HAPPY THANKS - GIVING

THE CAPTAIN'S FIRST GUEST BLOGGER POST

I would first like to take this opportunity to thank Horace for giving me the chance to be a Guest Blogger. (And to congratulate Rumpole on going an amazing 5-1 in the pros and 2-0 in college this weekend. The '72 Fins are just finishing their last glass of bubbly right about now and smirking at Rumpole for picking the Colts).

In order to maintain public security, ensure the safety of the lives and property of the people and safeguard the smooth progress of the socialist construction, it is imperative to subject criminals who seriously endanger public security to severe punishment. To this end it is decided:

(1) Punishment above the maximum punishment stipulated in the Criminal Law, up to and including death sentences, may be inflicted on the following criminals who seriously endanger public security:

a. ringleaders of criminal hooligan groups or those who carry lethal weapons to engage in criminal hooligan activities, if the circumstances are serious, or those who engage in criminal hooligan activities leading to especially serious consequences; ...
e. whoever organizes reactionary secret societies or uses feudal superstition to carry on counterrevolutionary activities, thereby seriously endangering public security.

As you might have guessed, the above cite cannot be found in your local 2006 Edition of Florida Statutes. In fact, it comes from the People's Republic of China. We all have many things to be thankful for, family, friends, our health, and even the legal system we work in. Whether you are a prosecutor, public defender, private attorney, or judge, we all have an obligation to respect the great system we work so hard in every single day.

So, in this, the week of Thanksgiving, while citizens of other societies are being put to death for "organiz[ing] reactionary secret societies", The Captain would like to know what you are thankful for and what you plan on doing between now and next Thanksgiving to help make our system of justice even better.

I am thankful for having a great guest blogger and for my amazing football picks. Again, I did not lose an over/under bet. I think I have lost ONE all year. I am close to getting 4 of 5 picks right every week.

I tip my hat to the Captain's GREAT post and the 72 Dophins. Your record is safe one more year. Enjoy the champagne.

Now I gotta go pick 12.

Please identify one case Arrojo has prosecuted in the last year that makes him such a wonderful prosecutor. You could hire first year law students and give them a NITA review course, only one case file, and they would be amazing.

Arrojo could not last three months doing the job that most C prosecutors do: trying a case every three weeks and handling a caseload of 220 - 300 cases set for trial. All while the support from above is non-existant, unless there is a screw-up, which invariably will lead to administrators like Arrojo covering thier asses as quickly as possible, while selling you out.

Arrojo is not a prosecutor, he is an administrator who is now doing something you never see in the State Attorney's Office, from a Chief Assistant -- covering for somebody else's screw-up. The only reason it is happening is because the screw-up came from the top, not from somebody below him.

Ever ask yourself why the media relations guru at the SAO (I can't even remember his name) didn't handle the calls from the Herald? Distance this from Kathy.

sould we have a 'star chamber' type court of three judges who can authorize, under limited circumstances, covert court file situations.

i say yes; at leats it is better than the SAO makingthat decision on their own.

I am thankful that BHB gave me a job. And I am thankful that BHB lets me sit on my ass and make 120k
a year without having to even go to
trial.

I am thankful that BHB is not around the office much, so that he cannot see all the wasted talent.

I am thankful that Weed runs the day to day affairs of the office, because no one cares about him and no one respects him.

I am thankful that Warren is still a PD, so that at least there is one attorney there who is slower than I.

I am thankful that Gabe Martin
is in trouble so we can keep these cush gigs for 4 more years.

I am thankful that the young kids all get married and/or have babies and thus need to leave the office to make better money, so I can keep my cush gig.

I can often understand when police officers make major judgment errors in the heat of the moment.

I can sompetimes understand when attorneys make major judgment errors while in the midst of a trial.

I will not understand when SAO administrators and other desk jockeys make these same massive judgment errors while sitting in their offices, with the ability to research, think, ponder, and consult with others.

Can you imagin a prosecutor accepting that a defendant made a judgment error in a criminal case and dismissing the charges? The SAO clearly violated teh law by being a party to the doctoring of public records. It is shameful that Jose Arrojo publically came out and tried to justify those actions.

Prosecutors should be held to higher standards.

Now that it is after 1:30, the chief assistants should be rolling into work to begin thier long work days. Perhaps Jose would like to write in as he was previously invited to do, and explain where the exception exists in the law that allows the SAO to alter and create FALSE public records?

The Herald owes a greater obligation to the community than to print this article once. This should be investigated.

Who will conduct the investigation?

1015 bitter and stupid is no way to go through life. Hate to break it to you you whiny little bitch, but arrojo was a "C" once and held everyother position before being a chief. and he was a "C" in which the judges didnt coddle stupid braindead asa's like the you are or were. instead they expected lawyers with 200 cases to butch up and try 2-3 "C" cases a week. and it worked just fine and whiny assholes like you werent at the sao saying that their lives were too hard. Instead they took the challenge and loved the job and learned everything they could.

arrojo is a great guy and this whole thing with the fake dockets is nothing but an excuse for reizenstein to bloviate--something he loves to do.

Sad to read about the death of Mel Kessler in the Herald obits today.

He really could be a charming friend and a mensch, as well as a pretty creative lawyer.

Unfortunately, he got too close to his moneyed clients, which ruined his career and his life.

Really sad.

It is truly unfair to anonymously castigate Jose Arrojo and denigrate his trial skills simply because you disagree with his position on sealed cases.
Mr. Arrojo tried a public corruption case in my division a few years ago and was very effective. He was also very honorable and is the type of person who will stand up for his people especially if he has authority over them.
