PARTY TIME

POMPANO BEACH, Fla. (AP) -- Now Tank Carter has even more time to think about how much he enjoyed that Super Bowl party.
A judge increased jail time from six months to five years for the brother of Pittsburgh Steelers safety Tyrone Carter because he failed to report to prison on time for driving with a revoked license.
Tank Carter went to the Super Bowl instead and said he had no regrets.
He was to report to a Broward County prison on Jan. 6, but decided against it when his brother told him the Steelers had a good chance of going to the Super Bowl.
"Even knowing what I know now, I would do it again. It was the greatest game in my life," said Carter, who watched the Steelers beat Seattle from the 50-yard line in Detroit on Feb. 5 and partied with rapper Snoop Dogg after the game.
Tyrone Carter said he would have done "the same thing" for his brother.
The two have been close since growing up in a rough section of Pompano Beach and winning the Super Bowl meant "we finally made it together," Tyrone said.
On Tuesday, Broward Circuit Judge Stanton S. Kaplan upped the jail time.

What do Dade Judges have to say about this?

Assuming the Defendant is just stupid….and had a dumb but human reaction to an unusual situation.
Is it really fair for him to sit in prison until 2011?
Wouldn’t 364 have been sufficient?
What if the Steelers make the Super Bowl next year….what lawyer wouldn’t love to go before Kaplan with a motion for a furlough?

See You in court….but as we have said before….just not north of the border.

this happened to me in dade and the judge told me to "put in on calendar in a couple weeks" The only difference was that my client didnt go to watch his brother in the super bowl, he was hiding in a closet.

however, this moron should stay in for a while for using that excuse -albeit true. He embarassed the judge. Let him sit for a year, nad then, if he can get the judge tickets to Super Bowl 41, he should be released.

Half the problem with our system is that no one takes judges seriously anymore. He intentionally violated a court order (and admitted he would do it again). He deserved the 5.

The Judge can't up his sentence unless he sentenced him to more time and agreed to mitigate it upon his return. He can only tack on 6 months for contempt. Good case law on this. Kaplan...you are a douchebag. (Print that Phil)!

For whatever it's worth...Judge Kaplan granted our Motion to Suppress on a heroin trafficking case.

Rookie poster here. As a north of the boreder lawyer, lets face it you do this before Stan Kaplan you are going to get crushed. I am just surprised after admitting to partying with Snoop Dog he didnt have to drop a urine

5 years for "intentionally" violating a court order. If that is fair, be consistent. When an ASA violates a court order (ie motion in limine), give em five years.

Didnt that happen in a trial in front of Leban? The asa got fired, not 5 years.

Judge Stanton Kaplan doesnt accept pleas; only open offers to the Court. He also regularly rejects pre-negotiated pleas between state and defense.

VOTE HIM OUT and double your fee for cases in his division; it's truly painful to sit in his court for hours. (no calls out of turn and he is soooo old calendars take till 4pm)

Stanton Kaplan redifens the word asshole.
