Sun George?

Last night in the comments section, we saw fit to quote from one of our favourite books. In another context in terms of the present day situation in our nation, we wonder if perhaps these words may not assist those who are pondering events and making decisions.

Sun Tzu wrote, inter alia,

WAGING WAR:

When you engage in actual fighting, if victory is long
in coming, then men's weapons will grow dull and their ardor will be damped. If you lay siege to a town, you will exhaust your strength. Again, if the campaign is protracted, the resources of the State will not be equal to the strain. Now, when your weapons are dulled, your ardor damped, your strength exhausted and your treasure spent, other chieftains will spring up to take advantage of your extremity. Then no man, however wise, will be able to avert the consequences that must ensue. Thus, though we have heard of stupid haste in war, cleverness has never been seen associated with long delays. There is no instance of a country having benefited from prolonged warfare.

The skillful soldier does not raise a second levy, neither
are his supply-wagons loaded more than twice.

Poverty of the State exchequer causes an army to be
maintained by contributions from a distance. Contributing to maintain an army at a distance causes the people to be impoverished.

Attack by Stratagem

In the practical art of war, the best thing of all is to take the enemy's country whole and intact; to shatter and destroy it is not so good. So, too, it is better to recapture an army entire than to destroy it, to capture a regiment, a detachment or a company entire than to destroy them.

Hence to fight and conquer in all your battles is not
supreme excellence; supreme excellence consists in breaking the enemy's resistance without fighting. Thus the highest form of generalship is to balk the enemy's plans; the next best is to prevent the junction of the enemy's forces; the next in order is to attack the enemy's army in the field; and the worst policy of all is to besiege walled cities.

There are three ways in which a ruler can bring misfortune
upon his army:

By commanding the army to advance or to retreat, being ignorant of the fact that it cannot obey. This is called hobbling the army. By attempting to govern an army in the same way as he administers a kingdom, being ignorant of the conditions which obtain in an army. This causes restlessness in the soldier's minds. By employing the officers of his army without discrimination, through ignorance of the military principle of adaptation to circumstances. This shakes the confidence of the soldiers.

A whole army may be robbed of its spirit; a commander-in-chief
may be robbed of his presence of mind.

When in difficult country, do not encamp. In country
where high roads intersect, join hands with your allies. Do not linger in dangerously isolated positions. In hemmed-in situations, you must resort to stratagem. In desperate position, you must fight. There are roads which must not be followed, armies which must be not attacked, towns which must be besieged, positions which must not be contested, commands of the sovereign which must not be obeyed.

There are five dangerous faults which may affect a general:
(1) Recklessness, which leads to destruction; (2) cowardice, which leads to capture; (3) a hasty temper, which can be provoked by insults; (4) a delicacy of honor which is sensitive to shame; (5) over-solicitude for his men, which exposes him to worry and trouble.

When a warlike prince attacks a powerful state, his
generalship shows itself in preventing the concentration of the enemy's forces. He overawes his opponents, and their allies are prevented from joining against him.

Hence he does not strive to ally himself with all and
sundry, nor does he foster the power of other states. He carries out his own secret designs, keeping his antagonists in awe. Thus he is able to capture their cities and overthrow their kingdoms.

Maybe the powers that be in DC should be reading more Sun Tzu and less Jim Baker.

PS. Has any ASA done more in the last two months to protect this community than Laura Adams? With two victories in high profile serial rapist cases (which we are sure took years of investigation and work to obtain) she deserves our thanks.
Well Done.

Let me start the ball rolling with the story of a fetching ASA and a police officer caught strip searching each other in a car by some amused colleagues.

Was Abe offered that state job? Inquiring minds want to know- so does a certain Circuit Judge who has HER sights set on the 3rd DCA if she agrees to take the job.

Some not so happy vice cop vowing to crash the SAO's March Madness pool and "make some arrests" after some ASA's put the kibosh on an investigation he was doing.

With DNA and a confession-a first year law student could win a conviction in a rape case.

you can not be phil. he's no blowhard.

I am moving up to the Broward Blog ... If I wanted to read this sh--, I would have turned on NPR this morning

i agree. the states successful case with a confession, dna and tons of other evidence any secrectary in the sao would have gotten a conviction. its no big deal.

a little holiday ass kissing to an above average asa is no big deal. give me dna and a confession and im ready for trial. years of preperation rumpole? take another shot of egg nog. you are starting to remind me of the "brokeback blogger" again....

Laura Adams is the best. I never had a supervisor more prepared with her own work and willing to take the time to help her division ASAs prepare. Her courtroom abilities are flat out superior. I can think of no ASA I would less want to see on the other side of a trial case that I am handling.

