HERRERA HAMMERED

Attorney Jose Herrera, who was once the counsel for the Miccosukee tribe, but has since lost that plum job with his disingenuous handling of a case, that for a time unfairly besmirched the reputation of two fine lawyers,  (see our coverage in 2013 of that contretemps here) has been found GUILTY by Judge Tunis, who was the appointed Bar Referee.

Sanctions come next. It won't be pretty.

Rumpole - "unfairly besmirched the reputation of two fine lawyers" jumps off the page.

Remember when the Miami Herald and Jay Weaver almost daily and certainly weekly, would extensively cover this "case" when it was nothing more than accusations on paper in a civil case, and contributed heavily to the promotion of the false allegations of these now guilty lawyers?

Does anyone else notice that once the truth started to come out, Weaver literally ceased coverage and as a token, it seemed like the Herald would have O'Valle write a brief article and then bury in on page 6?

Does anyone else think its weird that the Herald doesn't report the demise of what appears to be the second of Jay Weaver's three "reliable" "sources?"

Just remember that, next time Jay calls to ask about one of your cases.

Following up on your "Pink" lawyers piece, I saw Sara Shulevitz in the courthouse today. She was playing up every conversation in the hallway like she was auditioning for a new reality show. Except there were no cameras around. Something is off with her, obviously. But when someone acts this strange, you gotta start asking questions about competency. Seems inevitable that some judge is going to whack her for hamming it up in the courtroom.

Maybe someone else has seen this too.

I dealt with "Pepe" years ago. Dealing with him was one of my worst professional experiences. He is disingenuous at best. Our profession is better than him. Permanent disbarment is the only suitable sanction.

Sadly, unless this lowlife scumbag and his disgusting cohorts lose ALL of their money or lose their freedom, none of this means much.

Yeah, they don't wish to lose their licenses, but face it, they have no shame. Their licenses are just for money making. They've never used their respective licenses for anything honorable in their lives.

As long as they have some of their dirty money left and their freedom, they'll figure out some way to make more money.

Let us know when the system really imposes a punishment on a dirty lawyer that fits the crime.

If you are interested truth look at the cases of U.S. v. Juan Rene Caro Southern District case 08-cr-20044-JAL-1 start around DE-601 and read the filings in the Southern District Bankruptcy cases 05-01429-LMI,09-bk-36408-LMI & 11-02138-LMI. This is good stuff.

LOOKS LIKE A 2 MILLION DOLLAR YACHT FROM NEVIN SHAPIRO FOR 600k FOR LEGAL FEES AND THE LAWYER BUDDY GETS AN EXPENSIVE WATCH FOR THE WIFE AS A GIFT FOR ACTING AS INDEPENDENT COUNSEL FOR SHAPIRO TO DO THE DEAL. IF ONLY WE CAN ALL GET THOSE KINDS OF DEALS. TABAS MANAGED TO GET SOME MONEY IN THE CLAW BACK. EVERYONE SHOULD READ THIS STUFF IT IS VERY INFORMATIONAL.

Roman was found guilty of conduct including “dishonesty, fraud, deceit or misrepresentation,” “obstructing another party’s access to evidence,” “knowingly making a false statement of material fact or law to a tribunal” and ­”counseling a client to engage, or assist a client, in conduct that the lawyer knows or reasonably should know is criminal or fraudulent.”

Herrera was found guilty on 18 counts involving multiple violations of rules governing candor toward the tribunal, fairness to opposing parties and counsel, meritorious claims and contentions, actions prejudicial to the administration of justice, and maintaining the integrity of the profession.

Hey didn't Tein represent Jeri Beth Cohen when she made the comment that all Cubans should go or be sent back to Cuba? Of course she was only expressing her most inner feelings during a momentary lapse in discretion, she just did not expect the fall out. So Tein came to her rescue. Don't try to excuse or dismiss the racial and ethnic devide or the level of prejudice the lies beneath the surface. The sub silentio discremination that exisit in the system is remarkable. So 3:30 when you say the Mafia of Sleaze, you should look both ways, including in the mirror. And yes I agree with Hector Lobana's approach to the issue.

Bernie Roman and Pepe Herrera have been convicted of serious ethical violations that rise to the level of criminality.

It’s sad that they would invoke ethnicity to try to explain their crimes. Doing so denigrates the rule of law and all latins. I don’t think their last ditch effort at a “ defense” is resonating in the Cuban Community.

Just looked up the Ramon Rodriguez case SC-17-36. Judge Cueto the referee. Different field different ball game. Lets see how billing millions of dollars in legal fees and obstructing discovery to prevent collection of the judgment by Ramon Rodriguez plays out in front of Cueto. Didn't Dresnick say something like the fees collected by Tein made his eyes spin. How do you explain the Bar giving lawyers who bill excessive fees and obstruct discovery a pass, but then go after Ramon Rodrguez for trying to collect a judgment.

Assuming 9:37 PM Where is the evidence of Ramon Rodriguez taking money under the table from Bernie Roman. Why not discuss the fees billed and paid in the case. Why not discuss the sanctions for obstructing discovery. Those are issues that will play out before Judge Cueto. Your identifying yourself as a Cuban is a nice touch which fools no one who can read.

Since you want to discuss fees, why not discuss the fees Bernie got paid? It was millions by the way, for not winning a single case he concocted and costing his clients millions more.

I'd think Bernie wrote @11:51, except that it's mostly grammatically correct. Maybe he had someone else write it for him though, like most of the things he files. If you've ever had the misfortune of having to listen to him speak/whine, you'll understand.

@11:29 could totally be Bernie.

Whether or not Ramon was paid by Bernie is not at issue (in this case). So what exactly are you trying to say? If he didn't get paid, does that make him a more ethical criminal or a more stupid one?

I wonder if the Florida Supreme Court will live stream the permanent disbarment proceeding for Bernardo Roman III and Jose Maria “Pepe” Herrera? When the Supreme Court permanently disbars them, will it hold separate disbarment hearings or give them the professional death penalty together?

How come so many of Bernie's accessories to his crimes were let off the hook? They signed their names to frivolous and false pleadings and they argued things they knew to be lies in front of the court. Why are none of them held accountable?

The reason people think lawyers are sleazy is in part because of that type of behavior, and the reason the field is full of lawyers like that, is because YOU DON'T DO ANYTHING ABOUT IT.

And if your excuse is they're young, they're new, they didn't know any better...
First of all, bullshit to that.
Second, congratulations. You just taught a group of young new lawyers that there are no consequences for their unethical behavior in your field.

I'm sure we can expect great things from all of them in the future!

How long is it going to take for unethical attorney Pepe Herrera to be disbarred for life? Has anyone bothered to look at his association to the City of Sweetwater, the Manny Maroño family and the current Sweetwater administration? It is high time this individual is told to close his office for good. The legal business can do without the underhanded tactics practiced by Herrera.
