DUIS DOOMED?

The Armando Gutierriez who was indicted in New Mexico and is a political consultant there and who may have some ties to South Florida is NOT the same Armando Gutierriez who runs many judicial campaigns in Miami.

If DUIS and something called an "intoxilyzer" are your things, then courtesy of the Broward Blog here is a North of the Border Judge's ruling throwing out breath tests because of something like they forgot to feed the hamster on the wheel inside the contraption.


Many of you remember Ted Klein. Ace lawyer. Very well respected. Got his dream job as a federal magistrate only to have the building he presided on kill him with mold. The wrongful death lawsuit filed in federal court was dismissed last week. The DBR article is here.

Ted was killed by the negligence of federal managers who knew about the mold problem in the courthouse and did nothing about it. It's more than a damn shame- It's a &!*$%&)*&* Tragedy.

Just in case you missed it, Phillies second baseman Eric Bruntlett accomplished for the first time since 1927 an unassisted triple play to end the game in the ninth inning of the Mets/Phillies game on Saturday.

Coming this week: CHAOS AT THE PDS OFFICE. Silent Charlie won't talk, but others have and the stories we hear. Morale at the bottom. Dress codes being enforced for jail visits. I presume Rump you conducted the autopsy, determined the cause, and tested the courthouse for the same pathogens, and concluded a likely proximate cause. right? oh, you didn't? You are just basing off what you read in the review? oh you do not know really what caused his death? you really have no clue who these federal "managers" are? ok then. you moron you. stick to what you really know. very little.

Before posting any comments about a hush hush sexual harassment suit and ruining someone's reputation, I would strongly suggest that you do your research and try to contact any parties named or involved for an interview. I recently heard a similar rumor only to find that it was untrue, and I know that the person who is sublect of the rumor is thinking about suing the person spreading the rumor. Just a word of advice, assuming it is the same rumor.

JUDGE MARIA D. ORTIZ ....

(for the benefit of 10:28 am and the other "fascinated" lawyers).

Judge Oritz earned a Bachelor of Arts and a Bachelor of Science from UM in 1985. She got her JD from Nova in 1989 and was Admitted to Florida Bar in 1991.

In 2004, Governor Jeb Bush appointed her to the County Court.

In 2006, she ran unopposed and was elected to a six year term. She raised $23,525.44.

Prior to becoming a CC Judge, she was a Judge of Compensation Claims for the State of Florida for six years and also served as an Assistant City Attorney for the City of Miami.

Her Group 26 seat is up for election in 2012.

So, 10:28, are you still fascinated?

Rump, I hate to say it since I really do love the office I work for, but morale at the PDO has really plummeted. Everyone feels like they have someone watching over their back, too much work, no pay, more and more red tape . . .
It's starting to feel like the SAO over here. Lack of discretion + too much oversight = unhappy PD's ready to jump ship.

OK. I'll start with tonights game: J E T S at Ravens.
1) The Ravens right now look like the class of the AFC. Better than the Steelers or the Cheaters. Punishing defense. Good running game. Very confident QB who is well coached and has a cannon for an arm. 2) Rex Ryan coach of the J..E...T..S. It is really time to start considering salads for a few meals a week.

The Dolphins:

In Cover 2, their base D, their is a consistent break down in weak side run support and pass coverage. They don't have the safeties to provide the support ala Ed Reed for the Ravens or Troy Polomalu for the Steelers. That leads to breakdowns and long pass plays and breakaway runs like you saw the Pathers do. They need help at CB and Safety. They need to sign two veteran Free Agents- 1 safety and 1 CB. Watch the waiver wire. They will be available.

About Judge Seidman's ruling ... I'll put money on his decision being overturned ASAP. Even though the underlying premise (that oversight and accuracy of these machines is lacking), you will note that Seidman cited no cases in support of his actions and there was no proof submitted at the hearing that Veiga actually manipulated the machine used in that case. I wonder if there is any coincidence between this ruling and the fact that Seidman has drawn heated opposition (as he is generally seen as being an asshole by the defense bar in Broward) for his position in 2010?

Do you think someone should be guilty of DUI just because that someone denied to take a blood test i know you migth be thinking that if you have nothing to hide then why fear but would you acussed someone guilty of DUI jus becase refusal of blood test?
