THE DEATH PENALTY ... IT'S STILL ALIVE (AND WELL IN FLORIDA)

THE CAPTAIN REPORTS:

THE DEATH PENALTY .... IT'S STILL ALIVE (AND WELL IN FLORIDA)

Two recent articles on the death penalty deserve mention today.

First, Fred Grimm, from the Miami Herald, wrote an Op Ed called Dollars and Sense on Capital Punishment.  Part of it reads:

"Some 14 death row inmates in Florida have been cleared by DNA testing, after spending an average of 20 years on death row. Outside of the old Confederacy, that might be cause enough to reexamine the underlying morality of capital punishment."

"Instead, Florida Gov. Rick Scott vetoed funds earmarked for the Florida Innocence Commission, charged with sorting out flaws in the criminal justice system — an embarrassing mess of misidentifications and false confessions and lying jail house informants — that made Florida the national leader in wrongful convictions."

Read the rest here:

And, the Huffington Post, speaks about the "murder" of a Texas death row inmate who was convicted for starting a fire that killed his three young children.  Governor Perry gets the award here for the latest Governor to sign a death warrant that executed an innocent person.

The Huff Post article is called:

"Cameron Todd Willingham Exoneration Was Written But Never Filed By Texas Judge"

And reads in part:

"A Texas judge who reviewed the controversial 2004 execution of Cameron Todd Willingham planned to posthumously exonerate the father who was put to death for killing his three daughters in a house fire. "

"Scientific experts who debunked the arson evidence used against Willingham at his 1992 trial and a jailhouse witness who recanted his shaky testimony convinced District Court Judge Charlie Baird in 2010 that "Texas wrongfully convicted" him. But Baird's order clearing Willingham's name never became official, because a higher court halted the posthumous inquiry while it considered whether the judge had authority to examine the capital case."

In local news, the State of Florida vs. Adam Kaufman continues in Courtroom 4-1 on Monday.  Bill Matthewman and Al Milian for the Defense.  Dramatic testimony ended the week with a Crime Scene Detective returning to the stand to first deny and then admit having an affair with the lead homicide detective.

In case you missed it, the Herald article started out this way:

"But on Thursday, the trial took an unexpected turn when the defense attacked the morals and honesty of Detective Ana Howell, the lead crime scene investigator for Aventura police.
It was revealed in court that Howell, who gathered evidence in the death of Eleonora Kaufman, had an adulterous affair with the lead homicide detective on the case, Anthony Angulo."

"Kaufman’s defense attorney William Matthewman asked Howell about the affair.
“Isn't it true, ma'am, you previously had an intimate sexual relationship with detective Angulo?” Matthewman asked her in court."

“I am married and have three kids. My job is very important to me,” an uncomfortable Howell said from the witness stand. “This is very important to me, sir, because this is my life here,” she told defense attorney William Matthewman."

It's a shame we all don't have the opportunity delve into the private lives of defense attorneys, especially when it has nothing to do with the innocence or guilt of their clients. It might put an end to that BS line of cross-examination once and for all, doncha think?

I don't know where Fred Grimm got that number of 14 death row inmates who were cleared by dna in Florida. 14 inmates may have been cleared, but they weren't on death row. Hey, but why have the truth get in the way of a good story.

When you testify as a witness you put your credibility on the line. If you are an adulterer, while it may be "private" in nature, it's shows your lack of honesty. When you lie about it under oath, it also shows your a liar.

When the govt is attempting the put someone in prison for any given time, the jury should know if the evidence against that person is being brought by an honest witness, or in this case a liar. The bottom line is this witness lied to the jury about a matter relating to her ability to be truthful. If she was honest from the get go, perhaps her credibility could have been salvaged.

As far as the defense attorneys private life, how is that relevant to a case. The defense attorney ( like the prosecutor) isn't testifying, so what purpose would that serve? You don't like criminals so you somehow equate that with their lawyer? Pretty shallow thought process. I don't like criminals either, but I do like the constitution.

I am sorry 6:39, but the willingness of a witness to betray her family and marriage vows, with another witness in the case is absolutely relevant. It shows 1 she is a lying cheat who cannot be trusted, and 2 that she has a motivation to shade her evidence toward her former boy toys version.

Also, it is noteworthy to point out that on seeking to avoid answering the question, she talked about how much she loved her job, not her family.

A lawyers philandering has no relevance, except for that of one or so of the more "senior" prosecutors on the office who are know to have a thing or three for the boys in blue.

8:29 I stipulate to your comment, Anna Howell is a lying cheat, who did an incompetent crime scene investigation under the direction of the lead rookie detective/lover, and without doubt has motive to back his version of events unobjectively. State's case deteriorating with each witness. Great Kob being done by Mr. Mathewman and Mr. Millian.

THE CAPTAIN REPORTS:

According to the Innocence Project, there have been a total of 13 prisoners cleared of their crimes in Florida due to DNA testing. Only one, Frankie Lee Smith, was on death row.

