dade judge, he's probably like Reemberto Diaz or Stan Blake. And the bench could always use another
Stan Blake or Reemberto Diaz, particularly in Broward. And he is a quick riser and will likely be on the circuit bench, assuming he holds his seat.

Am I stumping for him? Yes. But I'd rather send my $$$$ to make a dent in the good ol boy Broward bench than worry about the Dade judges, which are always more easy to deal with. Wouldnt we all want to take a few more Broward cases if we could?

Rumpole, here's one more reason why we have such big lines and delays to enter the building:

The building manger is now requiring that all persons who come through the front entrance of the REGJB remove their belts and put them through the X-ray machine, even if the metal detector doesn't beep. That also includes attorneys. (Attorneys don't have to remove their belts if they use the back entrance).

This is driving the screeners crazy because it means extra work for them for no reason and for which they don't receive extra pay, the lines at the checkpoints get clocked as people who didn't beep have to go back to put their belts into the X-ray machine, plus they catch grief from attorneys who find it unreasonable to have to remove a belt that hasn't even set off the metal detector.

Please, Rumpole, publicize this, maybe contact Glenna Millberg, or Judge Blake or whoever so that someone can have a talk with the building manager and instill some sense of reason into her.

Why would Satz prosecute a teacher when the video shows him being held in a full nelson by one student, then when he breaks free another student punches him in the head?? Both guys were bigger than the teacher.

I'm surprised that no one has commented on Martinez-Scanziani's comments. The article states:

“It’s not that I chose an opponent. I chose a group that was up for re-election,” Martinez-Scanziani said. “It’s demeaning to both Judge Hendon and myself to make this a race issue.”

[SHE CHOSE A GROUP, NOT A JUDGE? I GUESS IT'S JUST ONE OF THOSE RANDOM COINCIDENCES THAT THE JUDGE HAPPENS TO BE HENDON.......PLEASE. I'LL TELL YO WHAT'S DEMEANING.........SHE THINKS PEOPLE ARE STUPID ENOUGH TO BUY THAT CRAP]

These sentiments have been echoed by other candidates challenging incumbents in Miami.

Martinez-Scanziani said she has a great deal of respect for Judge Hendon, even though she doesn’t know him well. She said she decided to run because it would be “good to have a fresh face on the bench.” [WOW, AND I WAS NAIVE ENOUGH TO THINK THAT PEOPLE RUN FOR OFFICE BECAUSE THEY THINK THEY CAN DO A BETTER JOB THAN THE INCUMBENT. SILLY ME. NOT HER. SHE HAS A GREAT DEAL OF RESPECT FOR HENDON BUT THINKS A "FRESH FACE" ON THE BENCH WOULD BE GOOD. SCARY. As a supporter of Obama until a few days ago let me tell you how he fell from grace and lost his bid for president and Clinton will not have his as a VP.

The unfair attack on Geraldine Ferraro was the last straw. When I was a young man I campaigned for Geraldine Ferraro for VP. The democrats of the USA took offense when the amatures running his campaign who have attacked anyone who is supporting Clinton as a racist. Those amatures lost my support with the unfair and outrageous attack of Geraldine. If Obama thought it ok to attack the first woman VP candidate a icon of the democrats for 2 decades. How stupid can a campaign be to attack the hand the feeds you. Obama has now lost all chance for the VP slot and may lose his senate seat.

Both in Dade and Broward, there are a lot of dumb police officers who make bad arrests. The difference though is that in Dade, the SAO is intelligent enough to get rid of the stupid cases via nolle prosses. In Broward, on the other hand, the theory is "let the jury decide." (Read the article on the Broward blog for 3/14 re: Joseph Brazer). Why is Dade so much more reasonable than Broward? Is it because Michael Satz gives prosecutors no discretion and because his own discretion is always used unreasonably?

Jack does claim to still represent the plaintiffs in the Alabama case before Judge Moore. Although, because his pro hac vice admission was revoked, I'd imagine he can't be billing much time for courtroom appearances or legal filings.

As for backing off in in the face of adversary, you know by now that Jack's transmission ain't got no reverse gear, rump. C'mon.

I hear tell there's this new-fangled, computer thingabob called LexisNexis that'll let someone search most any court's docket in the country for the attorney of record in cases on those dockets. Go-ahh-lee!! Back in my day, we'd a had to sit in a litigator's office and review their files 'fore we could figure out if they had any clients or much of a practice. Ya'll young'uns sure 'nuff got it easy nowadays.

