JUDGE BRONWYN MILLER & JUDGE MCKENIZE OBSCURE REFERENCE

JUDGE BRONWYN MILLER GETS OPPOSITION

Alert readers posted this weekend that newly appointed County Court Judge Bronwyn Miller has received opposition from attorney George Alvarez.

I served as an ASA with Bronwyn Miller. Yes, she is qualified, but face it.... she is a first time appointee judge up for election. She has no funds, has never run a campaign and has been a judge for only a short while. She is also a non-hispanic who is going to have a tough fight getting "re"-elected in Miami-Dade County. She is a perfect target. Remember that 99.999% of the electorate has no idea who Bronwyn Miller or Geroge Alvarez are, but are going to cast a vote anyway. It's a coin flip.

Regarding Judge B. Miller's competition--This is what Dade County is all about: Attempt to replace an extremely qualified, hard working competent judge with an unqualified incompetent one. To the voters of Dade, (dead and alive), FYI, South Dade Justice Center already has one incompetent lazy judge, they don't need another. Our money is on Judge B. Miller as well. We are in for 500.00

Rumpole responds to the Judge Miller race: We know Judge B Miller. She is hard working, intelligent, and will not go down without a fight. Obviously, at this moment, her biggest concern is her opponent’s name. But she can overcome that with good, aggressive campaigning. Here is the election people are wondering about: A non-hispanic female against a Hispanic male. The hope is that the election turns on qualifications. But if it doesn’t, people will be watching to see what characteristic turns out the biggest vote.

I handled a case where the Bailiff for a circuit judge chased down a defendant in the hallway after an arraignment and handed him a business card for an attorney and said... hire this guy.... everything will be fine. The client came to me instead.We reported that to the SAO... they investigated and the bailiff admitted it and got to keep his job and no prosecution for that funny crime prohibiting court people from soliciting clients...Oh well. When you are part of the system... they will screw anyone to keep the system intact.

Rumpole responds: Yes. The constant worry, creeping in the shadows, always looking over your shoulder, life on the run is not fun. Seriously, the most difficult part of the job is when some lawyer or judge saddles over and whispers an amusing rumor. Then we need to worry: is this a red herring designed to out us? How can we print it without giving away our identity to that person? You would be amazed at the stuff we have had to sit on because only one person told us, and we couldn’t blog it.
The only regret we have is the very few times we have had to look a person we like and respect right in the eyes and deny we are the blogger. Lying is not our style, but we just don't see a way around this problem. Anyway, the identity thing has died down.
But as we recently emailed a lawyer who is obsessed with our identity,

“face it, the fact the blog is written anonymously makes it much sexier than if you knew who was writing it.”

If our identity was positively confirmed we would stop, as how could we effectively practcie before Judges who might be angry at a comment?

County court judicial terms are 6 years, not lifetime appointments. I wish more sitting judges would draw opposition. Just because you're doing an okay job doesn't mean there might not be others out there that are better. (Post is meant to be general, not to any specific people.) Plus, I've seen way too many county judges burn out during their 2nd term. After all, how many times can you listen to defendants tell you they need more time to get a valid DL or that the state isn't ready because they don't have an accident report. I think it would get to me after about two weeks.

the only problem is the more contested elections the more checks you have to execute. it's a tax i would rather evade.

Please, can we have some picks on how Judge Newman is going to perform in the hearing? Can there be someone snapping photos of the other Judges wincing as Newman grand stands and thinks out loud? Is it true that he would not participate in a group hearing if he could not lead it? I think this may be a suicide mission they have sent Newman on. The bench is giving him enough rope to hang himself with.

The Federal Blog "beneath the robes" or something like that, used to run commentary on the hottest federal judges (male and female). But at this particular moment, with a campaign looming before her, we just can't imagine that Judge Miller is very happy when the comments on the blog referring to her looks rather than her qualifications to be a judge. She was a pretty tough and aggressive prosecutor. [no pun intended on "pretty"]

Nobody commented on Judge Leifman's looks, or Judge Schwartz's hairdo when discussing their races respectively. But since things are getting pretty sexist, we're gonna come out with a new sexist poll real soon. "Have you ever boinked....opposing counsel, a witness, the judge, etc.?

Rump, maybe people commented on her looks because they don't know anything else about her. How many people who practice at MJB have gone to So. Dade and had a case in front of her? This may be the battle of the unknowns.

Just because Miller was a "tough and aggressive prosecutor" doesn't necessarily qualify her for the position she holds. I can think of more than one person that has extensive courtroom experience, but I considered less than perfect for donning a robe. I have yet to appear before her since the appointment, so I can't comment on what type of job she is doing and if she is qualified to remain in that position. How many of you have actually APPEARED before her?

In addition, how many of you know the relatively unknown George Alvarez? Whose to say that he isn't qualified or won't do a better job than Miller? Don't start crucifying the guy because you don't know him. He may win this thing and surprise everyone in a judicial position. Go for it George!!! You got balls! Count me in for $500!

Advice for Rumpole...if you are worried about people telling you false rumors just to find out your identity, why don't you take those red herring's and post them as a reader...then they will be out there, but will be untraceable...just an idea...wouldn't want you to have to sit on good gossip. By the way, wouldn't ann Rand completely disagree with what you are doing, or do you consider yourself a cyber-Dominique Francon?

Good idea, and we have done that, albiet very few times. Usually, whatever rumor we hear, turns up in a few other places and then we go with it. As to Ms. Rand, what about runing a blog is anti-objectivist? But, just because we like her novels, and believe she made valuable contributions to the field of philosophy, does not mean we live our lives as she would have liked us to. If you read the books written by those closest to her (the seperate accounts by Barbara Brandon and Nathaniel Brandon) you will she that she was a deeply flawed person as an individual. Her brillance was her curse as it were. She could never find an intellectual equal and it haunted her into making very grevious errors in her personal life. Thus, while we rely on her philosphy and tools for decision making in many areas of our life, we don't really care what she would of thought of us personally. She probably would have thought polls on "boinking" were a waste of time as well, but it makes us laugh.

Judge Newman is a perfect Judge to decide the issue. He has as much courage as any county court judge and will not be dazzled by the name Hirsch. He doesn't take sh** from people like Fat Ed, Fat Jim or Slick Dick...Bobby R. (who should be mentioned because the other DUI kings are mentioned) don't pull no sh** (like...I need a continuance because the State didn't spell Officer Davenport's name correct and I was prejudiced) and is willing to try a case. "Mitch! Bring down a panel!". I would love to see what the rate of pleas for those guys are in Judge Newman's court.

You all also make a big mistake to think Judge Newman anything other than intelligent.

I have practiced in front of Judge B Miller...She's nice and knows what she's doing. I don't know Alvarez, but nobody is writing about his looks. Anybody see a double standard?

s.dade? where's that? as for all these campaigns, i wish donations were illegal, i'd be a lot richer. 500 a pop for every campaign (and its non deductible). explain how thats not a business expense. if i wasnt an attorny, i wouldnt know the judge, and feel obligated to pay up. thats a cost of doing business. dang IRS.. d'oh!

Juge Miller is a very caring compassionate,and capable. I wish their were a dozen more like her. The fact that she is so beautiful only makes her stand out more!
