Rump, according to the Indictment, before Trump makes the highly incriminating “consensually recorded” statements on page 16, he says “this is off the record”. Any opinion on how this might impact admissibility of the recording?
All these morons who are giving money to Trump for his "Legal Defense Fund" should read this. Even the most ardent and deluded believers have to start questioning their support for this traitor in light of the facts. This man should never be allowed near the White Housel.

If what is written in the indictment is true, the man should never be free again.

It was just last week that this came up. After Miranda, a defendant gave a full confession. Unfortunately for Florida, before he confessed the Defendant said, “ this is off the record.” Motion to Supress, granted.
You hit the nail on the head. Off-the-record statements are never admissible in evidence. They cannot be included in the record, because they are off the record.