I too thought it was silly to go back and remove my belt after passing the metal detector without a beep. I had thought the guards were discriminating again me. I am glad to hear that it is not only me who has had to go back and remove his belt after entering. This policy of going back to remove your belt after not beeping is silly. The guards must have misunderstood their instructions. (This is only a problem after the attorney’s line is closed)

This belt thing ought to prove my point. The purpose of courthouse security is not security, it is designed to demonstrate to the population that they are slaves living in a police state.

What is the threat? Obviously, firearms. What do they search for? Nailclippers and files. Why do they really make us go though security to keep a judge from getting nailclipped to death? No, it is a symbol. A symbol that we are all slaves.

Let's make sure that we celebrate St. Patrick’s Day, the patron saint of slaves is the patron saint of us all; because we are all slaves to the state.

Cannon 2, of the Rules of Judicial Conduct states that “A Judge Shall Avoid Impropriety and the Appearance of Impropriety in all of the Judge's Activities,” providing that “A judge shall . . act . . in a manner that promotes public confidence in the integrity and impartiality of the judiciary”; saying that “A judge shall not allow family, social, political or other relationships to influence the judge's judicial conduct or judgment.”

The test for appearance of impropriety according to the commentaries “is whether the conduct would create in reasonable minds, with knowledge of all the relevant circumstances that a reasonable inquiry would disclose, a perception that the judge's ability to carry out judicial responsibilities with integrity, impartiality, and competence is impaired.”

Would you afford us all the benefit of your opinion, and seek the opinion of our readers and contributors to the following: What is the propriety of a judge who is married or in a “meaningful” or “significant” relationship with a police officer sitting in the criminal division? Would the opinion change if the judge handles cases involving officers who are assigned the mates or significant others unit or section?

What I don't get is why Jack does not run for Judge. He is a media craved monster and surely if he ran for Judge the media would be all over this. Also note he can file to run for the media attention and drop out before the qualification fee is due. Now thats truly free media attention.

I've spoken with the screeners on the belt issue and they did not misunderstand the instructions. It's the building manager who, as usual, wants to impose unreasonable and needless security procedures that overwhelm the screeners, the people who come into the building and the system without any real increase in security.

The FACDL should quickly talk to Stan Blake and the building manager to get this issue resolved.

Defense attorneys are as much officers of the court as prosecutors and should be able to bypass security screening just like prosecutors do.

You forgot to post Jack's follow up "Notice" to the Supreme Court, which says that he intends to "discover" the sexual practices of everyone involved in the Bar proceedings against him. Now those depositions should be exciting, no? I can't wait to get one of those subpoenas. When the Bar takes his deposition on his own sexual practices, however, I'll bet it's a very short one.

Obama's the problem? Clinton's insistence on a scorched earth policy is the real problem.

Apart from super-delegates and supposing both Michigan and Florida are to be seated, there are 884 pledged delegates left to be divided. Obama has a 170 delegate lead. To overcome that lead, Clinton has to take 613 of the 884 remaining pledged delegates. That's about 70%. By way of comparison, Clinton took 53% of the delegates in her huge Ohio "comeback."

If you include the superdelegates, the average win needed drops, but only to the mid-60s. Is that even thinkable given that she TRAILS in North Carolina, Indiana and Oregon?

So why is she staying the race? Why is she hammering the presumptive nominee of her own party. Is she really that crass? Does she truly feel so entitled that she's willing to drag down her own party? Apparently she is.

The reporter should be left alone. She is getting complaints from both ends of the spectrum ..some say she did not go far enough, while others say she went to far. Sounds like she is just a good reporter. Would be interesting as to why the GOP would support that Broward Judge. In no way would I ever support that Lady running here in Dade as she has some anger issues,However I would be skeptical of Hendon as he was appointed by Bush (twice) which means he is likely politicaly conservative and Lord knows those people are no friend to minorities.

You don't need to pretend to be a former Obama Supporter to get us to see that we should not elect this man. Anti-Christ or not, it doesn't make a good impression on the rest of the world to have someone with a muslim name as our President. Ferraro's comment has nothing to do with that, and actually, she atacked him not the other way around. Ferraro was wrong and so we shouldn't use his response to her comments against him. However, there are plenty of other reaons not to elect Obama.
