Enter Project Mercy. The NY Times reports here about Denise Dalliare, a woman sentenced to fifteen years for a small amount of cocaine. She was recently released after ten years when the sentencing judge, who could never forget the unfairness of her sentence, mitigated the sentence to time served.
Judge Gleeson, who sits on the Federal District Court in Brooklyn and teaches a course in sentencing at New York University Law School, takes his students and clerks every year to the Danbury prison. He was inspired to do so by his mentor, the late Judge Eugene H. Nickerson, who urged him to spend time in a prison at least once a year to keep in mind where he was sending defendants.
As part of those visits, inmates tell the group about their cases and their lives behind bars. For the past several years, Ms. Dallaire has been one of those inmates...
After his most recent visit to Danbury, Judge Gleeson decided to see if he could get Ms. Dallaire’s sentence reduced. He thought the best way would be to seek a presidential pardon, and he called a friend, Jonathan D. Polkes, a partner in the major New York City firm of Weil Gotshal & Manges, and asked if he would be willing to take on the case pro bono.
The article goes on to state that Judge Gleeson wants to create Project Mercy.
Modeled on the Innocence Project where lawyers would donate time to research and help inmates, Project Mercy would seek out cases of inmates who are not innocent but are caught in a prison system where their sentences were issued at a time when minimum mandatory sentences ruled the day.

So we ask the Judiciary of South Florida to follow in Judge Gleeson's footsteps. How about taking day trips to some local state prisons? How about seeking out qualified lawyers to work on cases with sentences that in retrospect seem wholly unfair?

I have had two cases before Judge Gleeson in the past 6 months. One civil and one criminal. In both cases he was extremely fair. In the criminal case,despite a PSI that gave my client a level 32 he sentenced him to time served and returned him to his native land. But you better be over prepared when you appear in front of him as he does not tolerate fools.He also gave the keynote speech last year at the Waldorf with over a thousand lawyers attended. He does not wear a robe while on the bench during hearings and asks question which lets you know he knows the file and has read everything. Although he has a "boyish" appearance he is a veteran litigator as an AUSA. He could make a fortune in private practice in NY but his heart is on the bench. Some of our judges, who do not have his litigation experience could well take a lesson from sitting in Judge Gleeson's courtroom in Brooklyn. Maybe these local judges would be cured of their self proceived importance and the "black robe fever" that they have. I do not know of any local judge, federal or state who can come close to Judge Gleeson.
ReplyDeleteJudge Gleeson does not wear a robe in court because the greatest judge in the EDNY and perhaps the greatest district court judge in the last 100 years- The great Jack Weinstein does not wear a robe in court. And when he sentences a defendant he often gets down off the bench and sits at table eye level with the defendant. Google Jack Weinstein and read some of his press coverage. He is an amazing judge and man.
ReplyDeleteThe only time any of our local judges go to visit the jails is when they get indicted and convicted - former judges Sepe,Sheinberg,Gelber and Davis come to mind quickly.
ReplyDeleteCommon Sense and good humor are essential for a good Judge. I was in his` division When Phil Davis got busted, I got Arthur Magginis as a replacement Judge for 18 months. One Of the Best Judges ever and a nice man.

I've used the site several times dabling in 20 year olds and 40 year olds including one 42 year old Brazilian divorcee and why her husband left her I will never know. Truly one of the most beautiful women I have ever met. Most are seeking 1-3K a month to help with tuition. As a Jewish woman who frequents your site, I experience those comments as painful personal slurs. I understand that the site is intended to produce robust, raucous and randy debate. But I know there are certain rules of decorum you expect your commenters to observe. I ask that you consider a rule that would protect your female Jewish readers from the type of witless hostility on display in the above comments.
Your comment is well taken. I saw the comments as juvenile and sexist but not anti-semitic because I had no familiarity with what J-date was. I generally will leave those comments up to stew in their slime.