BUT .....

There have a been a total of 23 inmates on death row in Florida who were later released because:

a) their conviction was overturned AND

i) they were acquitted at re-trial

or

ii) all charges were dropped

b) they were given an absolute pardon by the governor based on new evidence of innocence.

Florida, with 23 exonerations of inmates on death row, leads the nation in that category.

It's Sunday and for a certain large ethic segment of Miami, Sunday night means...CHINESE FOOD!

And the best take out chinese food in Miami is.....

GOURMET GOURMET! For more than two decades, visitors to Flagler and 42nd Avenue have been queuing up for the best chinese take out in the City.
It's the fresh food that sets GG apart- the chicken is fresh-never frozen. Ditto the shrimp and seafood and all the cuts of beef and pork are top shelf. The veggies are done crisply and never overcooked. All sauces are handmade for each dish. Let's get to it:

Appetizers:Old standby egg rolls are top notch, but the nod here goes to the dumplings- 10 to an order for 6.95 and freshly made every day.
Chicken: all the standards are here, but all are done better than you've ever had, but the can't miss dish is the "Chicken over Jade Blossom" which is something you can't get anywhere else. A GG creation with chicken, a special spicy sauce all finished over freshly flash fried crispy spinach.

Moon cake scallops is a spicy sauce and fish laid on greens, which are fresh chunks of fish fried over crispy green vegetables round out the can't miss items on the menu.

Note: On Sundays, GG opens just for take out from 5-9. Enjoy.

Remember: it's better to live good than be good.

In between your racist rants look up the case of, Dr.Ossian Sweet September 9, 1925 a case in which Clarence Darrow, represented a African American Dr. who was a former slave, and had advanced in life. When he moved in his new, two story brick home, in Detroit he was attacked by a mob of white neighbors, demanding that he leave.
"The house belonged to Dr. Ossian Sweet, twenty nine and his twenty three year old wife,Gladys. With their baby daughter, they were the forst African Americans to settle in this white neighborhood and no illusions about how they would be welcomed. Among the furnishings were a sack of firearms and a satchel heavy with some four hundred rounds of ammunition. The Sweets went shopping for furniture for their new home that morning, and Ossian spent that afternoon seeing patients at his medical practice in the black quarter of the city.Alarmed by reports that the mob would return he asked his brothers, Henry and Otis, and a group of friends to help defend his home. Clarence Darrow told the jury,"Take away the hate and you have no case here. After an expensive legal battled funded by WEB Dubois and the NAACP defense fund, Dr. Sweet was exonerated, but his wife, and daughter died as a result of his wife contracting tuberculosis, while being incarcerated also charged with the murder, her charges was dismissed by the DA but she lost her life to the illness while Dr. Sweet had been incarcerated."

American Minority's way of responding with criticism apparently is to insult, beat up, and rape the girlfriends of the people insulting him. I wonder if he learned this in law school. People might be a little more respectful if he used words and logic to respond to words and logic. It might also help him get his points across (and he has made some good points) if he at least would learn how to use spell-check and grammer-check on his computer, even though it would really make things better if he could spell and understood the basics of English grammer.

Until its demise due to budget cuts (and if you believe that I am the tooth fairy) I was a member of the Florida Commission on Captial Cases. In its last two sessions, the Commission was prepared to address the issue of whether the death penalty in Florida was actually working.

It was our examination of the effects of the death penalty on the judiciary that gave rise to the very odd attempt by one of our members to propose in the House that there be two supreme courts comprised of ten members. Five members for criminal matters and five for civil.

The President of the Senate was so disturbed about where the commission was going and the work being done by regional collatoral counsel on behalf of death row inmates, he decided, despite the now obvious lack of oversight of those offices, to "save the taxpayer's money" by doing away with the Commission, which took up all of $200,000 of the budget.

The fact of the matter is that, as Justice Kogan put it so many years ago, death just does not work. It uses up a ridiculous amounts of judcial resources, taxpayer money to provide for death row inmates and deters nothing. In fact it may have the opposite effect, as perpetrators may, in a panic to avoid death after having committed one murder, commit another, which could be a police officer.

Not one death row inmate will tell you that, before committing his/her initial crime, considered the death penalty before pulling the trigger, so to speak.

If the legislature and the governor are serious about reducing the expenditures for prisons try with the extra $65,000 per year it takes to keep each and every death row inmate. With over 400 of them, the savings per year would be over $30,000,000 per year. That would pay a lot of teachers.

There is no first amendment right to free speech on a private blog. If you want to exercise your first amendment right the way it was intended, stand on a soap box in front of the justice building and spew your hateful crap.

Your comments about sticking it in someone's sister or girlfriend is gross, uncalled for, moronic, juvenile, and shows just how short your shortcomings really are. Guess it would be ok to stick something in your girlfriend or sister just to teach you a lesson? Since violence was used against African Americans, I guess it is now ok for African Americans to use violence against another segment of society.

