FATAL VISION

BREAKING: Fleur Lobree and Alan Fine are your new circuit court judges. And for Judge Lobree, currently of the county court (say that three times fast) her appointment to the Circuit Court, in the face of her loss at the polls in August to retain her County Court seat, is - in  keeping with the season- a Lazarus like arising from the judicial trash heap of judges who couldn't defend their seat. Life rarely gives you second chances, much less third bites of the apple.

Good Friday Morning. This is your second to last working Friday of the year. Will anyone get roped into appearing in court on Friday the 28th? If so, time for a refresher course  on your litigation skills. 
10 Shopping days until Christmas. 17 days until we tumble over the fiscal cliff.  And just for perspective, 201 days until the fourth of July, 2013.

Bogus butts?  Deleterious derrieres? The Herald reports that another clinic in Miami has been illegally enhancing the less than bountiful bottoms of the fairer sex of Hialeah. The article is here. 




















Anybody in trial besides the lawyers in Judge Tinkler-Mendez's division? 

Remember the Jeffrey MacDonald case? Green Beret doctor convicted of killing his wife and daughters? MacDonald's guilt was presumably exposed in the book and television movie Fatal Vision. The case has gone on and on. Back and forth to the Supreme Court. Now, for perhaps the last time, MacDonald, aged 68, and Brian Murtagh age 66 and the last remaining original prosecutor on the case, are squaring off in court again. Because of the new book "A Wilderness of Error",  MacDonald has a new, and in all likelihood final, evidentiary hearing. The Washington Post portrays this fascinating battle between two men for forty years here. 

A case lasting forty years? Talk about your career case.

In response to Rumpole and 9:06 AM, I am out of town, and have limited access, but here is the latest in Miami-Dade Circuit Court for the two open seats of Judge Victoria Platzer and Judge Ellen Leesfield:

Governor Scott has named as our two newest Circuit Court Judges:

FLEUR LOBREE
ALAN S. FINE


This is amazing news for Judge Lobree. What a roller-coaster ride she has had.

Judge Lobree began her career as an AAG in 1992-1997; she then Clerked for Judge Sorondo at the 3rd DCA from 1997-2001. She joined the State Attorney's Office in 2002 and worked there until 2011.

In April of 2011, Governor Scott, in his first judicial appointment in our County, chose Lobree for an open County Court seat.

This year, as a result of the appointment, she had to run in the general election in August. In that election, she faced Michele Alvarez Barakat. Barakat trounced Lobree. This meant that Lobree's last day on the bench was to be on Friday, December 28, 2012.

Well, we should all give a big thank you to Ms. Barakat. As a result of Barakat’s win, Judge Lobree now has a new job come January 2, 2013. She will now be a Circuit Court Judge.

Alan S. Fine has been an attorney for 28 years having graduated from the University of Florida College of Law in 1983. He runs his own practice in Coral Gables and specializes in civil forfeiture, commercial litigation and complex fraud cases. Oh yeah, he also went to Princeton and earned his undergraduate degree. I know this guy - and folks - he is smart, and he will do a great job.

Congrats to both.

So Fluer Lobree will serve another two years until she is soundly defeated again at the polls. Maybe Alvarez-Barakat will take her on once again.

GOVERNOR RICK SCOTT & JUDGES ....

For those of you out there keeping count, this completes 24 months on the job for our new Governor.

In those 24 months, Governor Scott has made 24 judicial appointments in Miami-Dade County to the County, Circuit & 3rd DCA.

Of those 24 appointments, 13 were male and 11 were female. Of those 24 appointments, 16 have been Anglo, 6 have been Hispanic, and two have been black.

Of note, both of Governor Scott's appointments that were black, Judge Rodney Smith and Judge Eric Hendon, took place after THE CAPTAIN authored the May 15, 2012 piece called: JUDICIAL APPOINTMENTS - WHERE HAVE ALL THE VIRGIL HAWKINS' GONE????? In fact, Governor Scott's very first appointment after that piece ran on Rumpole's Blog was Judge Smith.

FUNDRAISING .....

I would strongly suggest that Judge Lobree open her campaign account for the 2014 election in January of 2013 and begin lining up her endorsements immediately if she wants to avoid another long hot summer of campaigning in '14.

ELIZABETH SCHERER, now former ASA. Ms. Scherer has been practicing for 11 years. You may recognize the Scherer name; her father Bill Scherer has been a bigwig in the Republican party for a very long time. He is one of the named partners from Conrad, Scherer. He actually resigned from the Broward JNC when his daughter applied.

Congrats and good luck to Judge Scherer.

Fleur will be great on the circuit bench-- she is reasonanable, kind, very smart and hard-working-- she is not a prima donna or egomaniac-- she loves criminal law and she's done a lot of good in this community and i am proud to know her

The appointment of Judge Lobree to circuit is a wonderful thing. The tragedy in Newtown is an awful thing.

As I maintain the prior thread, I don't think Sherer should have gotten the nod in Broward over Rifkin, but that's the machine at work.

Lobree, really? A judge with the brains of peanut, who gets her ass kicked in a County Court retention race after getting appointed less than two years before, gets a promotion? Is there a reason why she did not have to wait for a County seat to open up?

Hendon? Weak. Too busy making everybody happy to do the job. Not the brightest bulb on the tree. He will have a hard time following the rules, because he does not know them. Can anybody spell "Rick Scott is running for re-election"?

Does anybody question that Captain is Paul Huck, Jr.?
