WEEK NINE

And after going 5-0 last week, Rumpole is mighty fine heading into week nine.

Who won the suicide pool?

Who told you to take the Colts and the under when the entire football picking, grit eating world (note the obscure reference to “My Cousin Vinny”. I’ve had a lot of coffee this morning.) was picking the Cheaters and especially the Under?

Rumpole. That's who. Trial Lawyer. Football tout extraordinaire. (There. I’ve just about guaranteed a losing day today.)

The Buffalo Bills rumble into Miami as a road favorite. Buffalo? The team with the most injuries since the 82nd Airborne stopped the German army at Bastogne in the Ardennes Forrest in December 1944? Yes, those Buffalo Bills are a road favorite, against a home team coming off a bye week. What does that mean? It means you run from this game like a Judge asking for a favor. Stay away from it. No picks here.


The Cowboys play the Giants in New Jersey. We’re beginning to think that these Cowpokes are just a mite bit overrated. While the Giants have rallied and surprised us, as we had them winning about two games and their coach fired by now. The Giants are coming off a bye week, and the line is anywhere from even to the Giants favored by 1.5. The under line is 49, and we like the under. Good teams play good defense, as we very well knew last week in the game of the millennium. Take the Giants big, and take the Under small.


Jax plays the Titans at Tennessee. We like the Titans -4, and we like the under 35. It’s a low number, but these teams have a history of playing under. That being said, don’t bet the mortgage on the under. That was for last week. Just a couple of six packs worth of under is enough here.

There is just not a lot of match ups we like this week. So rather than push it when it isn’t there, we’re going to leave our picks as they are: but here are a few thoughts:

The Dolphins/Bills o/u is 40-41, and something tells us this could be a shoot out. Good teams play good defense, and neither of these two teams qualify for the label good, so the reverse corollary is true: bad teams play bad defense.

Norv Turner in San Diego should be arrested on suspicion of murder. He took the super bowl contending Chargers and killed them. Somewhere Marty Schottenheimer is laughing. The Colts would be the play but for the issue of how bad are they hurting for blowing a game they should have won? Tony Dungy is the class of the coaches here, and in the NFL. They don’t come any better than Dungy, and if anyone could have his team ready to go, it would be him. The problem is that in this business you go broke fast betting against home dogs, and the Chargers are getting 3.5, so be careful.


Steelers pounded the Browns in week one. But since then the Brownies have a new QB and a three game winning streak. Something tells us that the men of steel are just not as good as they looked Monday night. The Ravens got old fast. We think the Steelers will win this one, but it could be close. An angry team looking for revenge with a new QB says to us to leave the game alone.

Don't forget at 11:00 AM today what is really important. 2 Minutes of silence is the least we can do to remember.

    5 - You are willing to spend your life looking for little loopholes in the scientifically established age of Earth (few billion years), but you find nothing wrong with believing dates recorded by Bronze Age tribesmen sitting in their tents and guessing that Earth is a few generations old.

    4 - You believe that the entire population of this planet with the exception of those who share your beliefs — though excluding those in all rival sects - will spend Eternity in an infinite Hell of Suffering. And yet consider your religion the most “tolerant” and “loving.”

    3 - While modern science, history, geology, biology, and physics have failed to convince you otherwise, some idiot rolling around on the floor speaking in “tongues” may be all the evidence you need to “prove” Christianity.

    2 - You define 0.01% as a “high success rate” when it comes to answered prayers. You consider that to be evidence that prayer works. And you think that the remaining 99.99% FAILURE was simply the will of God.

  4. First of all it's week ten. The fins are 0-9 so I get confused. Need the Gints to win here for a comeback today. Is it wrong to dock your boat to watch football at the dockside bar? I think I'll just have another Pina Colada and sleep here tonight and motor home to port in the morning. Limited connectivity here so sorry about missing any posts. Will clean it up Tuesday. The Fins really are bad aren't they? It hurts to see our once proud team so bad. Can Shula come out of retirement?

  8. 4:54 -- Bravo! I've had discussions with people who fit all of these categories. As an agnostic leaning toward atheism, it never ceases to amaze me how narrow-minded, overbearing, and unyielding fundamentalists can be. As far as I'm concerned, organized religion has caused more war, killing, intolerance and hatred than any other factor.

