BEN KUEHNE CASE DISMISSED!!!

Blogger David O Markus has just broke the story that the case against our friend, colleague, and one hell of a lawyer- Ben Kuehne, and his co-defendant has been dismissed by the Feds.

What a fantastic Thanksgiving for Ben.

Shame on the Feds for dragging Ben's good name through the mud! Sorry David, but Ben gets our next 10 federal conflicts.

Several careful readers have inquired whether Rumpole will be handing out annual "Turkey" awards.

    Remember this guy?
    Hobart Smith III, CLI at SAO circa 1987. Graduated Pepperdine at top of class. Came here. Was awaiting bar results when he started babbling to anyone and everyone he had perfected way of taking music from a tape and compressing it into a digital format (or zeros and ones as he used to scream about) . Right after passing bar but before being sworn in, he pissed off the State Attorney by resigning and going to work for Apple. Napster and then Itunes and the Ipod were all things he had a hand in.

    Hobart turned down a 30K a year job to pursue his crazy ideas. According to the web, Hobart and His 280 foot yacht just got back from a tour of the South Pacific.

    Not a bad career move Hobbie.

    SUPERSEDING INDICTMENT WITH PREJUDICE

    COMES NOW the United States of America, by and through Kenneth A. Blanco, Deputy Assistant Attorney General, and moves this Court for leave pursuant to Rule 48(a)
    of the Federal Rules of Criminal Procedure to dismiss, with prejudice, the Third
    Superseding Indictment and its accompanying criminal forfeiture allegation as to defendants Benedict P. Kuehne and Oscar Saldarraga Ochoa.

    This motion is based upon the totality of the circumstances surrounding this matter, including the changed circumstances occasioned by the affirmance of this Court's dismissal of Count One of the Third Superseding Indictment.     Reminds me of the scene in "Officer and a Gentleman" where Lou Gossett, Jr. is questioning Richard Gere: The good Sergeant is asking the recruit [Gere] about why he is taking flight training -

    Q. "Why are you here?"
    A. "I want to fly jets, sir."
    Reply: "My grandma wants to fly jets."

  16. What an amazing day for Ben! Most of us were all on his side and it's the best news he could have received for Thanksgiving.

    The Justice Department and the U.S. Atty.'s office should apologize on the news for wasting our money on such a frivolous prosecution against Ben. Pushing charges against someone for the hell of it is wrong.

  18. On Tuesday, Gov. Charlie Crist suspended Rothstein from the Fourth District Court of Appeal Judicial Nominating Commission. Crist appointed Rothstein on Aug. 25, 2008 and four days later the lawyer gave $140,000 to the Republican Party of Florida.

    And he wants to be a Senator? I do not think Crist could win a seat for County Sewage Management at this point.

  21. Does that idiot (10:23post) really think Crist knew Rothstein was crooked before he appointed him and before they took the donation.

    I am sick of jerks making up statements like that. It is kinda like blamming the bad economy on Obama. (Yes, some Republicans say hey look at the mess we have now...).

    The correct comment should have been, hey, I bet Crist never met him in the first place. But, then, if I donated that kind of money, I bet I would have lots of meetings with a Republican Governor.

  23. While there are many on the list who have been aptly described as pathetic, I'd prefer to focus on the positives.

    Bill Altfield, Fleur Lobree and Andrea Ricker-Wolfson all would be great judges. All have the intelligence, insight, judgment and termperment to be a good judge.

    Some of the others also may be fine, but I don't know them or haven't seen them in so long that it's not fair to comment (unlike some others, I assume that people change over time and don't think my experience working with or against them several years is relevant today...........unless of course they did something unethical).
