SCARY REGJB STYLE IS......


Walking into Judge Areces or Adrien's calendar on a Friday morning and seeing your client's case is on page 89.


Walking into the Third DCA and seeing Judge Rothenberg on your panel chomping at the bit.


Doing a weekend bond hearing with a new county court judge from Civil.


Trying to get a rational discussion started with a prosecutor on why a drug minimum mandatory should be waived. All you get is "go see David "psych-NO' Paulus".


Trying to get a continuance from Judge Huck. (OK. It's not a REGJB issue, but it's still scary).


Walking into a criminal court North Of the Border and seeing the Former Chief Judge sitting in for your judge for the day. Ouch!!

Rump - I love your blog and your articles/commentaries, but I'm starting to question your qualifications as a defense attorney....
Rumpole replies: My qualifications are well known: I am on time; I have a file; I'm ready to go; my hangover is better after a few aspirin. For religious and personal reasons I will not read statutes nor case law and you can easily spot me as I carry around the 1989 Florida Rules. In my opinion, nothing important has happened since then.

On the issue of early start times: Judge Areces has a system and it seems fair and works. State and PDs' in court by 8:30 A.M.--Private start calling cases at 8:45A.M. Free for all at 9:00-10:00, Don't be late, sigh and a shrug if she has to go back!. Sometimes we come in late, traffic, front door-back door, client tardy. But over all, you can set your watch to her.
Rumpole says: Equal time for a fan of Judge Areces.
And maybe it's a little unfair to make fun of Judges Adrien and Areces and the large calendars they have. As Judge Moreno used to say when he was a Circuit Court Judge "That blind clerk doesn't like me."


JUDGE REYES'S BAILIFF

The comments section on the previous post has some complaints about Judge Izzy Reyes's bailiff. Here's what we know: As long as an individual is not being disruptive, anyone in America has the right to sit in any courtroom as long as that courtroom is open for business. No one- not a bailiff, not a police officer, not a Judge, has a right to tell anyone they cannot sit in a courtroom that is conducting business, unless the proper procedures have been followed for sealing the courtroom.
If we recall, this issue was raised North Of the Border, where the new Chief Judge responded that outside of legitimate space issues, bailiffs would stop baring anyone who was not a defendant from entering the courtroom. We don't think the problem is that bad in Dade and doesn't Joe Farina have other problems to worry about?

    I never stated that Mr. Lombana was PAID for what he does. Duh - I think any reasonable person knows that - but thanks for pointing it out - for the few who may actually think a Treasurer is paid.

  3. THERE IS A NEW START-UP BLOG REGARDING THE COURTHOUSE NORTH OF THE BORDER.

    Let's see what they can do. It appears to be admittedly moderated like this BLOG, and hopefully they can steer clear of the infighting, hidden censorship, political agendas, and other garbage that appears to have been the downfall of JAAB.

  4. Nightmare is having a case set for trial in Judge Scola or Adrien's Division and instead of being placed on 1 hr standby, being required to come back to court every freaking day of a two week trial period.

    Nightmare is if Judge Schwartz does not like you.

    Nightmare is if your client violates probation before Judge Ward.

    Nightmare is having to deal with ASA Kahgan or ASA Frank-Aponte on any matter.

    Nightmare is being at Sounding in line to call a case behind colleagues who can't simply announce ready or not and instead feel that they have to explain every little fucking thing to a judge who did not even ask them for a reason. Shut up already!

    Good afternoon everyone. This is Fake Judge Robin Faber. I would like to remind everyone that I am a duly elected jurist to the second highest level trial court in the entire state of Florida.

    Since I issued my previous order against untoward humor and frivolity on this blog, I have seen an alarming increase in crude humor, off color jokes, rampant talk about women's body parts, and basically a full ignorance of my order and command. I am a serious fellow. I deal with serious issues. I remind you I have a stack of community service that needs to be done.

  27. Funny you should say that- Rothenberg is Butchko's Rabbi. They vacation together (will Leslie recuse herself from BB's cases?) and Rothenberg helped Butchko get the political consultants lined up for her application to be Judge, not to mention Butchko's work on Rothenberg's failed attempt to become a prosecutor when Milan SPANKED her in the primary.

    Please: Every Julio, Juan, Herb Kleins, or Rosalita, with a law license, consider running against the BB.

  31. Did Judge Butchko legally change her name from Beatriz to Beatrice or is Beatrice a nickname? With judges like Marino, Barzee and Adrien adding Pedraza, Flores and Camacho to their names, it's kind of curious that Butchko would anglicize her Spanish first name.

  34. While I know very few here would give two flying you know what's about most of the things happening North of the Border, JAAB has just posted that its president, Craig Esquinazi, has resigned, effective October 30, 2007.

    With Bill Gelin, the front-man for the BLOG, ousted (and his posting privileged revoked) and Craig Esquinazi, the president leaving, the question remains who if anyone is actually left?

    From my count, the only others sticking around are the glorified court reporter Marshall Williams, who fancies himself a judge-maker (although on my count, he hasn't put up a winning candidate ever) and Jeff Ivashuk, allegedly a former Chippendales Dancer and current criminal defense hack.

    It doesn't sound like the magical combo great political movements (or blogs) are made of to me.

  35. What is it with Butchko's calenders? I had a sounding in there and I couldn't get in the door. There were more than 80 pages. I couldn't find my client, the line was 10 deep and it was 10:30! She sits up there and she tries to seem nice and polite but you can see she has a temper and a mean streak. She wants to know about all the cases and she sticks her nose in to shield the completely overworked ASA. And then she says she doesn't want to get involved. Very confrontational and obviously has a problem controlling her audit. It was like practicing law at Walmart the day after Thanksgiving. Was she a prosecutor at one time? You can tell she has never defended anybody.

  38. I believe that Judge Butchko inherited that horrific caseload from previous judges, and is doing all she can to reduce it. Ergo, the SAO's (and some defense counsel's) annoyance. Continuances truly are for good cause only.

    I have sat in her court for long periods of time while awaiting opposing counsel, and have NEVER noticed her being anything but polite to both sides, and the defendants as well.

    That being said, she doesn't take crap from either side and lets her displeasure be known if she senses it. Once again, politely.

    I would gladly appear before her again.
