SUMMER IS OVER

UPDATE: The Jury is out in the Boating manslaughter case before Judge Walsh. 
Rae Shearn got the well deserved NG on Friday in the Jelmo Kirkland case. Self defense. Well done Ms. Shearn. Well done indeed. 

BREAKING: JOA....reserved. The judge neither granted nor denied the JOA. She reserved on the motion.  The case goes to the jury. As per @Davidovalle305 tweets. Follow him and never miss an important REGJB story again.

BREAKING: Judge Lisa Walsh hearing argument from both sides on the JOA argument on  the boating manslaughter case. @Davidovalle305 just tweeted around 1:45 pm that the Judge seemed on the verge of granting the motion. More as this story breaks.

How did we miss the 100th Birthday of the Oreo in March? 

The Democratic Convention starts up this week. But more importantly, the NFL starts on Wednesday with the Cowpokes v. The Gints. Should be a nice match up, until the Cowpokes realize that Tony Romo is still their QB.  

David Ovalle tweeted that Jelmo Kirkland was acquitted of second degree murder late Friday before Judge Colodny. Anybody care to give a shout out to the defense attorney(s) that deserve a Rumpolian "well done"

There's a fascinating federal trial going on that is giving the jurors an inside look at the secretive Amish community. A series of attacks by a breakaway Amish sect on other Amish, in which men's beards and hair were cut against their will has turned from a simple assault and battery case into a federal hate crimes prosecution. 

This just in: At the Democratic National Convention, Arnold Schwarzenegger will be the surprise speaker just before President Obama. He will yell at an empty  table for several minutes before warning "I'll be back".  Really.  Go ahead. Make our day.

T-63 days and counting until Election Day......

In exactly nine weeks, our citizens will go to the polls to elect a President of the United States. Will BHO get a second term or will Willard Mitt Romney become our nation's 45th President?

The NYT 538 has Obama with 308 electoral votes to 230 for Romney.

The Huffington Post has Obama with 231 and Romney with 191. They call the 116 remaining as tossup with eight states in the tossup column:

Colorado
Iowa
Wisconsin
Michigan
Ohio
Virginia
North Carolina
Florida

The DNC begins their party in Charlotte tonight. Three nights of speeches with Obama pulling another Colorado rocky mountIn high as he tries to repeat what he brought to the convention in 2008. This time, though, he will speak from inside the Bank of America Stadium, home of the Carolina Panthers with a seating capacity of nearly 74,000

Tune in tonight for your Keynote address. A great story indeed. Twin brothers Joaquin Castro and Julian Castro will take the podium tonight followed by First Lady Michelle Obama.

Joaquin, 38 years old, is a Texas State Representative currently running as a US House Candidate in Texas.

His brother, the Keynote Speaker, is Julian, the current Mayor of San Antonio. Both brothers attended Stanford University and Harvard Law School.

Everyone says I ruined it. Well, If I didn't take the deal I would still be in. I'd be until the 3rd of never. I'm gonna do life for that evil bitch? No way jose. With all that yayo I flew in for them, you know what they gave me when I got pinched? 22K. Said it was enough for a good attorney to get me off. Then wanted me to hire some yahoo who was ready to plead me without cooperation. Yeah. Like you guys would have all done the time. Not.

A motion for JOA made at the close of the State's case should be determined at that time; a trial court may not defer its ruling until a later time and it is error to do so. See Hitchcock v. State, 413 So.2d 741, 746 (Fla.), cert. denied, 459 U.S. 960, 103 S.Ct. 274, 74 L.Ed.2d 213 (1982); Adams v. State, 102 So. 2d 47 (Fla. 1st DCA 1958)

If you go by that political blog that the times carries that I posted a link to- its the 538 blog- they are exceptionally accurate based on scientific and probability modeling- they have Obama's re-election probability at +70%. Romney has a very very narrow path to victory in the electoral college. If you concede Wisconsin to Obama, which now looks likely, and Romney's not making in-roads in Colorado despite millions in ads from him and Super PACS- although it remains very close there. Romney's election is close to impossible if you factor in Virginia- where Obama is solidly ahead, and Ryan as VP moves Florida closer to Obama, where Obama retains a slight lead. Look at it this way- Obama can win and still lose a few of the states he won in 08. Meaning, he has some margin for error. Romney has none. The popular vote will be 51/49 to 53/47. But its always that. So this is a long way of saying I feel fairly confident, baring a major mishap- of Obama being re-elected. What could occur? A Greek default knocks the legs out from under the already fragile economy. Israel strikes Iran, which strikes back and the markets fall and there's no liquidity. Germany presses Spain into a default.
A live mike picks up Obama calling Romney a cracker, or Obama plotting with the UN to send troops to occupy Texas ( as some jackass judge said on TV the other day he thought Obama was going to do). Outside of those things, he should win.

I love it 3:27. You are right. Judge Rosa Rodriguez did this in the Spence Jones case. She was acquitted so it did not matter. A nice cop out. Sort of like saying "I don;t have the cajones to tell the State they are incompetent and never should have brought this case to begin with so I will let the jury decide and if they convict, then I will do what's right. And the State can then appeal. In the past 20 years I can think of only one judge who had the balls to deep six a flawed but high publicity prosecution: Judge Middlebrooks JOA on the Grigsby case. There may be more but I doubt it.

CAP- The 538 blog has Obama at something like 95% winning Michigan. Also, Virginia and Ohio and Wisconsin are solidly leaning Obama. It is a mistake to call those states a toss-up. And want to know why the Obama camp feels confident about those states? Obama has been spending a lot of time in Iowa. In the scheme of electoral votes, Obama is NOT spending time and money in Iowa if Michigan of all places is a toss up.Same with Ohio and Wisconsin. Obama saved the auto industry, He doesn't come close to losing Michigan, and it matters not one whit that Romney's dad was Governor of Michigan.
Also- look where Romney is on the air- Colorado, and Ohio. NOT Michigan and Virginia and Winsconsin. Romney doesn't spend any more money in Wisconsin unless the polls close to within 3 points, and despite Ryan as VP, he isn't within 3.

I think I saw El Capitan on the floor of the convention when I was watching CSPAN tonight. What can I say, I watch that station. I admit it, I am a convention junkie and Captain was in the background interviewing Rahm Emanuel.

Great coverage Rump on 538 and the conventions. But I still think that the RNC put on a bettor speaking list so far and I believe that Romney can pull this one out of the bag.

I'll be watching rock star Bill tomorrow night.

Ms. Moneypenney: Has the word gone out on the end of summer hours? I have lawyers wandering in here at all hours of the morning. Some are wearing ties, some are not. This is NOT acceptable. I am a busy jurist. Please re-send the memo, please post it on the door, do what is necessary. Summer hours are over. Court starts at 9:00 am. I will take the bench every day at 8:57 and I expect attorneys to be o time, prepared, and ready to lawyer. Thank you. Now please send me my revised copy of my speech to the incoming new jurists: "My life on the bench" and check Soto to make sure the ceremonial courtroom is reserved AND well stocked with refreshments. Thank you.
