COMPUTER SEIZED???

Props to Super Defender Lynn Overmann. Police arrested her client. She got the cop arrested for perjury. From the Herald article: "I think it's a bit of poetic justice that the man who wrongly arrested him has at least tasted what it feels like to be inside a jail cell" said Lynn Overmann.



JUDGE’S COMPUTER SEIZED???

The Herald reported that the office computer of everybody’s favorite whipping boy, Juan D’Arce was seized yesterday in a daring day light raid on the chambers of Judge Ivan Hernandez. However, some are whispering that His Honor’s Dell was “D’Arce’d” as well. Before we degenerate into specious speculation on what could be on that “hard” drive, lets give Judge H some props.

Many Judges would have thrown D’Arce out on his d’butt before d’herald article debuted. But Judge Ivan Hernandez stood by his employee, defended his right to campaign for the candidate of his choice, and didn’t fire D’Arce.

Loyalty. Not a trait much in evidence these days. We congratulate Judge Hernandez for standing up for his JA. If His Honor email’s us, we can recommend an honest bondsman.

OK. What could possibly be on that hard drive?

Speaking of censorship, in reply to a previous post, whomever is posting "[deleted]" is a troublemaker. We haven't been deleting any posts. If we delete or edit a post, rest assured we now announce it so everyone knows. Congrats to Lynn Overmann!
Its one thing to convince the state to drop charges against your client after they have held him in jail for the past 14 months but it is especially sweet to get the cop fired and then prosecuted for it!

Every ten years or so they charge a cop with perjury so state attorneys can somewhat credibly argue in closing " Why would officer so and so risk perjury charges to come in here and blah, blah, blah".
Cops commit perjury all the time and almost no one cares. The cops consider untruths little white lies as long THEY believe a subject is guilty.
prosecutors and Judges often look the other way. In a swearing contest between your client and a cop...well, you know .
Does anyone care if a cop falsely claims something was in plain view so long as she hasn't planted it?
I believe Very few cops would lie to frame a person they believe is innocent. How much does it matter when cops lie to convict people who are guilty?

My client was innocent - the State immunized the actual dealer during the internal affairs investigation. I don't think the fact that lying is pandemic is a good reason to ignore it - just nice to be able to prove it every once in a while.

Lynn, I was not commenting about your case specifcally, ( Great job !). It just seems more often than not we all are stirring the muck. Nothing is black and white just a big gray mess. And it is sweet every so often to have a totally innocent client and to be able to prove it. congrats

I have known Judge Hernandez for many years and have always found him to be very ethical, professional, courteous and diligent. I cannot believe that he would intentionally allow his JA to run campaigns from his office. That being said, has anyone pulled up the Judge's campaign report from the 2000 election to see how much Pericles was paid for consulting? Or did the "consulting" firm contribute to the Judge's campaign?

It is a legal impossibility that Iven Hernandez or D'Arce operated illegally from the SDJC--THEY ARE NEVER THERE! The last time Hernandez worked on a Friday, Ford was President.

Our system of justice works on the assumption that the police always tell the truth. If we're going to give their testimony such weight, the consequences of their perjury should be equally weighty. Accordingly, I agree that they should be punished more harshly. However, I think brutal prison ass-raping, as suggested above, is needlessly cruel. A regular prison ass-raping should be deterrent enough.

They are of copys refusing and threatening undercover reporters asking for complaint forms at various local stations. Should be prosecuted in a couple cases.

Whay hasn't Bennett Bummer's office ever go after bad cops? When was the last time you saw Bennett, Weed, Rory, or Warren giving a press confrence on the need to clean up these departments? All you criminal defense attorneys who are getting in line to gang rape this cop in prison are really showing your true colors. Need I remind you all of this thing called PRESUMPTION OF INNOCENCE?? Or does that only apply when you represent the defendant or when the defendant is one of you? For all those of you who are so eager to see this cop get it, maybe you should remind yourselves that one is presumed innocent until proven guilty. You all who are posting your fantasy punishment for this cop are just a bunch of HYPOCRITES. It is no wonder that criminal defense attorneys are viewed by society even lower than used car salesmen and county court judicial assistants.

i agree in part dissent in part. the cop is innocent until proven guilty and any true criminal defense atty, if paid well, would love to represent the him. however, if found guilty perhaps an ass wax is in order. he put an innocent man behind bars with his purjury. i rather one ass rape then having my freedom deprived for 14 months. though i would insist on a condom.
your comment about criminal defense atty's is stupid and shows that you will be nothing more in life then a lawyer that says 'and then what happened officer?'

The part about being a hypocrite must have hurt if your little zinger at the end was meant for a prosecutor that you assumed must have written the previous post. Well, it is not only lawyers who read AND post here, but observers of the criminal justice system do to. This observer is amused when any lawyer climbs their high horse and makes statement such as the previous ones, but only when it suits their best interest. Yeah, the cop deserve to go to prison if found guilty, but practice what you preach, let the system go forward as it was designed.

I believe I read Former officer Gary ultimately admitted to lying.
So if true the presumption doesn't much Help. There is nothing more dangerous than a lying cop!when caught they need to be made an example and pilloried.
They can lock anyone up whenever they want to and there ain't shit you can do about it. The most powerful guy in the world is a cop they can arrest a congressman , judge, the president, Etc and its your word vs his. Nice to know the only qualification for the job is a high school Diploma or GED. SCARY. A cosmotology license requires more training.

If I were to need a criminal defense attorney I would find the sleaziest and most dishonest one I could afford, but since I don't make tons of money and cannot pay to keep you all living in the lifestyle you want to be accostumed to, I will settle for any assistant public defender. At least they are not in it for the money, and they can beat the crap out of any of you "privates" in trial...even if they work for Brummer.

As someone who was a pd for several yrs, Pd's do it b/c its a cake job with nice benefits and, if you suck up to the right people, a pretty good paycheck, too.

I don't think a 19 year cop was beaten, threatned, or tricked into a false confession.nor do I think the cops wold fabricate a confession against a fellow cop. Sometimes I say stupid stuff. Some people think, i'm an a-hole, Some actually like me.

I handled a case where the Bailiff for a circuit judge chased down a defendant in the hallway after an arraignment and handed him a business card for an attorney and said... hire this guy.... everything will be fine. The client came to me instead.
We reported that to the SAO... they investigated and the bailiff admitted it and got to keep his job and no prosecution for that funny crime prohibiting court people from soliciting clients...

Oh well. When you are part of the system... they will screw anyone to keep the system intact.

The recent seizure of Judicial Assistant (and future blimpie's sandwich maker) Juan D'Arce's computer has uncovered some startling finds. Among the items discovered are the CMI Intoxilyzer "source code", Fmr. U.S. Senator Thomas Eagleton's shock treatment reports, Ed Newman's real SAT scores, and Jason Grey's ego.

In support of his Judicial Assistant, Judge Ivan "Semper Fi" Hernandez points out that D'Arce has a "constitutional right" to conduct political campiagns from a judge's chambers. The learned judge handed over his copy of the Constitution and directed this reporter to look up this right under the Fourth Amendment. I was unable to find either.

Anonymous,If you want to go around calling me a pussy you really should use your name . If you want to fight (I assume you don't have the guts) I am easy to find. Justice building, every morning or south florida boxing on 164th st 4 or 5 nights a week. I will fight you when and wherever you want.