Rumpole should ban you, but he won't because he is crapping his pants at what a moron you are.

11:36 What makes you think my reply was in any manner to froce my self on anyone you are a joke. My comment was clearly, a statement citing that I am a ladies man, and although you small group of racist do not like me, white women and hispanic women are attracted to me. I know that erk's you people internally to see that. That is the point of what I said. How could you take my statment and twist it around to mean something as reprehensible as insulting, beating, and rape. What you said proves your are unscrupulous in your character, and bias. Also btw you dont nearly point out the many typos of others I see on this blog, but it's ok. I wish you all would just stick to your own issue. Our founding father's of this country said, "Every man has a right to freedom of speech, and every man has a right not to listen." So exercise your right and leave me the hell alone, or we can continue to distastefully insult each other on a Law blog. I pretty sure if you used your real name, you wouldn't attack me on this blog like you do. I'm used to it, I grew up getting harassed and searched even thought I didn't look threatening. I was always searched without pc, and told to go on my way. You do become bitter after growing up treated like a suspect teenager coming home from the movies, getting of the public bus. Maybe you all should consider that before you attack me on this blog constantly. That is why I chose to become an "Attorney for the damned of society", just like Clarence Darrow did, a white man who is an original Co-founder of the NAACP formed in 1910. in NYC.

You all are cognizant of these facts and I know that. I also know why you all heckle my comments it's in your blood, and in your genetic make up to behave, like you do on a Law Blog. Which goes to show that a degree on a wall does not mean that a man has character.

Actually, Marco has very quietly become one of the most divisive politicians in America. It is not his rhetoric, but his ultra-conservative positions. He has not changed since his days as Speaker of the Florida House. He is just as mean and sanctomonious as ever.

The most devisive politician of the year is John Boehner. For all of his tears, Boehner has cowtowed to every one of his 89 "frogs in a barrel" as he calls them (freshman members from the "Tea Party"). By doing so and allowing Rep. Kantor to be his hatchet man (countered by Debbie Wasserman-Schultz as the Democratic "Bulldog") he has put his party's interest before the nation's.

He sees his job as being the head of his party, not the Speaker of the House working for the good of all Americans. He is so worried about staying Speaker, he forgot what his job is. I remember great Speakers like Sam Rayburn and Tip O'Neil. Real statesmen.

My vote for most un-American (note I did not say unpatriotic, because they are two different things) politician of the year is John Boehner.

I get kicks off of dating and or taking your girlfriends because you people are such jerks, and buffoons. When I got to a club or restaurant or say Dolphin mall there is always a catch for me. My point is although you men hate my ethnicity, your woman are attracted to me. That's payback for me. I have no need to force myself on anyone if anything I need an extensive appointment book. Now do you imbeciles have anymore rhetoric and lies I need address. It pisses me off to know you all think me a black man some how is suppose to not have a voice or opinion. BAN American Minority they say, as if the answer to poor speech is censorship rather than a more convincing argument. What a lawyerly position to take. I won't even agree AM's fascination with penile eruption is misguided... he is only responding to the stimulus engineered every day by mainstream media. It is equally revealing that some writers think only lawyers can speak, lawyers own the blog, and lawyers are immune from criticism or critique by non-lawyers or law students or interested passersby. Your defensiveness against AM and your inability to respond with intellect rather than emotion is most revealing of all. 1:00pm, Aside from ignorance and stupidity at least you know that violence was originally invoked by caucasians against minorities. That is called a fact something that bigots and ignorant people such as yourself tend to casually over look. You people originated the game of violence and relentlessness. Your for fathers and current generation are still murderous and caniving. The Bible says: "You reap what you sow."

Anonymous said...

Am Min-

Wrong again. Violence was not started by whites against minorities. All the evidence points to the fact that humans originated in Africa. They migrated around the globe over thousands of years. Acts of violence on one human by another was not invented by whites. It is as old as humankind itself.

Further there is evidence that as man migrated, they diversified, and at times tribes fought with one another.

And for the record, in more recent history, many Africans who were sold into slavery were captured and sold by other Africans. Warring nations in Africa were killing one another before a white guy even thought about using them as slaves.

I know you want to ignore history and scientific fact, so that you can validate your own form of bigotry, but it won't work on this blog. Educated people know better.

As long as you espouse the belief that every white is a devil who preys on minorities, it gives you a trumped up excuse to be angry. It also gives you an excuse for being rude. It's an excuse for why you can't get into Harvard. It's an excuse for everything.

Real men don't make excuses, or make meaningless anonymous threats. They don't brag about how big their cock is or how many white women they have had. Every time you write you show that you are a classless fool, with a huge chip on your shoulder. The world does not owe you anything just because someone you heard of was discriminated against. You being stopped on your bike is nothing like what people who struggled for civil rights went through, an it is an insult to them when you compare yourself to them.

Moreover, your fear, anger, racist views are also an insult to those people who risked their lives for you. They didn't withstand the dogs and fire hoses for you to write an express yourself the way you do.
