TAKE FOOT. OPEN MOUTH. INSERT.

IN WAR: RESOLUTION. IN DEFEAT: DEFIANCE.  IN VICTORY: MAGNANIMITY. IN PEACE: GOODWILL.
Winston Spencer Churchill.

Judge Jacqueline Schwartz, if nothing else, has shown us that she is no WSC.

In Victory? Piss off the Miami Hispanic community.
This is what she said about her reelection:

When Schwartz won reelection  Tuesday over lawyer Frank Bocanegra, she issued a statement saying voters had "gone past the days when any nondescript Hispanic could go on the ballot and defeat any Anglo sitting judge."

David Ovalle's article on Schwartz's latest misstep is here.

The Cuban-American Bar Association fired back:

In a letter sent to her on Wednesday, the Cuban American Bar Association said "the statement is incompatible with your duties as a judge and with the dignity of judicial office."
Her "troubling" words suggest that "some or all of your Hispanic colleagues on the bench achieved their positions by virtue of a 'nondescript Hispanic name' and not because of their hard work, professionalism and other qualifications," CABA President Ricardo Martinez-Cid wrote.

Schwartz tossed the letter in the trash before going out for a lunch of Arroz con pollo, or maybe as David Ovalle likes to muse, arroz con mango.  (she didn't really do that as far as we know).

Remember that during the campaign Schwartz  told a store clerk to "Go F themselves" when they refused to take down a large Bocanegra sign. (See our post in September "...And the horse you rode in on."

Next up for Judge Schwartz: why battered women need to toughen up and stop complaining.

In other news, the Lunch and Learn Seminar for November on "Ethics and Ethnic Sensitivities in Miami" to be taught by Judge Jacqueline Schwartz has been unfortunately postponed until never and a day.

See You In Court, where gone are the days....nah. Not gonna do it. Wouldn't be prudent.

Another reason why the Judiciary should not be elected. The voters have no clue who judges are and whether they are good. IT's a stupid system, that makes for stupid judges, of which we seem to be getting more of.

Dios mio!

Don't ever do away with elections though. Take a look at the results for the third re retention. Appointments only mean you are stuck with the appointments forever, regardless of how bad or mean they are.

Term limits. One 8 year term and then back to having to work for a pay check.

8:43 - apples and oranges.

Merit retention has worked in other states. Remember all politics are local. Trial judges are far more visible, and therefore bad ones can be removed. They have been in other jurisdictions, like Colorado.

Electing judges is the worst way imaginable, except for all the others.

I'd take any nondescript Hispanic-named judge over a foul-mouthed, spoiled jerk like her any day.

THE CAPTAIN REPORTS:

Miami Bail Bondsman Charged With Stealing $16,000 .....

From the DBR:

Florida chief financial officer Jeff Atwater announced the arrest of Miami bail bondsman David Rodriguez on grand theft charges.

The arrest follows a joint investigation by the Department of Financial Services' Division of Insurance Fraud and its Division of Agent & Agency Services into a 2013 incident in which the defendant is accused of stealing $16,000.

Rodriguez, 37, failed to turn over the funds that a Margate man paid on behalf of his son to Fire Line Bail Bond. When Rodriguez couldn't answer several inquiries into the son's release date, the victim demanded a refund. Rodriguez refused and cut off communication.

Records show all funds drafted from the victim's bank were endorsed and cashed by Rodriguez. Rodriguez, who is being held without bond, faces up to five years in prison.

"Floridians seeking the services of bail bondsmen are putting their trust in someone during a vulnerable moment in their life, and we cannot allow anyone to take advantage of it," Atwater said.

Hey I thought she was Jewish, which means she is not Anglo or am I missing something in the term Anglo Saxon Protestant. I guess she doesn't even get the fact that she is white, non-Hispanic and not Anglo.

I think the Anglo's should revolt and demand a retraction!

Rump:

Your rightous sense of political correctness hides the fact that what she said was generally true.I am tired of marginal Hispanic lawyers targeting non-Hispanic judges.
I do not think that Mr. Bocanegra was an unqualified candidate. Truth be told, I would have voted for a marginal candidate, Hispanic or otherwise, just to get rid of her.
Granted, in today's demographics, she was an idiot to make that comment. Sort of sounds like the outrage when Jeri Beth correctly observed that we could cut the crime rate significantly if there was no prohibition on deporting Cuban felons.

So, if you're a County Court Judge is it O.K. to have your name used on your husband's law firm website promoting how you prosecuted and defended thousands of cases?

I seem to recall a move to do away with electing judges and go to merit selection and but CABA came out against that because the rationale was hispanics had a better chance getting elected than appointed. Oh well as the old saying goes be careful what you ask for...

Whacky Jackie is by far the best current nickname (second only to Big-Duh.)

What an idiot. And she actually had time to consider that released statement.

Barakat moved quickly and removed his Judge-wife's name from his website. Crisis averted.

To all those who are closet bigots and agree with the idiot Jacqueline Schwartz I suggest we test her hypothesis in August 2016 and 2018 by running nondescript Hispanic females against all non-Hispanic judges. What do ya think professor?

Schwartz is a bigot.

Bob Levy. Why is he allowed to make the actual statement? Jackie Wendy over it with Bob Levy and he approved it and released it. Likely, urged her to say it as he too is upset that demographics have shifted.

Retention and appointments are just as bad. A different group of insiders are targeted and the select their pals. South Florida is not the normal immigrant community. Appointments and retention here is a huge problem.

Last observation, when non-Hispanics were the governing majority there were no complaints from the sitting judges that we had no diversity on the bench. The Jackie Bob Levy statement is similar to the Jerri Beth Cohen statement that Hector Lombana defended. When a non-Hispanic makes a statement they are being targeted it is the same statement as the focus today. Stop making these arrogant statements. If Jackie has to go, Jerri Cohen, Hector Lombana and Bob Levy should be held accountable. These are all the culprits of racial tension. I will not donate or vote for anyone working with them.
