HAPPY THANKSGIVING


(no this is not a judicial convention)



Three football games for our consideration today.

Green Bay goes to Detroit where the home town Lions are getting 3.5. The over/under is between 48.5 and 47.

The resurgent NY Jets go to Dallas where they play the suddenly mighty Cowboys. The boys are giving up 13.5 and the over/under is 47.5


The Colts roll into Atlanta where the low flying Falcons cannot wait until this season is over. Their QB is in jail, and with him their hopes of the playoffs and beyond. No pun, but this has been a dog of a season for the Falcons. (Ok. Bad pun.) The Colts are 13 point favorites and the over under is 41. Avoid the line here and take the over.

Detroit is a dangerous team today. They are playing their second game at home after losing to the NY Giants last week. In many ways, the Lions season is on the line today. Wanna have some fun? Eschew (“avoid, or shun” for you robed readers) the points and take the money line: lay 100 to win about 155. Green Bay has nothing at stake here while the Lions have everything to lose. Nervous about not getting any points? Then take the home dog- you’ll never go broke taking a home dog in the NFL. We also like the over 48.

J…E…T…S….can’t do it twice in a row. With a bye week, they had two weeks to prepare to shock the Steelers last week, who turned in perhaps their worst effort of the season. But now the Jets have a short week to prepare for the Cowboys who are riding high. Washington gave the boys about the best competition these cowpokes are likely to see until they meet up with the Packers in the NFC championship game in January 08. Take the pokes, leave the gravy and the Jets.


Enjoy your holiday and remember today is about giving thanks. As young American men and women are on battlefields overseas, please take a minute to remember the sacrifice they are making so that we may give thanks in peace with our families today.

I was in Beth Bloom's court this week and only one of the hot PD's is still there but, the replacement is hot too.

The new prosecutors there are about as dumb nd a convention of county court judges and Beth super speed demon Bloom was off her ADD meds and was going at 10000 miles per hour.

Must disagree- the ASA's in Bloom are very fair, nice, and hardworking. And yes she still has the hottest PD's- but there were five sexy ASA's lighting up Newman's courtroom the other day. He has a virtual harem in there.

although i respect the job our troops are doing dont forget that they volunteered to enter the service mainly because they have no skills to market in the private sector.

12:54, most of the enlistees are fresh out of high school. What kind of marketable job skills did you have at 18? That isn't an attack, it's an honest question. A large number of soldiers who chose to enlist did so as a means of paying for college and obtaining marketable skills. Such resourcefulness and determination is also worthy of respect.

Today is a day our government has chosen that we should give thanks for what is given. What about tomorrow??? We live in a ruthless, non forgiving, and selfish society. I ask you lawyers and judges that tomorrow remember today.

I must admit- I checked the link out. And indeed there is a video of Rumpole running. However, it is of poor quality so I have decided to let it stay up.

To my football fan- I went 3-1 as I liked the Lions to win or the Pack not to cover. Oh well.

9:11 PM- very interesting post indeed on the "other" Broward Blog- the Broward advocate. In A nutshell, a dade defense attorney sitting in court on a case assigned to a Broward ASA did nothing as the Broward ASA didn't get notice for the case, and the Dade ASA's couldn't find a file. Eventually the case was nolle prossed.

Rumpole says: No worries mate. You can re-file a nolle prosse and if the story is true, that Defense attorney has just burned his/her bridges with that Judge and prosecutor. Hope it was worth it. If the story is true- and it might not be- that is NOT the way you practice law.

but the owner became gloomy

walked none other than Shumie

"Bring me Turkey and stuffing"
"bring me carrots and peas"
all the waiters were scared
and they fell to their knees

after a great big feast
only one Turkey leg was left
and Shumie reached for it
like a hungry beast

but a little old lady
who had just sat down
reached for the leg and said with a frown

"You have eaten and eaten and your fork moved with a blur
please let me have this leg
and don't cause a stir"

all the waiters grew quiet
the chefs all said "hush"
and for a moment or two some thought there would be a rush

then after a burp
and a scattering of peas
the Mighty Shumie rumbled
"only if you say Please"

This night is famous
but not for carrots and peas
but it is known as the night
Shumie got kicked in the knees.

This is no different than a situation when a case is assigned to a specialized unit of the SAO (like economic crimes, sex crimes, career criminal, etc.) and the prosecutor for that unit is not in the courtroom when the judge calls the case. The normal thing is to tell the judge that so-and-so is the prosecutor on the case and to pass it. Prosecutors from those special units do the same when they get there and the defense attorneys is in another courtroom.

The defense attorney in this case gained nothing for their client by taking advantage of the situation to get a nolle prosse because such nolle prosse would be a nullity since the Dade SAO was not prosecuting the case and, thus, could not nolle prosse it.

The defense attorney should have just said to the judge: "So-and-so from Broward is the prosecutor in this case" and the let the judge take it from there.

I believe Shumie to be a frequent contributor to the blog in the form of "fake so and so" and may, along with some co-horts like Lurvey, Lyons, and Blecher, be Rumpole himself. If you buy into that proposition, then lets say Lurey or Blecher does the Shumie posts, and Lyons will put them up. See how it all fits?

Silly debate about what the defense attorney did.

First, do we actually know what happened?

Assuming de do, the defense attorney had no legal obligation to say anything, just a moral obligation, like stopping a kid from running into the street.

After his name is spread throughout the broward and dade sao, and all the judges, he'll receive his just desserts
