FED STUFF

Courtesy of everyone's favourite federal blogger,  Dade Circuit  Judges Jerald Bagley, Robert Scola,  Mary Barzee Flores,  and Darrin Gayles have applied for the vacancy in US District Court.

We all know that the Chief (Judge Fred Moreno) got his start in the humble confines of county court in our Justice Building. But who can name the last Dade Judge who was appointed to the federal bench?  Who was the last female Dade Circuit Judge named to the Federal Bench?

Former Fed Prosecutor and current Dade Circuit Judge Daryl Trawick has thrown his hat into the ring to be the next US Attorney. Also on the list is  Judge Illona Holmes, who is currently chief judge of the criminal division North Of the Border. Can anyone tell us Judge Holmes' connection to our little building?

Judge Holmes was an A.S.A.,not P.D.in Dade County during the early 1980's.She then moved to Feds as I believe U.S.Atty thenn to Broward as County Court Judge,then Circuit.

You mentioned four of our fine judges, but failed to mention Circuit Judge Peter Lopez and County Judge Maria Ortiz.

Wasn't Cecilia Altonaga only a County Court judge? I know she started off as County Court judge. Did she then become Circuit Court judge?

72 year old woman in texas tasered for not signing a PTA on a speeding ticket. of course texas authorities say the taser was justified.

one question: what man can go home to his wife and sincerely state that he had to taser a 72 yr old woman. this guy is a complete wuss. id be so embarassed to resort to a taser on an old lady.

I hate to be like this but, what does an assistant federal public defender get paid? I didn't rack up 6 figure student loans to get paid $40k a year. I could have done that teaching history or US government to high school kids (and gotten summers off).

Pretty quiet week at the 3rd DCA. But I thought that one quote from a case called Harris v. State was worth printing here:

Terrence Harris appeals from the trial court’s denial of his motion to correct an allegedly-illegal sentence under Florida Rule of Criminal Procedure 3.800(a).

Harris was sentenced as a violent career criminal for the charge of burglary of an unoccupied dwelling.
Harris sought the same relief in a prior appeal, our Case No. 3D03-2998. His theory was rejected in Harris v. State, 902 So. 2d 183 (Fla. 3d DCA 2005), citing Rodriguez v. State, 837 So. 2d 1177 (Fla. 3d DCA 2003), review denied, 848 So. 2d 1155 (Fla. 2003).

We remind the appellant that repetitive motions are not authorized under Rule 3.800 for claims that have been previously adjudicated and “may lead to forfeiture of all or part of his accumulated gain time.” Tannehill v. State, 843 So. 2d 355, 356 (Fla. 3d DCA 2003).

Jerald Bagley was one of the BEST JUDGES I have ever been in front of. He deserves the Federal bench and would be a good U.S.
District Court Judge.

Moreno, Altonaga and Lenard all started out as county judges, and become circuit judges.

Judge Richard Suarez went right from county court to the 3rd DCA.

What's the big deal. A good judge is a good judge anywhere.

Gayles is a great candidate for a Federal District Judge opening or a Circuit Court opening.

Great News! The now former Miss California Carrie Prejean is back in the news cycle. Just watched about 20 minutes of her on Headline News. Love when they keep replaying that clip of her in the white bikini over and over and over. Anyway, from a legal perspective, Miss Prejean has heard the words "You're Fired!" from pagent owner Donald Trump for allegedly being in breach of contract. Perhaps "The Donald" must have mistaken such alleged breach for that which was about to occur in his trousers. Wrongful Discharge? Maybe a little premature Donald (Go get cleaned up Donnie.). Who wants to file amicus? I'm looking forward to long and protracted litigation. It will be Carrie for 30 minutes every night. Will she regain her Tiara? Will she pose for Playboy? What about more natural looking implants?

BTW, when is the next Obama news conference, we still have two wars going on and still in a recession, no matter how they massage the numbers.

Are you kidding me. Maria Ortiz is not even qualified to judge a dog show..what business does she have applying to the federal bench. I tried a case in front her where the state objected when I tried to cross-examine a police officer regarding the evidence he failed to collect. The state objected based on...wait for it...facts not evidence. Maria Ortiz had to go to chambers for over an hour to figure it out.

I stand corrected - Ursula IS still a hottie. I loved being in trial before her, when she would call me sidebar and berate me for being a bad, bad boy. It provided needed relilef from tedious trial days. Have I said too much?