I joined a few weeks ago -divorced male-37- government lawyer- and within a few days was posting about political issues I know nothing about! I never met Rump, but we reached a deal and Rump gets clever, grammatically correct comments and I get an amazing time online.
Two weeks later my girlfriend was a little jealous of the time I was spending on here, though, and started texting me to come back to real life. I am hesitant so she throws in this- she actually loves me, love to have sex with me, and generally is a cheerful smart girl with big tits.

ReplyDeleteLet me see if i can explain this again. I was married in my late 20's. Worked hard. Made partner. Left a big firm as partner and started my own shop when I turned 40. That's when it started. Wife didn't want to cut back to help me succeed. "I struggled with you once and don't want to do it again" she would say. Then I got prostate cancer- lost my business. Went bald from radiation when it had spread and was in danger in dying. Meanwhile she threw a fit when I couldn't pay the gym membership and lease her a new Porsche and all the other things, so we divorced. All of the sudden- I got better. Then I reopened my firm. Worked my ass off alone for a decade and now have hit it big. Started dating women my age or within 5-6 years and they were all my ex-wife. Nagging, mean nasty women who loved to tell me all their dirty secrets about their ex-husbands and trash them for being cheap in the divorce. I started realizing that I didn't want to go through that again. Then I came into contact with some young women- law students and such. And they were so sweet and nice and caring. I take good care of myself. Don't have six pack abs but have no gut and sure, there's less hair on top and a lot didn't grow back after radiation. Eventually I started a relationship with a beautiful, sweet, idealistic 22 year old who didn't have a daddy who gave a damn about her or who had the ability to help her through school. So I helped her. And in return I got the love and sex from an amazingy beautiful woman. Then we split up by agreement when she graduated and got a job in Atlanta. So where do i go to re-create that magic? A bar? Some J-date type of website where I can meet my ex-wife's clone? No- seeking arrangements is the best place for me. It fulfills all my needs and I am respectful to the women I meet and date. What's wrong with that just because i help the girl I am seeing out with some money?

We could go back and forth on this topic for days. Everyone has a sob story but not everyone resorts to having to sell themselves. I know plenty of people who had a hard life but managed to get through life without having to escort or whatever the hell you call it. I'd rather keep my money than pay for love. I'd rather have a woman love me for me and not because she feels obligated because I paid her tuition. Just my honest opinion.

ReplyDeleteI've worked very hard to support myself through law school and in life, and as a result have a strong character and resolve. These women are cheapening themselves and exemplifying what is wrong with this generation. No morals, no character, no willingness to endure temporary hardship for long term gain. At least I can look myself in the mirror every morning and know I have nothing to hide from my children or of which to be ashamed.

If you are presently blocking comments that contain racist or homophobic slurs, I ask that you consider a blog rule blocking sexist and anti-Semitic slurs.
The issue is not simply one of decorum; it has real-world implications for your readers.
The routine and casual brutality toward women undermines their work and sense of self-worth of your female colleagues. Think about the psychological evidence in Brown v. Topeka Bd. of Ed. The African-American children thought the white dolls were prettier and the black dolls were dirty. A female visitor to your blog can't help but internalize the hostility of her male colleagues.
While I understand the principle of allowing such slurs to "stew in their own slime," your tolerance of them here implies approval, because you do moderate comments and seek to promote civility. Furthermore, in general, one such slur operates as a dog whistle to your more sexist readers -- they then feel safe to come out in snarling rabid packs.
I simply ask that you consider blocking such comments as you would presumably block hurtful slurs towards other groups. I'd be happy to help you craft a suitable prohibition. But if you have a wife, or sister, or mother, or daughter, you know what hurts them when you see it. Thanks.

Watching 60 minutes about the case in which the prosecutor tried a murder by arson case with no proof of arson as stated by the investigator who combined bigoted remarks in his report and testimony. That case is very disturbing and to add insult to injury Taylor is pleading no contest to be a free man.
