CAPTAIN POLITICAL UPDATE..BLOGGERS IN TROUBLE

The Captain reports:

CIRCUIT COURT CAMPAIGN WATCH:
The clock is ticking and there are now less than two weeks to go until the end of qualifying. The burning question seems to be not whether Cristina Miranda, ASA, will be filing, but against whom, she will be filing?

There has been wide speculation that she will file in Group 24 against first term Judge Mindy Glazer. In anticipation of that challenge, Her Honor recently put her money where her gavel is, and poked down $140,000 of her own mulah on March 31, 2006. Many remember Glazer filing at the 11th hour and startling lontime sitting Judge Martin Kahn. In that election, Glazer raised only $7,693 and ponied in an additional $37,500 of her own money, but it was enough to unseat Kahn.

In 2006, Glazer has raised $64,773 from 332 contributors and added $150,000 of her own cash for a campaign warchest of nearly $215K.

If Miranda chooses not to file against Glazer, she has several other possible opponents, among them:David Miller, Cindy Lederman, Lester Langer, David Young, Gisela Cardonne Ely, Pedro Echarte, Maria Korvick, Ellen Venzer, Arthur Rothenberg, Maxine Cohen Lando, Mark King Leban, Maria Espinosa Dennis, Cristina Pereyra-Shuminer, Maynard "Skip" Gross, Ellen Leesfield, Israel Reyes, Joel Brown, Victoria Platzer, and Stan Blake.

UHHO…. AN ALERT READER EMAILED US THIS:
Law.com reports:

When a temporary San Francisco prosecutor wrote on his personal blog about a misdemeanor case he was handling last December, he probably didn't think the judge would read it.
But Superior Court Judge Curtis Karnow heard about it. And he didn't like what he read.
Karnow didn't find the postings prejudicial enough to throw out the entire case, as the defense wanted. But in turning down that motion to dismiss this week, the judge still came down hard on ex-prosecutor Jay Kuo, calling his conduct "juvenile, obnoxious and unprofessional." Karnow also stated his intention to send his written ruling to the State Bar.

Rumpole says: “Juvenile, obnoxious and unprofessional.”??? How dare that prosecutor copy our blog!!!! “Get your own schtick” we say. We have made every legitimate effort to corner the legal market on those qualities.

The Blog devolved over the weekend into a Godfather sequel.

Rumo, here is a curious note:

Does Ms. Saida Nuñez think she can keep violating all judicial campaign rules and laws? Seems that Ms. Saida Nuñez is campaigning for multiple candidates with 1990 tactics which include but are not limited to: Mudslinging, intimidation and just plain ignorance.

Ms. Saida Nuñez, stop your hate and please play nice. We are watching your lack of style and hateful ways. We like clean campaigns and you Madame are not an ethical campaigner.

Captain, can you please help locate a list of Candidates, using the services of this so called lady, Ms. Saida Nuñez. So far, the only people we have been able to for surely verify as her clients are Migna Saenz-Llorenz (not surprised) and Bronwyn Miller. We cannot verify this though and need your help. People like this need to be stopped.

Shelly, watch this lady. She is a walking misdemeanor in the opinion of many.

Rory is almost finished with his debut auto biography entitled "Memoirs of a brummer Geisha".

It is said to contain such controversial topics as the true life accounts of recruiting trips to various north east cities. Seduction, adventure and philly cheesesteaks are all addressed. Also, a behind the scenes look at the restaurants Rory frequents within 15 miles of his office.

The forward to this book will be written by B. Brummer. I will try to obtain some of the advance copy and post it as I get it. Off to court.

IMPORTANT LEGISLATIVE UPDATE:

Many of you have been following the debate on Senate Bill 658, The Closing Argument Bill. During the last few weeks, FACDL-Miami President, Brian Tannebaum, along with several other members of both FACDL-Miami and FACDL statewide have been lobbying against the bill.

The bill would have eliminated "close-close" for the defense.

The Senate voted today on the bill, and it required a super majority vote, to change the law. The vote was 25-11, (it needed 27 votes) and it therefore failed to pass.

The session is not over and crazier things have happened, but for now, defense barristers, you can still get the last word.

If it wasn't for Hispanic immigrants, most of us wouldn't have our yards tended, homes cleaned nor after school programs (professional or private)
for children. This also reminds me how many of our parents and elderly relatives are cared for by immigrants as well...both documented and undocumented.

Let's keep America Strong and give these hard working Hispanic individuals and their families the same ones we have to Life, Liberty and the Pursuit of Happiness as well as Education and Health Care.

I love immigrants as much as the next guy. Let's not get all Fox News creepy/crazy about it, but there's just no need to go around rewriting national anthems. That sort of song is supposed to represent a common thread (since there aren't many) we all strive to enjoy together. Which means, sooner or later, learn the friggin language. Or try. Why are we giving the Broward judges a hard time for pointing out that a Cuban whose been here for 19 years and can't speak English (even a little) is just making no effort whatsoever. Just being here doesn't count to make you an American; earlier immigrants assimilated and adapted at the same time. Except the Irish. I still have no idea what they're saying, especially after a couple of pints, but God love 'em anyway. They get a free pass for starting out sort of speaking English.

izzy is terrific and whether its this time around or not, he'll be on the third. i'd love to see someone run against Lederman, that would be so sweet. and i bet every parent who she has ever looked down at would vote for that opponent

the probate bar is all abuzz about Cathy Parks possibly filing against Judge Rothenburg. They want to keep him, but know that she could probably beat him. A solid source has confirmed this.

I may still vote for Judge Cohen...

He is consumed by his sister's life and death and by the disdain he feels for those whom he says contributed to her untimely passing. Few other thoughts, it seems, cross his mind. His world is a lonely one. He relies on public transportation and recently moved in with a friend “from the music business” because he couldn't afford to pay his rent. He hasn't been working since 1997 and says he gets by on royalties from some of the Menudo music he owns, which mostly sells in Latin-American countries.

McGillis also faces many accusations. The state's welfare agency and juvenile court considers him a harasser and manipulator. A few days after Wendolyn died, McGillis videotaped her children answering questions about what transpired before their mother's death. The DCF claims McGillis brainwashed the kids into believing Benge killed their mother. McGillis denies the allegations. He's jammed up many fax machines. During a hearing in October 1999, Judge Jeri Cohen complained about it. “You are not to fax me anything else,” Cohen ordered. “If you have something. I'm warning you not to do it. Let me tell you something, Mr. McGillis. Look at me. That fax machine is my fax machine. I pay for all the ribbons in that, and since you have started faxing me information my bills -- and I'll call my secretary in here -- have gone up. It's costing me $85 a month in ribbons because of all the junk you've sent me.”

According to DCF's district administrator Charles Auslander, McGillis had harassed attorney Lucy Piniero by calling her office 50 times in a row. Judge Cohen entered an order prohibiting him from communicating with anyone from the Department of Children and Families, particularly Piniero. McGillis appealed. “Well, you know the problem with that was that maybe he only called 40 times,” says E. Joseph Ryan, Jr., an appeals expert who represented McGillis in the Third District Court of Appeal. “It sounded like a fantasy.” Once police even dragged him out of the Juvenile Justice Center in handcuffs because he wouldn't leave Piniero's office until he spoke to her. McGillis was charged with trespassing even though he was in a public building during business hours.

While McGillis clearly has crossed lines, those opposing him have as well. Judge Cohen has questioned his sanity: “Darrin is mentally ill.... You don't have to be a rocket scientist to know that he's got severe psychological problems,” she said during a hearing in April 1999.
