Acronyms.

Case in point: WPNG- anyone and everyone who practices criminal law knows that PNG means "Plea of not guilty." Indeed at least half the Judges in the REGJB know that as well, but we digress.

There are two ways you can enter a plea of not guilty: you can go to court and during the arraignment say the words "the defendant pleads not guilty" or you can file a written plea and thus obviate the need for your client to attend the proceeding (in State Court. Don't make that mistake in Federal Court!)

When someone in the comments section writes that they "filed a WPNG" it is a redundancy. If you've been paying attention you know there are two ways to enter a plea of not guilty- say it or file a written plea. It is, to the best of our knowledge, impossible to file an oral plea.

Therefore, it is a redundancy to say that one "filed" a written plea- there is no other way to do it.

The JAABlog reports on the rumor of the day- that two amorous ASA's were caught In Flagrante Delicto in the Broward County parking garage.

We'd be tempted to tell the over-heated crime fighters to go get a room. But with all Governor Scott is doing to state employees, our sympathies are with them. Perhaps they cannot afford a room. Now if they were going at it on county time....well that would be a different kettle of fish all together.

Speaking of Sex :
We are loathe to even dignify this conversation, but we shall, just this once.

There is a damn good reason why an individual's sexual orientation is not allowed to be discussed on the blog. It's nobody's damn business. Now WHERE they seek fulfillment might be someone's business, if they do it on county property and government time ( see above.) But otherwise there is more of chance that we would offer to take the entire Dade Judiciary to lunch at Joes and wash their cars while they ate then we would allow anyone discuss this subject on the blog.

Look at it another way. Nobody looks at Judge A and says identifies the Judge as a heterosexual judge. Just like most police descriptions used to not mention the individual's race if they were white. But for reasons similar to why african-american males are routinely singled out as "black males" in police report while white males are just "males", gay judges would be routinely referred to as "a gay judge", while we have never heard anyone refer to a heterosexual judge as a "straight judge."

Nobody deserves to be labeled and identified simply on their sexual preference. It's as irrelevant as identifying an individual by the sport team they support (although there is a damn good reason to make an exception for people who support the cheater-Patriots.)

So just stop it already. It will never make this blog.


There you have it. We got two things that were bothering us off our chests.

As we said, spring is in the air, and a young ASA's thoughts quickly turn away from min-mans and to love. Just be careful. You never know who's watching or what security cam is recording the most embarrassing moment of your life.

Remember the roaring 80's when Sonnett, Sale, Kuehne tore it up? What a firm! Then the Clone/Bondsmen Wars of the 1990's came and devastated the legal field. They were one of the casualties.

move the Supreme Court to the new First District Court of Appeal building in Tallahassee.

Rep. Bill Hager, R-Boca Raton, said all it will take to facilitate the move is to change the building signs and door locks.

And they (the republican traitors in Tallahassee) want the court re-structuring vote to be the same election as the repukelican primary in January, WHEN DEMS WILL HAVE NOTHING OF CONSEQUENCE ON THE BALLOT, and most moderates won't care about the court system, except for hearing that the "trial lawyers" (which always comes with the Fox-news implied "evil" in front of it) are against it, so it must be worth voting for...

Maybe Obama can declare marshall law and force a return to constitutional government in Florida.

HJR 7111 asks voters to consider a constitutional amendment that would add three justices to the Supreme Court and create two divisions, one for civil cases and one for criminal.

“I’m sure the pill mill drug dealers don’t want reform but we’re reforming them,” said Rep. Matt Gaetz, R-Destin.

You miss the point re the sexual orientation of judges. No one cares about a judge's sexual orientation, race, religious beliefs, or the like, unless it affects how they rule or the experience reservoir from which they draw their judgments. In the same way that "finishing school" graduates probably ought not sit in the criminal courts, people, IRRESPECTIVE OF THEIR SEXUAL ORIENTATION, who are not familiar with intimate relations between opposite sexes should not be in Domestic Violence Court judging those accused of crimes involving relationships between folks of the opposite sexes.
Sometimes you get so wrapped-up in your PC attitudes that you lose all objectivity. Remember that there was a day when people who were not straight could not get appointed to the bench. Now they do, and those appointments frequently come through Nominating commission not majority-populated by gays and be executives who are not gay, and that is how it should be.
The next time you bitch about a lawyer with a civil background that is appointed to the criminal division, keep in mind how prejudiced a view that is. What difference would it make if they know nothing about criminal law. At least, they can read that and learn it.

My friend from law school got a job in a small prosecutor's office in the north east. He ended up prosecuting a fetching young woman for welfare fraud, who he then started having a sexual relationship with.

One weekend, after an evening of heavy drinking, he decides to bring her back to the office and ends up having sex with her on the District Attorney's couch.

When he shows up for work on the following Monday, he is fired and escorted out of the office. While never confirmed, it was said that the office had hidden security videos ...

Actually, your position is the more overtly PC perversion. You'd have the characteristics of the the litigants or cases determine who or what the presiding judge should be. Should judges that don't have children be prevented from serving in the juvenile division? Those that don't drive be kept away from traffic cases? How about racial or ethnic considerations? Should black litigants get black judges? Jews? Catholics? Native Americans? Not to mention that your premise is based on the assumption that gays don't
experience domestic issues. Really??

I'd guess you're a republo-Federalist Society-libertarian-homophobe that has, like the rest of your ilk, has found a smug, pseudo-intellectual means of expressing your least-common-denominator prejudice and ignorance. Have fun sleeping with you Palin poster. Or is it Pawlenty??

Written on nearly every file. it meant someone better do something on the file - usually it meant resending discovery, or sending additional discovey.

If it meant doing real work, like responding to a C4, you would just stick it in the pile of files, and when it came up again, let the next ASA deal with it in court.

in Midtown and pretend that they’re on their way to spiritual superiority. These people who look at you with pity and condescension if you dare admit that you don’t “practice” breathing while sitting with your legs crossed. Do you really think developing an ability to sustain discomfort for extended periods of time makes you better than me? If you need to believe that the way to stop feeling shitty about yourself is to squeeze into over priced tights and be manipulated by some “guru” who has come to yoga because they can’t hold down a real job – fine. Before yoga grew into the scam that it is today, it was called stretching. It was the thing you did before you exercised. oh-- and it was also what you did if the police pulled you over for drunk driving. Yes, once upon a time, extending your arms out and touching your toes was a way to tell if you were sober. Let's Face it-- yoga is for people who are too lazy to exercise.

I hear your words but wonder why the anger? In the last year yoga has helped witht two medical problems drs could not solve including one where I kept getting sinus and ear infections. Its effect on my body has been substantial in area where "traditional" exercises have never helped. I have better balance. I wake up cravng certain poses. I don't preach , but for me yoga has been a blessing which arrived right when I needed it.
