WE'RE BACK

We're back from the briny sea, tanned and ready to take on the day.

Is there an opening on the Federal Bench? Some comments over the weekend mentioned some Judges. We read Melvia Green's name, and she would be an excellent choice. We read another name, and quite frankly we can't think of a worse Judge in the entire State of Florida. But that is for another day.

The Dolphins march on towards an imperfect season. No team has ever finished the season win less, but our once proud Dolphins seem primed to make a run at it.

You could spend your free time in a lot worse ways then reading the Pulitzer Prize winning book "An Army At Dawn", which details the US Army's initial involvement in WWII: Operation Torch and the invasion of North Africa.

Mondays off or Fridays off? We'd pick Fridays off every time. The craziness of a combined Monday/Tuesday calendar on a Tuesday when the courthouse is dark on Monday is just not worth it. Friday calendar's are lighter and it's easier to absorb the Friday cases on Monday. Plus it's more fun to start the weekend Thursday night.

We really have no idea what's going on in the REGJB, and we think we have rambled enough.

    36 Step Up For 2 Open Federal Judgeships ...(Tampa Tribune)

    The Middle District openings are the result of decisions of two judges - Susan Bucklew in Tampa and Patricia Fawsett in Orlando - to take what is called senior status next August.

    These people have applied:

    Douglas W. Abruzzo, an administrative law judge from Johnston, Pa.; Peter Adrien, circuit court judge from Miami; ......(AND THE LIST GOES ON NAMING ALL 36 APPLICANTS) including Melvia B. Green, a state appellate judge in Miami; .....

    Did you say that no team has ever finished the season winless?

    When the franchise entered the league in 1976, the Buccaneers lost their first 26 games. That is 0-14 the first year and 12 straight loses in year number two before winning their 13th game.

  5. The good news is that if they pick Adrien, we don't have to deal with him in Miami anymore. Perhaps O'Connor in Broward should apply also.

Who ever is screaming about the comment from a year ago about their family memember (and I have a pretty good idea who it is) if you want to send me a private email to discuss the matter without screaming and cursing I will be happy to speak with you privately. Be prepared to discuss 1) why I should give a damn based on your futile attempts to have me disciplined and to sue me; 2) why, if you don't read the blog as you have claimed, you somehow stumbled across this. If your email, without any homophobic curses as your last batch of comments had- can explain this to me, I will be happy to take the comment down.

  8. I stand corrected by El Capitan. My favourite quote from that Bucs team was by the coach, the wonderful John McVay, who when asked about his team's execution, answered that he was in favor of it.

  9. Only because it could be missed as a comment on yesterday's post, I re-publish my comment from this morning:

    Peter Adrien applies for the Federal Bench. The only good part of this is that it is in the Middle District. Let's see, if he gets the appointment he will be leaving town. Hmmmm, the Middle District's loss is our gain.

    Nope, I am not that selfish. It is only 1100 more days (actual count) and Peter Adrien will be off the bench for good. I am a patient man.

  11. Peter (“If I only had a brain” hereinafter referred to as “No Brain I”) Adrien is being interviewed by George W. (“If I only had a brain” hereinafter referred to as “No Brain II”) Bush for nomination to the Federal Bench in the U.S. District Court for the Middle District of Florida:

    No Brain I: Oh Mr. President I appreciate your invitation to the White House. I understand this is Federally subsidized housing. They say they are going to evict you next year. I can help you with that. You know I am an expert at representing people in evictions from Section 8 housing. I actually made $40,000 a year doing that for 10 years.

    No Brain II: That is impressive. It shows you have a firm grasp of the Federal Statutes and the Constitution. You know I was as successful an oil man and baseball team owner as you were a lawyer. Oh course as commander in chief is where I really excelled. I hear you have done really well as a Circuit Judge the last 2½ years.

    No Brain I: That is not all we have in common. I could really use this seat in Orlando. I am being run out of Miami, just like you are being run out of Washington. Like you I have no friends and everybody is out to get me. Don’t they see that I am the smartest person on the bench. Like you I am the great decider.

    No Brain II: Who says I have no friends. I have Carl Rove and Dick Cheney. Okay so what if Hughes has left me and Gonzalez has slunked off back to Texas. Besides, how can you compare your decisions to those I have to make.

    No Brain I: See I told you I was smart. I know more about you than you know about yourself. I could do your job. Sit here behind closed doors and see only the people you want to see. That is easy, but screwing each person before you to their face, now that is something. I’m good at that. I’ve got this Assistant State Attorney, a real idiot, but mean as all get-out. Between the two of us we beat up on every poor shnook that comes in the door.

    No Brain II: Tell me where you stand on abortion?

    No Brain I: I wait outside for it to be over.

    No Brain II: Do you believe in Executive Privilege?

    No Brain I: Certainly. I get a table at Joe’s whenever I want and I have my own bathroom in my chambers.

    No Brain II: Will you enforce our system of checks and balances?

    No Brain I: Oh I don’t have to do that. My wife uses Quickbooks. It does it automatically.

    No Brain II: You are perfect. I am pleased to tell you it is my intention to nominate you for the Federal Bench. You will have to be confirmed by the Senate.

    No Brain I: Oh sir, I can’t do that. I was confirmed by my church when I was very young. I can not convert now.

    No Brain II: I understand. I really do. We will find another way. Maybe a recess appointment.

    No Brain I: Oh I love recess. Let’s go out and play.

  17. Rumpole, just to correct you once more: The coach of the winless Bucs was John McKay, not John McVay. John McVay was GM of the Niners, among others, around that era. John McKay had previously won national titles as head coach of the USC Trojans.

  20. The State no-actioned all charges against Jeffrey Weinsier, the Channel 10 reporter arrested for armed trespassing on school grounds by Dade Conty Schools Police. ASA Maggie Gerson no-action the case because Weinsier was never on school grounds, the commnds of the school board police were not lawful, and Weinsier never disrupted a school function because children had already been dismissed.