Laura is the best and she should be at the top of any list for any job in that office, or for any job period.

dna and a confession = guilty every time.

She may be great, but the case was gravy. I'm just glad she didn't blow it.

Anonymous said...

let her try to defend and win a case with those facts. he or she who does that is the "best".

"I have been using Advanced Gain Pro for 3 months now and I must say I'm simply amazed. I really didn't think the product would have this many benefits. I really only purchased the pills to help the reliability of my erections. But to my surprise every aspect of my penis and sex life has improved. I have larger, harder erections easily, and I can really satisfy my girlfriend fully now."

Finally! A new pill that really works!

i am starting to believe that RUMP is a asa, or a former asa. he defends the abed one daily, in fact kisses abe's rather large ass. and he reaps praise on a conviction that by dog could have won.

Anonymous said...

So what if he was a prosecutor? Doesn't a prosecutor deserve praise for protecting the community from a serial rapist?

Anonymous said...

yes but i give more praise to the cop that cought the scum bad.

Large Ass? I object. I have many faults, but that is NOT on the list.

Trying a slam-dunk is easy, unless some jury decides on a lesser and you spend many nights imagining that you can figure out what you did wrong.

Then, of course, there is hardly any public pressure on a defense attorney -- or a boss who has a high level of expectation. There are times when you get to believe that you are only as good as your last trial, which the Boss expects will be perfect.

Life is less than all rosy on this side of the Courtroom.

Anonymous said...

Abe, what is the lesser of rape?
And does your boss really care if asa's loose cases? If so, she must be angry all the time.

My investigations lead to Abe as the great Rumpole.

Always blogging when Rumpole is NOT.

OK Rumpole blog and someone find Abe at the same time and solve this mystery.

Anonymous said...

Who is Rumpole?

The identity lies in the following:

1. Phil. R.
2. Judge R. Pineiro
3. Judge S Blake
4. ASA Abe
5. Atty B. Tannebaum
6. Atty David Markus
7. A law student at St. Thomas?
8. Judge A Hague

10. Chris and Alan.

Anonymous said...

Check the jury instructions, there are lots of category 2 lessers of all crimes.

Does KFR care? Depends on the media coverage of the case. Lose a high profile case and she cannot become Lt. Governor -- or some such bullshit theory.

Anonymous said...

Great list. Except that some of those people could not tell you who Horace Rumpole or Ayn Rand are, or even that one of them is fictional.

I love Phil and therefore I love Rumpole.

Rumpole will not post tonite.

Using an Ancient Art of War approach, (with a Bad Santa paraphrasing of the theory) can't we send unclean women to take down the enemy? Send 'em on a tour de force down the Boulevard in Dade!

Thank you very much.

Rump I am the same anonymous who went after you for your idiocy on the DNA colloquy but you are right on the mark on Laura Adams. One of the hard working and most prepared ASA's I have ever had the privilige to work with. She is smart and tough as nails. its funny that all the defense attorney cretins rip her for trying easy cases-- for many years she was a DC who tried the toughest homicide cases it the building.

thanks rump for recognizing a good prosecutor

I have been with Phil all night. So have a number of others. Unless Jackie is posting as Rump, Phil is NOT Rumpole. Im a little disappointed, because I was sure it was him.

There is not one person at the SAO that works harder, cares more, and WINS more cases than Laura Adams! There is NOT one person that gives more of themselves to their cases than Laura.

How many ASAs at the Division Chief level still pull all nighters working on their files? Laura Adams does AND on a regular basis!

Let's not even get that far... when was the last time a Division Chief came in on the weekend for that matter?

Moreover, when Laura Adams was a Division Chief I hear she would even go in on weekends to help out her "C" level prosecutors! Who does that? Laura Adams.

So the next time someone wants to make a stupid comment, like a first year law student can try a high profile media rape case or my dog could it... bite your tongue! You should be ashamed of yourselves and hope that nothing ever happens as horrific as an armed sexual battery to one of your friends or family members. Anyone that says differently is just plain jealous... I dare you to step into the ring with Laura Adams on ANY case!

The SAO and Dade County should be counting their blessings that prosecutors like Laura Adams haven't left for greener pastures.

If the SAO continues to lose good, hardworking prosecutors (of a Laura Adams calibur) then one day the citizens of Dade County may be turning to 1Ls to protect them against sex offenders. Who knows? Crazier things have happened.

As for me, I sleep better at night knowing there are people like Laura Adams out there fighting to keep me and my family safe.

Keep up the good work, Ms. Adams!