  12. There is a difference between a criminal defense lawyer and a spokesperson. A defense lawyer is a fighter. A spokesperson on the other hand, such as Mark Eiglarsh, merely goes on the news to discuss various issues. For example, Eiglarsh was recently on the news just because he had somebody's record expunged. Big Deal. When you hear about a case on the news and then you approach the potential defendant and offer to do the person's case for free just for the air time, that is a disgrace to the profession. A person in trouble with the law doesn't need this kind of person. When was the last time Eiglarsh actually charged a person to handle the person's case. I think it was 1963, before he was born. When was the last time he actually tried a case? I think it was 1961, before he was born. Real lawyers accept tough, challenging cases when necessary not softball cases that everyone knows will be dropped at arraignment. That's why I respect lawyers like Roy Black. There are other lawyers who promote themselves a lot like David O. Markus, but at least they have the goods and the results to back it up. I respect David O. Markus. Tell Eiglarsh to try a case or go somewhere and sit down.

    Joseph George speaks about the Regional Counsel Office:

    After getting this letter from the County that said:

    “While the lawsuit is pending, we do not intend to consider funding for facilities and other expenses related to the Regional Conflict Counsel’s Office in Miami,” Glazer-Moon wrote.

    George (who has been cramming the fledgling operation in his own law office) said:

    “Candidly, my visceral reaction was surprise and discouragement. But I’ve never allowed myself to stay down in the valley of discouragement. My whole life, I have been keeping people away from symptoms of depression and moving forward. I felt I had been handed a big lemon. Because of my love of fruit trees, it was a Ponderosa Lemon. Now, let’s make lemonade.”

    He also said:

    He is optimistic about this new public service mission. He has hired retired Judge Bruce Levy as his chief assistant and Richard Joyce, formerly with the Justice Administrative Commission, who’d recently argued a dependency case before the Third DCA. The next day, he was interviewing a law student graduating at the top of her class at St. Thomas who told him she “believes in defending and protecting the vulnerable.”

    Attorney [forer attorney] Barry Kutun, 5660 Collins Ave., Apt. 6-A, Miami Beach, suspended effective 30 days from a September 27 court order. (Admitted to practice: 1966) Kutun entered a guilty plea to three felonies, one in Miami-Dade County and two in Broward County. All of the cases involved engaging in sexual acts with a minor.

    It appears the County has relented its position after the grown ups
    in Tallahassee complained.

    To your dimwitted and foolish post, I only have three things that I feel compelled to say in response. First, I believe that a stronger choice would have been to use a question mark to end your first sentence (posted above). Secondly, that would be a pretty neat trick if I could charge someone legal fees "before I was born." Finally, I hope you find the happiness that is obviously absent from your life.     Never thought you would see the words "triathlete" and "Kuehne" in the same sentence?

    BEN KUEHNE, a member of The Florida Bar Board of Governors from Miami, put his focus in a different direction by becoming an “Ironman.” Kuehne, 53, successfully competed in the Inaugural Ironman Louisville, which consisted of a 2.4 mile swim in the Ohio River, 112 miles of biking the rolling hills of Kentucky horse country, and a 26.2 mile run. He finished in 16 hours.

    Footnote: Kuehne will be buried on Tuesday. (just kidding).

    it is true that the county mang. has offered mr. george space that has not been built out. the space is located in liberty city. mr. george does not want the space because the area is violent, it is to far from the court house and it does not have parking.

    the county commission has yet to place the matter on its agenda.


    my sources tell me this is far from a done deal.

  23. I was once, in the mid 90s, appointed to defend a robbery with a firearm case. there were 3 codefendants. Mark Eiglarsh had one of them. He came to a depo, heard the evidence, and moved to withdraw immediately, No publicity and difficult case. He ran away so fast it was pathetic.

  31. Peter Adrien applies for the Federal Bench. The only good part of this is that it is in the Middle District. Let's see, if he gets the appointment he will be leaving town. Hmmmm, the Middle District's loss is our gain.

    Nope, I am not that selfish. It is only 1100 more days and Peter Adrien will be off the bench for good. I am a pattient man.
