OPEN STRONG

First Monday in October. You know what that means.... time to check the tax assessment on your home. Also first day of the new session for the Supreme Court.

We don't have a Regional Counsel yet, unless the Governor did something while we slept.

At 0-4 your Miami Dolphins are officially in the mix for being on the clock and causing commissioner Roger Goodell to say next April "With the first pick in the 2012 NFL draft the Miami Dolphins select Andrew Luck, QB, Stanford." With all due respect to Jake Long (who was picked first by the Fins in 2008), the Fins passed on Matt Ryan the last time they had the first pick, and that has hurt them.

Roy Black at his blog has a series of three posts on opening arguments. He advises to spend a lot of time on your opening sentence. We agree. Nothing- and we mean nothing- makes us cringe more in court then when we see a lawyer stand before a jury for opening and the first words out of their mouths is some kiss-ass remark thanking the jury for their service. The jury has spent hours if not days waiting to be told about the case. You have only one chance to make a great impression- don't waste it thanking the jury.

Read this post where Mr. Black compares the opening statement of the prosecution and the defense in the OJ Simpson case and you'll see what we mean. Don't do a Marcia Clark for goodness sakes.

October may be our favourite month. Fall is in full swing, football season is 1/4 over, the summer slow down is over. Yes, October is right up there as one of the best months.

I know there will be much smarter arguments as to why the President shouldn't be ordering the killing of an "american citizen" but really...isn't this "american citizen" over in enemy territory demanding jihad against americans??? "Tell me who your friends are, and i'll tell you who you are"...comes to mind...

  6. Caught a lecture by the Q at the UM. Went off on a tangent and talked extemporaneously for 20 minutes on how a 3-4 Zone Defense with a rolled up strong safety was the very best way to attack a Bubble Screen Modified West Coast Offense. It was the Q's contention that even when the offense adjusted for the rolled up strong safety by putting a Tight end in motion the statistics of over 10,000 plays bore out that the offense could expect a negative net gain (NNG) and the defense would eventually dictate the offense to switching out of the called play.

    The Q should be coaching the Dolphins defense.

  8. roy black's analysis of opening statements on his blog is great reading for anyone trying to learn how to do trials or refresh their skills. what a great teacher! His attention to detail is only eclisped by vincent bugliosi. I watch Mr.Black in court on several occasions and always learned something. Much can be learned by watching others, court tv, and reading books by and about trial lawyers. No someone criticize Mr. Black or me or talk of some inane bs like what to wear to jail.

  10. Seriously, does anyone have an issue with the guys in Yemen being killed? If he was here in the US, they would have been arrested, or killed in a gun battle, not killed by a drone.

    However, once they are abroad, and actively participating in advocating death and destruction to the US, its interests, and its citizens, they become enemy combatants. Then they are fair game.
